SECTION C. DESCRIPTION/ SPECIFICATIONS/ STATEMENT OF WORK

C.1 Scope of Work

This contract is for travelling approximately 583 miles of National Forest System roads on the Eldorado National Forest to produce an inventory of road signs.

An inventory report shall be produced to include all regulatory signs, warning signs, and guide signs (brown horizontal signs) within forest roads classified as operational maintenance level 3 through 5. Other signs such as portal signs, informational signs, etc. are not part of this inventory.

There is no accurate existing inventory of signs, sign locations or sizes of signs. There is an outdated inventory from 1992 that may be used as a reference.

The contractor shall travel all roads designated in the contract, stopping at each sign location to collect inventory data on each existing sign that meets the criteria described in this contract (regulatory, warning and guide signs). After this first step is completed, the contractor shall provide an inventory report to the Contracting Officer for review and final approval.

Sign data shall also be collected for gates immediately adjacent to designated roads or on the designated roads.

The completed sign inventory is intended to become an accurate inventory for future use by the Forest Service.

Note this contract does not involve replacement of any signs or posts.

C.2 Project Location & Description

The project is located within the boundary of the Eldorado National Forest. See the project maps in Section J.

Caution is needed when driving on mountain roads, as current conditions are not always known and can change rapidly. In general, roads can be expected to be accessible with a high clearance pickup truck during non-winter season.

The contractor should be prepared to cut fallen logs and debris out of the road in the event vehicle passage is obstructed. Notify the Contracting Officer’s Representative (COR) immediately of any road failures or obstacles that may impact safe continuation of data collection.

C.4 Estimated Start Date & Contract Time

Start: October 3, 2022

Time: 100 days

Final inventory report must be submitted no later than May 1, 2023.

It is advised that the contractor target higher elevation areas of the project early in the performance period, to ensure completion before snow prevents access.

C.5 Restrictions on Work

Work shall be performed during daylight hours between 0600 hrs and 1800 hrs local time.

Exceptions to these times are:

1. In accordance with the fire plan, if included in Section J.

2. When the Contracting Officer (or designated representative) determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable road damage.

3. In accordance with any Forest closure orders that come into effect during period of performance. Annual seasonal closure of native surface roads typically goes into effect from January 1st through April 1st.

C.6 Licenses and Insurance

The contractor shall obtain the insurance and licenses listed here.

Worker’s Compensation Insurance: The Contractor shall provide evidence of Worker’s Compensation Insurance or a valid reason that exempts the Contractor from the requirement.

NOTE: The Contractor working alone is not required to carry the insurance.

If the contractor fails to provide the documentation within 10 calendar days after contract time begins, the contract may be terminated for cause in accordance with FAR 52.212-4.

C.7 Technical Requirements

C.7-1 Definitions

Maintenance levels define the level of service provided by, and maintenance required for, a specific road.

Level 3. Assigned to roads open and maintained for travel by a prudent driver in a standard passenger car. Roads in this maintenance level are typically low speed with single lanes and turnouts.

Level 4. Assigned to roads that provide a moderate degree of user comfort and convenience at moderate travel speeds. Most roads are double lane and aggregate surfaced. However, some roads may be single lane. Some roads may be paved and/or dust abated.

Level 5. Assigned to roads that provide a high degree of user comfort and convenience. These roads are normally double lane, paved facilities. Some may be aggregate surfaced and dust abated.

C.7-2 Specifications

General:

1) Contractor personnel shall wear Personal Protective Equipment (PPE), such as high visibility vests or clothing, and use proper temporary road warning signs at each stop location to warn traffic of a stopped vehicle and working personnel who are taking the inventory.

2) Provision of all personnel, materials, equipment, and supplies to complete the inventory are the responsibility of the Contractor.

The USDA Sign and Poster Guidelines for the Forest Service (https://www.fs.usda.gov/Internet/FSE_DOCUMENTS/stelprd3810021.pdf) shall be used to answer technical questions that arise.

1) Regulatory and warning signs are found in USDA Sign and Poster Guidelines of the Forest Service Chapter 3A and 3B.

a. Table 3A.1 and Tables 3B.1 include the types of signs that are used for this contract.

2) The sign code of warning signs that apply are found on pages 3B-2 through 3B-5.

3) Guide signs, including route markers, considered for this contract are found in Chapter

3C.3 and 3C.4 in the USDA Sign and Poster Guidelines for the Forest Service, pages 3c-1 to 3c-15

In case of technical questions that are not answered in the USDA Sign and Poster Guidelines for the Forest Service, the Manual on Uniform Traffic Control Devices (MUTCD) shall be used for determining requirements.

No changes to direction in the USDA Sign and Poster Guidelines for the Forest Service shall be made without approval of the Contracting Officer.

Sign Inventory:

Inventory shall be performed on all roads, Level 3, 4, and 5, identified on the project map.

The project map is georeferenced and can be used on a GPS enabled device with an application that uses PDF maps.

The map has the designated roads and most gate locations identified. Not all gate locations may be identified. In cases where there is a gate present that is not shown on the map, the https://www.fs.usda.gov/Internet/FSE_DOCUMENTS/stelprd3810021.pdf

Contractor shall inventory the gate and make note of the map discrepancy in the inventory report. Similarly, if a sign is physically missing compared to the 1992 inventory, identify the missing sign in the inventory report.

All mile posts shall be to the 1/100 (hundredths) place and the contractor must ensure they are listed on the inventory in sequence from the beginning of the road to end.

Inventory data tables or spreadsheets equivalent to those shown below (Table 1 & Table 2) shall be completed by the contractor.

Information shall be prepared and returned to the Contracting Officer in a format that can be sorted and filtered, such as Microsoft Excel.

Photos of each sign and gate shall be taken and catalogued in the sign inventory with an embedded link or other method approved by the Contracting Officer.

Photos need not be high resolution but must be clear and usable, without need for enhancement or alteration by the Forest Service, to identify the sign type, text, and condition;

this includes condition of the post or other mounting method.

Note: Table 2 does not provide a place for individual gate signs. The reason is that gates have standard size signs and a standard number of signs. Photo(s) of existing signs on gate is important. If any sign is missing or damaged, all gate signs will be replaced at the same time, thus no need to specify condition of each gate sign. Typical gates have red and white object markers (FBM-L and FMM-R) with yellow type 2 object markers (Type 2 OM) on posts (front and back). Tape will not be allowed as an alternative to FMB and OM object markers.

Upon receipt of the completed sign inventory report by the Contracting Officer, the government shall have 2 weeks to review the sign inventory report deliverable and provide any recommended changes back to the contractor, who will then have 2 weeks to make any corrections.

C.7-3 Contractor-Furnished Equipment

Contractor responsible for furnishing all equipment, software programs, vehicles, personnel to perform scope of work.

C.7-4 Government-Furnished Equipment

Government will make available to Contractor any existing reports or data applicable to the project.

Contractor would be responsible for making copies if necessary.

SECTION E. INSPECTIONS AND ACCEPTANCE

E.1 Government Inspections

The Government may review preliminary data submitted by the contractor at reasonable intervals during the completion of each line item of inventory work (line items 1-4) and provide feedback, if requested, on the acceptability of method and data quality. Delivery of preliminary data shall be made in method acceptable to both parties. These reviews are not considered “final inspections” and do not guarantee acceptance of the line item for payment.

Government inspections shall not be relied upon by the contractor to provide notification of unsatisfactory performance and do not relieve the Contractor of the responsibility for maintaining quality control.

Final Inspections. Final (formal) inspections for payment will be made on completed line items only.

Contractor shall request final inspections in writing and submit all data generated from the line item work.

For inspection and payment of line items 1-4 data need not be in Final Report (line item 5) format but must be presented in a fashion that clearly demonstrates that field work has been completed and has generated the level of information needed to later complete the Final Report.

Re-inspection after Rework. Where rework after a failed inspection may improve the inspection results, the Contractor may rework the failed item(s) and request a second inspection. The Government may charge to the Contractor the cost of this additional inspection. Re-inspection will be accomplished within five working days after the request is received.

E.2 Determination of Acceptability

Work on this contract will be deemed acceptable when the Government’s inspections determine data quality and usability of 90% or higher.

F. DELIVERIES OR PERFORMANCE

F.1 Work Timing

The Contractor shall begin work within ___10_____ calendar days after the effective date of the Notice to Proceed and shall prosecute the work at a rate that will result in completion of all work by May 1, 2023.

Failure to begin work on schedule will make the contract subject to immediate termination for cause.

Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time. The Government reserves the right to set the priority of work items.

F.2 Winter Shutdown

When winter weather sets in and the continuation of work is impractical, the Contracting Officer may authorize a total suspension until such time as work can proceed. During the period of total suspension, the calendar days elapsed will not be charged against the contract time.

SECTION G. CONTRACT ADMINISTRATION DATA

G.1 Pre-work

Pre-work conference. Before work begins on service contracts, a pre-work conference is normally held to discuss the contract – especially the specifications, labor provisions, plan of work, and selected standard clauses. The pre-work meeting should be attended by an officer of the firm or someone designated in writing to act on behalf of the firm. The pre-work meeting may be waived at the discretion of the Contracting Officer.

G.2 Payment

Payments and Deductions. Payment will be made for fully acceptable work at the prices bid in the schedule of items. In the event of extended non-work periods because of adverse weather, the Contracting Officer may authorize progress payments for partially completed sub-items on a case-by-case basis. In accordance with the inspection clause, payment may be made for less than fully acceptable work at a reduced price. Other exceptions are noted below:

Payment will be made in full if inspection results are 90 percent or higher. No payment will be made if inspection results are less than 80 percent.

Contract Release. Before final payment will be made, the Contractor shall sign a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release.

A Contract Release FS-6300-0016 must be uploaded with request/invoice for final payment in IPP, before final payment will be approved.

A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C.

15).

G.2-1 Invoice Processing Platform (IPP)

All payment requests must be submitted electronically through the US Department of the Treasury’s Invoice Processing Platform (IPP). “Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in FAR clause 52.212-4 Contract Terms and Conditions – Commercial Items. The IPP website address is: https://www.ipp.gov.

Each invoice shall be submitted on the Contractor’s letterhead or invoice form with the following:

1. Invoice date and Government Contract Number.

2. Billing period specified with beginning and ending dates. The beginning date must not be later than the completion date or within any previous billing dates.

3. An accounting (bulleted list, for example) of charges claimed and amounts due.

4. Total amount due for the billing period.

A Progress Report shall be submitted to support each invoice and shall include a summary of work performed during the period of performance identified on the invoice.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor’s Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 – 5 business days of award or the system implementation date. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with their proposal or quotation.

SECTION H. SPECIAL CONTRACT REQUIREMENTS

H.1 Emergencies

Fire Plan. See attached Fire Plan.

Area of Responsibility for Fire. Unless otherwise noted elsewhere in the contract, the following define the limits of a contractor's area of responsibility for fire under the terms of the Fire Plan:

H.2 Safety

When conducting surveys, vehicles shall have standard warning lights on to warn other drivers. Contractor responsible for safety of employees.

H.3 Superintendence by Contractor

The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the English language.

H.4 Final cleanup

Before final acceptance, all areas occupied by the Contractor in connection with the work shall be cleaned of all contractor’s rubbish, excess materials, temporary structures, and equipment, and all parts of the work area shall be left in a neat and presentable condition.

H.5 Public officials not personally liable

There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them by, or within the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.

H.6 Designation of Contracting Officer’s Representative (COR)

The Contracting Officer designates the Contracting Officer's Representative (COR). The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer must be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract may be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)

On all matters that pertain to the contract terms, the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment.

H.7 Approval of Subcontracting

The Contractor shall request approval from the Contracting Officer prior to entering into any subcontract arrangement. The subcontractor shall have the experience and equipment necessary to perform all subcontracted work. The written notification shall include as a minimum:

1. The name, address and telephone number of the subcontractor;

2. The date upon which the subcontract will be entered into and its duration;

3. A detailed description of the work being subcontracted with a listing of contract items or units;

4. Documentation of the subcontractor's representative authority.

Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.

Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR 13:

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
