ATTACHMENT 1
1. GENERAL INFORMATION
1.0 The United States Department of Agriculture (USDA), Food and Nutrition Services (FNS), Office of Retailer Operations and Compliance (ROC) is seeking a contactor to enhance the Supplemental Nutrition Assistance Program (SNAP) integrity in the area of retailer investigations.
1.1 The Government intends to award a single Firm Fixed Price Contract to assist ROC’s goal of eliminating fraud within SNAP. ROC is specifically tasked to examine and curtail fraudulent activities aggressively and the need to increase resources by utilizing external certified undercover investigators.
2. PRICING
2.0 The resulting Contract will incorporate the Vendor’s completed pricing sheet (Attachment 2). In addition, FNS requests that the Vendor include any available discounts.
3. PERFORMANCE
3.0 Period of Performance
The period of performance for this Contract is as follows:

3.1 Place of Performance
The vendor shall perform all tasks at their facility.
There will not be Government Furnished Property for this contract.
4. INSTRUCTIONS
4.1 FAR 52.212-1 – INSTRUCTIONS TO OFFERORS – COMMERICAL ITEMS –
(JUN 2020)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. (1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212- 3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.

5 | P a g e specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2) (i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest;
accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.

The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1)The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.
(2)The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3)The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4)A summary of the rationale for award;
(5)For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6)Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

4.2 ADDENDUM FAR. 52.212.2 - EVALUATION-COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers.
1. Technical Capability (includes Technical Approach and Management Approach)
2. Past Performance
3. Price.
Technical Capability and Past Performance, combined, are significantly more important than
Price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
1. BASIS OF AWARD
The Government will select the best value by conducting a tradeoff among all of the evaluation factors. A Firm Fixed Price Contract will be awarded to the Vendor who is deemed responsible in accordance with FAR Part 9, as supplemented, whose quotation conforms to the solicitation’s requirements, (to include all stated terms, conditions, representations, certifications, and all other information required by the FAR 52.212-1 Addendum of this solicitation) and is judged, based on the evaluation criteria to be the best value for the Government. CPARS and FAPIIS searches will be conducted to determine if the selected awardee is a responsible Vendor.
2. EVALUATION CRITERIA:
FACTOR (1) – TECHNICAL CAPABILITY
The Government will assess its level of confidence that the Vendor will successfully perform the solicitation requirements based on the Technical Capability information submitted in the Vendor’s quotation.
The Government will evaluate the overall quality, reasonableness and comprehensive understanding of the Vendor’s technical and management approaches as to whether they include detailed narratives that clearly outlines the methodology for accomplishing the requirements of the PWS.
Quotations shall consist of three volumes, as follows:
Volume 1 – Technical Capability - Includes Technical Approach & Management Approach
Volume 2 - Past Performance
Volume 3 – Price
TECHNICAL CAPABILITY – TECHNICAL APPROACH AND MANGEMENT
APPROACH (VOLUME I) – NTE 40 Pages Total
The length of the technical approach volume shall not be more than 20 pages total. The length of the management approach volume shall not be more than 20 pages total. Vendors are encouraged to submit the fewest number of pages responsive to the Performance Work Statement requirements using the quotation section page limits as cited within this section. The Pricing information SHALL NOT be included in the technical quote. The directions provided within this section assist in providing a fair and equitable evaluation of all quotations received. The Agency may determine those quotations not following the directions to be unacceptable, and if so, shall receive no further consideration.
Quotes shall be submitted via email with the solicitation number in the subject line.

All files shall be compatible with Microsoft Office product(s) and/or Adobe software.
1. Cover Page (not to exceed 1 page) –
At a minimum, this page shall include the Vendor’s name, address, taxpayer ID number, CAGE code;
Vendor’s Point of Contact to include name, title, phone number, and e-mail address; the solicitation number and date of submission. This page shall also include a quotation validity date of no less than 90 days.
2. Technical Approach (not to exceed 20 pages) and Management Approach (not to exceed 20 pages)
At a minimum, the following shall be addressed:
1. Technical Approach
a. The vendor shall provide examples of proof of the ability to provide highly technical reports in the form of ad-hoc, weekly, monthly as well as predictive models of future work performed by investigators and staff.
b. Remote access - Vendor needs to demonstrate that the investigators will have the ability to remotely access the agency network for investigation documentation purposes. Notation of all vendor supplied smart devices/laptops.
2. Management Approach
a. The vendor shall demonstrate a collaborative approach to management while working with federal, state, and local government when applicable. The vendor shall demonstrate flexibility in their work flow while accommodating numerous and frequent changes in the investigative environment.
b. Case management - Vendor needs to demonstrate their experience in case management oversight involving thousands of active investigations, occurring simultaneously and nationwide.
c. Quality control processes – Vendor needs to demonstrate their internal quality control processes. NOTE: The Vendor must notify the Contracting Officer if, between the time of quotation submission and award, their proposed key personnel will be unavailable to perform under the contract post-award.
PAST PERFORMANCE (VOLUME II)
a. The vendor shall provide verified proof of above satisfactory performance in investigations and cases involving public benefit fraud, Supplemental Nutrition Assistance Program (SNAP) related investigations, undercover work, or other white collar crime in a government arena. The Vendor must also provide past performance references, in their response, for at least three (3) most recent contracts held, to include those in progress. Only references for same or similar type of services will be considered. The Government reserves the right to independently verify the accuracy of the information provided and to determine Vendor’s performance on the related work with respect to the following
10 | P a g e factors: technical performance, quality of work, project management, compliance with agreed upon schedule and customer satisfaction.
b. If the reference does not submit a past performance questionnaire, the reference will not be considered in the relevancy and evaluation of the Vendors past performance.
c. Vendors must provide past performance information in accordance with the instructions and format provided in Attachment 3. It is the Vendor’s responsibility to send the Past Performance Questionnaire to its customers and direct the customer to submit the completed survey to Vanessa Boger-Wallace at Vanessa.Boger-Wallace@usda.gov and a copy to Antoine Boissonniere at antoine.boissonniere@usda.gov, no later than Friday, June 11, 2021, at 3:00 PM EASTERN. Past Performance Surveys received after the due date will be deemed late and may not be considered.
PRICE (VOLUME III)
An offer must be made on all items in the schedule. The total price shall include the unit price, quantity, discount terms, and total Firm Fixed Price to be eligible for consideration of award.
The price quotation shall include the following:
1. Your company’s Taxpayer Identification Number (TIN) and Dun & Bradstreet Number (DUNS).
Your company must have an active System for Award Management (SAM) registration.
2. A complete pricing sheet (Attachment 2) for this solicitation in Excel format.
3. Using Attachment 2, the Vendor shall list each labor category it proposes to use in performance of the PWS, indicate the unburdened unit price (hourly rate) for each proposed labor category, and indicate the proposed number of hours for each labor category listed. The Base Year and each Option Year/Period on the Attachment 2 spread sheet, shall be populated by the Vendor.
4. The Government seeks other discounts. The Vendor should clearly identify if any additional discounts are provided, using the Attachment 2 spreadsheet.
5. The Government reserves the right to obtain data, other than certified cost or pricing data, as necessary to establish fair and reasonable pricing.
6. This Contract includes FAR Part 52.217-8 Option to Extend Services. For evaluation purposes only, Vendors should include an additional six (6) months.
3. EVALUATION FACTORS:
The resulting Contract will incorporate the Vendor’s completed pricing sheet (Attachment 2). The Government reserves the right to incorporate any other part of the awardee’s quotation, in part or whole, into the contract. If the Government elects to exercise this right, the Government will address with the awardee whether or not that aspect of the quotation needs to be protected due to being proprietary or a trade secret.
FACTOR 1 – TECHNICAL APPROACH AND MANAGEMENT APPROACH
Technical approach: The vendor will be evaluated on the soundness of the proposed technical approach and whether it demonstrates the offeror’s ability to fulfill the requirements in the PWS. The approach must provide a clear and detailed plan for developing each task/deliverable in the RFQ and required time frames for delivery.

Management approach: The vendor will be evaluated on the extent to which their management approach demonstrates its ability to provide management and adequate labor resources to accomplish the requirements of the PWS on time and with quality. The approach must provide a clear and detailed staffing plan including the level of effort for each resource to accomplish the task and the mix of labor proposed.
FACTOR 2 – PAST PERFORMANCE
The Past Performance evaluation assesses the probability of meeting the solicitation requirements based on the vendor’s demonstrated record of recent and relevant quality of work performance in meeting contract requirements. The Government will review the Vendor’s three most recent past performance information for work that was performed contracts or is ongoing for relevancy to this requirement based on similar size/scope and complexity. The Government will evaluate the Vendor’s relevant past performance information to determine the past performance rating. The currency and relevance of the information, source of the information, context of the data and general trends in Vendor performance will be considered in the past performance evaluation.
The information provided by the Vendor in the relevant Past Performance Questionnaire will not necessarily serve as the sole basis of evaluation of past performance. The Government reserves the right to obtain and utilize information from sources other than those identified by the Vendor to include the Contractor Performance Assessment Reporting System (CPARS).
Past performance information may take into account predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement.
FACTOR 3 - PRICE
To be considered for award, the Vendor shall submit prices which comply with the requirements set forth in the FAR 52.212-1 Addendum above. Vendors who fail to comply with these requirements will receive no further consideration and may be eliminated.
The Government will evaluate the Vendor’s quoted price to assess the reasonableness of the total evaluated price to perform all services. The Government may require submission of information other than cost or pricing data to the extent necessary to evaluate price reasonableness.

FAR 52.217-8 - OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Vendor within 30 days before the task order expiration.

FAR 52.217-9 – OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
a) The Government may extend the term of this contract by written notice to the Contractor within 10 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed sixty (60) months.

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made.
