Question #1
My Question is in Reference to:
The contractor is required to notify the CO/COR in writing of all litigation pertaining to this contract and provide pleadings filed or said litigation within five working days of the filing. In most instances, the contractor is not served with litigation within five days of the litigation being filed. Accordingly, we request to revise this sentence to require the contractor to notify the CO/COR within five days of being served such litigation.

My Question is in Reference to:
This language requires contractor to maintain monthly average staffing levels of 90% for Correctional Services, 85% for Health Services and 85% for all other departments. The language also states that failure to fill any position within 120 days of vacancy may result in a reduction of the monthly invoice. Is a reduction for failure to fill a position within 120 days the only reduction that could be applied based on this language? If not, could there be a reduction of the monthly invoice based on failure to maintain the required staffing levels? If so, how would such reduction be determined? Would any reduction for failure to fill a position within 120 days of vacancy be based on the salary and benefits of the vacant position?

Answer: The contractor should be making an effort to fill 100%of the positions outlined in the staffing plan. Once a vacancy reaches the 120 day period the Contracting Officer may make a determination to process a reduction in contract price in accordance with FAR clause 52.246-4 Inspection of Services— Fixed Price. This same process would apply to not meeting the staffing percentage requirements. Both the percentage and the vacancy requirements of this solicitation or resultant contract will be treated, and calculated differently as they are separate requirements. For example a Correctional Officer position has been vacant for 121 days the CO could take a deduction for the salary and benefits of that one Correctional Officer to day one of the vacancy. The same Correctional Officer may cause the security staffing to drop below the 90% requirement and would be calculated in a reduction of the contract price for the percentage of the salaries, and benefits of the over security staffing below the 90%.

My Question is in Reference to:
The contractor's failure to fill posts identified on the staffing pattern with a relief factor greater than 1 without the approval of the CO "may result in contract action." Please describe the contract action that may be taken.

Answer: Each instance of non-conformance will be evaluated independently and in accordance with FAR clause 52.246-4 Inspection of Services—Fixed Price.

My Question is in Reference to:
We request to revise this paragraph as follows to clarify that the level of Spanish-speaking proficiency required is that which is necessary in the context of carrying out work responsibilities, and not general conversational Spanish proficiency: "A minimum of 5% of the overall staff complement must have sufficient Spanish language skills to understand and make oneself understood for purposes of communicating with Spanish-speaking inmates. At a minimum, 50% of the Intelligence staff must have sufficient Spanish language skills to understand and make oneself understood for purposes of communicating with Spanish-speaking inmates, and be able to translate written Spanish."

My Question is in Reference to:
Under Subsection D. Personnel, the PWS states “Any post identified on the staffing plan with a relief factor greater than 1 shall not be vacated without the approval of the CO. Failure to fill these posts may result in contract action.”
Question: Does this mean that all posts will be 100% mandated? Some of the posts within the facility require staffing with specific training and access. An example would be main control. Is there any allowance of time in which to fill the post during a shift in order to avoid a contract action (Example, staff call in thus 2-hour window to fill post)?
Section: Section C (PWS), Subsection D – Personnel Page: 15; Lines 23-26
Answer: All posts that are identified in the staffing plan that have a relief factor greater than one will be required to be filled and not be vacated. The purpose of the relief factor is to create a pool of available staff to fill in when staff are absent for any reason. Request to vacate a post would required a written request in advance to the CO requesting an alternative staffing plan or a technical proposal to satisfy security concerns associated with the vacant position. If a post requires specific training, it would be the contractor's responsibility to ensure enough staff are properly trained to provide coverage during the temporary absence.
For Example: An inmate is sent out to the local hospital requiring immediate medical attention, the shift supervisor pulls a correctional officer from the housing unit (where the post has relief of 1.70) and a correctional officer from the Armory (where the post has a relief of 1.0) to take the inmate to the local hospital. It will be required for the contractor to back fill the housing unit officer post.
There is no set allowance of time. However, each instance of non-conformance will be evaluated independently.

My Question is in Reference to:
Under Subsection D. Personnel, the PWS states “Any vacancy in an essential position will result in a reduction to the contract price in the amount of the salary and benefits paid for the vacant position from the initial date of vacancy through the Entrance on Duty with no applicable exclusions allowed."
Question: Can essential staff be filled temporarily by qualified “acting” staff until a suitable candidate is hired?
Section: Section C (PWS), Subsection D – Personnel Page: 22; Lines 1-5
Answer: Qualified acting staff can temporarily fill an essential staff position to perform the necessary duties until a suitable candidate is hired. A request must be submitted to the COR in writing, with the prospective acting staff’s qualifications. However, the position will be considered vacant and a contract price reduction will be applicable until a suitable candidate is hired.

My Question is in Reference to:
Under Subsection D. Personnel, the PWS states “Any corporate staff member or a representative of the corporate office that may communicate with an inmate or come into contact with an inmate’s records will undergo a minimum of a Background Investigation (BI) and be forwarded to the COR for approval.”
Question: Currently corporate and regional staff assist on audits which require review of inmate files.
How will this requirement apply to the Regional/Corporate staff related to file reviews and auditing?
What are the requirements of a minimum Background Investigation? How long does a minimum BI take to complete?
Section: Section C (PWS), Subsection D – Personnel Page: 22; Lines 35-38
Answer: To ensure compliance with HSPD-12, the Bureau is progressing with efforts towards getting the appropriate contractor staff properly cleared. All contractor staff having access to inmates and/or inmate records will require this new level of BI. Once regional and corporate staff are cleared at one facility, this clearance will carry to all Bureau contract facilities under that contractor. This is similar to the current NACI process and access to SENTRY. Once the BI is initiated, approval on the contract can be granted.
The length of time the BI will take to complete can vary from individual to individual.

Under Subsection F. Case Records, the PWS states “the CMC shall monitor pending designations for medical conditions listed by the BOP Medical as contradiction to transfer due to Valley Fever.”
Question: Taft Correctional Institution is located in Kern County, which has a high rate for the contraction of San Joaquin Valley Fever. Will certain medical conditions be excluded from transfer to the facility due to San Joaquin Valley Fever? If so, could you please indicate those medical conditions?

Answer: HIV, Cancer patients on cancer chemotherapy, Organ transplant recipients receiving immunosuppression medication, Patients with rheumatoid arthritis, psoriatic arthritis, eczema or other inflammatory diseases prescribed immune-suppressants, Anyone taking chronic oral steroids, Chronic myeloid leukemia, Chronic lymphocytic leukemia, Myelodysplastic syndrome, Myelofibrosis, Asthmatics prescribed steroid inhalers, Diabetics prescribed insulin. Currently, inmates who are diagnosed or who are designated to TAFT with at risk conditions are referred by the HSA and Regional Medical Director, for transfer to another facility.

As Taft is a government owned institution, please clarify whether capital maintenance expenditures for repair or replacement of major systems such as HVAC, etc., are the financial responsibility of the vendor or the Bureau.

Answer: Please read the special contract requirements, and FAR clauses associated with Government Furnished Property. The contractor is responsible for periodic maintenance, repair, & upkeep of all GFP.
If any GFP fails the Contracting Officer will make determinations as to government funded replacement or contractor funded replacement in accordance with FAR 52.245-1, Alt 1 (h)(4).

Answer: There have been studies and continued engineering monitoring dating back to 2007. The Bureau is managing, and tracking the engineering results. See attachment #9.

What type of roofing system is installed on the housing units and the date of installation as well as the warranty period?

Answer: The roofing system is a EFIS system with walkways, and gravel. The date of installation, and warranty is irrelevant as the Bureau is responsible for replacement. The contractor will be required to repair leaks, and general upkeep. Currently the Taft facility is on a list of Bureau facilities to have the roof tops inspected and/or replaced or repaired if necessary by the Bureau.

Answer: The above ground storage tank belongs to West Kern Water District. It supplies both domestic & fire pressures. The facility contractor is responsible for the annual diesel permit & pump repairs.
Repairs in the last twelve months have consisted of pump repairs totaling $8,487.00

Under Subsection H. Physical Plant, the PWS states “…It shall be the responsibility of the contractor to repair such damage, rebuild or restore the institution consistent with BOP Technical Design Guidelines at no cost to the Government. Any deviation from the original design and construction specifications shall require the prior written acceptance of the CO and Property Administrator. Any restoration or repairs shall become the property of the government upon completion as part of the physical structure of the institution. The contractor shall be solely responsible for the financial obligation of any repairs, restorations, or rebuilding as determined by the Contracting Officer.”
Furthermore Section H – Special Contract Requirements, Pages 17-18, states “The Contractor is responsible for all alterations, repairs, improvements and maintenance to the physical plant, including all equipment and utilities, energy conservation and major operating units. This includes oversight of BOP construction projects conducted for the improvement or repair of the facility.”

Answer:
03/28/2013, Replace Camp Water Heater HWH-CC3-1- $66,723.00 (BOP Funded as determined by CO).
06/15/2014, Replace Water Heater HWHU-1 - $99,950.00 (BOP Funded as determined by CO).
06/15/2014, Replace Electrical Switch Gear and Components of the Emergency Management Control System - $49,935.43 (BOP Funded as determined by CO).
03/16/2015, Rehabilitate CHIL-CP-1a Chiller - $60,855.00 (BOP Funded as determined by CO).
02/01/2017, Replace oven in Main Facility Kitchen - $30,000. (MTC Funded as determined by CO).
06/01/2017, Repair CHIL-CP-1a Chiller – Estimated $230,000.00 (BOP Funded as determined by CO).
06/01/2017, Repair underground fire main and PIV valve – Estimated $30,000.00 (BOP Funded as determined by CO).
Please provide a listing of all planned capital repair and replacement projects as determined by the Contracting Officer.
Answer: Other than the equipment being replaced with the UESC project, which is anticipated to be completed by July 2018. The Taft facility is on a Bureau list for roof inspection/repair/replacement, and asphalt inspection/repair/replacement. It is unknown as to when the completion of the inspections will take place, and to what extent and time will be required of any actions that come from the inspections.
These are Bureau projects, and funded by the Bureau. The solicitation/contract requirements should be followed for any facility security requirements associated with any projects.
Please confirm that the facility will be turned over with no known outstanding physical plant issues as determined by the Contracting Officer.
Answer: As the operation of the facility is currently continuous there is no way to provide a confirmation of this question.

We observed significant building movement during the site tour on May 9, 2017.
Question: Will the BOP please provide the history of each building’s movement and provide structural engineering reports/analysis based on the building movement gauges located throughout the two facilities.
Also, please provide any structural reports for suggested building movement monitoring, repairs and mitigation steps recommended to be taken.
Question: Does the BOP expect the contractor to be responsible for mitigation and repair of existing damage due to building movement or will the BOP require the existing contractor take mitigation steps and be responsible for existing building movement damage?

Answer: The contractor is responsible for minor aesthetics/appeal repair for settlement issues, and the contractor is required to read each monitoring station monthly, and provide the measurements to the engineering firm & Bureau.

My Question is in Reference to:
In the Performance Work Statement, Section I, Security and Control, the Subsection titled "Inmate Transportation" states that the contractor will be responsible for inmate transportation within a 400 mile radius of the facility.
a) Will the BOP please provide specifics on locations, trip frequency, and number of inmates to be transported each trip?
b) How much notice will be given in advance of transport requests (24 hours, etc.)?
c) Will inmate transfers (aside from Medical transports) occur on weekends, or Monday- Friday only?
