Q: The proposed Estimate of Effort is approximately 4-8 FTEs. However, if we propose the Biological Statement of Work (LD50), that effort would not amount to 4-8 FTEs. Please clarify what constitutes the 4-8 FTEs.
A: 4-8 FTEs is the Government's uniformed cost estimate only. Offerors should use their best business judgment and propose accordingly.
Business Question 1
Q: If task orders are to be cost-reimbursement, would not any resulting task orders be reimbursed at actual labor costs at the time of the task order rather than fully burdened rates used for budgeting of task orders? Can you clarify?
A: Labor cost should not change from your proposal.
The hourly rates proposed for each labor category shall be fully burdened rates, including any indirect or overhead rates applicable. The fully burdened hourly rates will be incorporated into any resultant contract awards under B.3. Advance Understandings, and must be used for budgeting task orders and reimbursement of labor costs on Time-and-Materials task orders.
Business Question 2
Q: Section B.2.A requires the Offeror to establish fully burdened labor category rates that will be incorporated into any resultant contract awards and that those rates must be used for budgeting task orders and reimbursement of labor costs. However, Section G.4 indicates that Task Order proposals are to include an itemization of all costs, both direct and indirect, necessary to complete the work. Additionally, Section G.13 requires the contractor to report incurred costs with indirect costs broken out. -Please explain how indirect costs are to be presented for TO proposals if the fully burdened labor rates are to be used for bidding all TO’s under this contract.
A: Section B.2.A. is paramount. However, if indirect costs such as Overhead are proposed then these costs should be presented by citing the formula (rate and base) in effect during the time the cost was incurred and for which reimbursement is claimed. If a special rate is being used; e.g., off-site, then so specify.
Business Question 3
Q: If financial reports are to be provided with indirect costs broken out, is it the intent of the Government to establish the category rates for task order bidding and evaluation purposes only and actual costs incurred will be billed and paid by the client?
A: The Government's intent is to establish category rates that will be incorporated into the contract. Actual costs incurred for other items will be invoiced and paid by the Government if allowable, allocable, and reasonable.
Business Question 4
Q: Maximum Ordering Estimate states that the Government currently has an Estimated Maximum Ordering Estimate of $7,500 for all contract Task Orders awarded under solicitation BARDA 10-100-SOL-00025. However, the original RFI stated “…cumulative animal model development task orders would not exceed $100,000,000 per annum based on BARDA’s rough order-of-magnitude estimate.” Will the Government further clarify the contract ceiling value for all tasks to be issued under this solicitation?
A: The maximum value per task order will be $7,500,000.
Business Question 5
Q: Section B.3.C states that the Offeror is to propose hours for the full period of performance. Is the sample task to be priced once over the entire 5 year period of performance or 1 time PER year for a total of 5 times?
A: Proposals should be priced for 1 year (12 months) base period with 4 option periods for a total 5 years.
Business Question 6
Q: Item B.3.c (pg. 5) specifies provision of fully burdened labor rates for the full contract period (5 years) which will be included in the contract Advanced Understandings. Item B.3.b (pg. 5) states that the Advanced Understandings fully burdened rates are to be used in pricing tasks.
A: Yes, fully burdened rates are to be used in pricing tasks.
Business Question 7
Q: Item 2 at the bottom of the page states, “The schedule for those meetings will be established by the COTR and”—it appears there are words missing. Will the Government please provide the missing words?
A: The sentence is continued at the top of page 20. "...Contracting Officer after contract award. The Contractor shall prepare and distribute the agenda and meeting/teleconference materials to all participants and provide a summary of all meetings and teleconferences in the Annual Progress Reports."
Business Question 8
Q: Will the government approve indirect rates at the time of work would be applicable. Is that correct?
A: The Government will approve indirect rates at time of task order issuance.
Business Question 9
Q: Section H.3. Laboratory License Requirements, states that the contractor shall comply with all applicable requirements of Section 353 of the PHS Act for Clinical Laboratory Improvement Act as amended. Will the Government provide additional information for this requirement?
A: This article is not applicable and will be removed via an amendment.
Business Question 10
Q: Attachment 6 of the RFP is “Protection of Human Subjects Assurance Identification/IRB Certification/Declaration of Exception (Common Rule).” However, Item H.13 states that no research involving human subjects will be conducted under this contract. Will the Government clarify this discrepancy?
A: This article is not applicable and will be removed via an amendment.
Business Question 11
Q: The last paragraph on page 35 states that “The Section 508 standards applicable to this contract/order are identified in the Statement of Work. However, the Statement of Objectives does not identify any Section 508 standards. Will the Government please clarify this discrepancy?
A: There are no section 508 standards identified in the SOO.
Business Question 12
Q: Will the contract(s) awarded be IDIQ with Cost-Reimbursement completion type task orders? Can you clarify?
A: Yes; Indefinite Delivery Indefinite Quantity (IDIQ) task orders with Cost-Reimbursement Contract Line Items.
Business Question 13
Q: The RFP states that “The cover page should clearly state if the Offeror’s proposal is for biological, chemical, or rad/nuc animal model development (Offeror may submit for one or more).” Is it the Government’s intention that Offeror’s submitting for more than one area provide a complete proposal for each area on which they are bidding (i.e., a separately bound 50-page proposal for chemical., a separately bound 50-page proposal for biological, etc). And, if it is the Government’s intent that Offeror’s submit one volume containing all areas in which they are bidding (i.e., all areas in one bound volume), will the Government please modify the page limit to 50-pages per area being bid? An overall 50-page limit would provide an unfair advantage to Offeror’s bidding in only one area compared to Offeror’s bidding two or three areas within the same 50-page limit.
A: The Offeror should submit one proposal that includes all areas (bio, chem, and/or rad/nuc) in which the Offeror intends to respond.
Business Question 14
Q: Will the Government allow Offerors to use smaller than 10 point type for proposal figures and tabular material?
A: No.
Business Question 15
Q: The Government states that “Base and Option work should be formatted in separate sections of the technical proposal, following the outline of the SOO.” Will the Government please clarify its intent as to how Offerors should separate SOO areas into Base and Option areas within the Technical proposal?
A: The technical proposal should be tabbed and clearly labeled base year, Option Year I, Option Year II, Option Year III and Option Year IV. Under each tab, the technical approach should be shown.
Business Question 16
Q: Business Proposal Cover does not agree with the Business Proposal Cover format in Att. 3. Which should we use?
A: Please use L.30. Page 58 instructions. Attachment 3 will be removed.
Business Question 17
Q: Item 4 states, “In response to the attached SOW (Attachment 8), please provide the following:…” Attachment 8 is “Invoice/Financing Request and Contract Financial Reporting Instructions for AMCG Cost-Reimbursement Contracts.” Will the Government please clarify this reference?
A: M.5. page 66, Item 4 should state, "In response to the attached SOW (Attachment 14), please provide the following…"
Business Question 18
Q: The Government has specified a limit of 20 pages for Business Proposals; however, the requirements request Representations, Certifications, and Other Statements of the Offerors, Small Business Subcontracting Plan, Past Performance information, and Cost information. In order to provide thorough cost information, will the Government consider removing, or at a minimum, increasing the Business Volume page limitation to 100 pages?
A: No. The Reps and Certs, Subcontracting Plan, Past Performance are not included in the page count. These documents can be filed in the appendices section of your Business Volume.
Business Question 19
Q: The Government requests Offerors to submit an Original and 5 copies of the proposal. However, the RFP provides two different individuals to which Offerors will send deliveries. Is it the Government’s intent that Offerors send an Original and 5 copies of their proposal submission(s) to either of the two individuals listed?
A: Offerors should list both individuals on deliveries.
Business Question 20
Q: Summary of Related Activities, it is not clear in which volume these should be included. Where you would like them and are they included in the page count?
A: Please submit the Summary of Related Activities in the Business volume. Offerors may include this document in the appendices if necessary.
Business Question 21
Q: Packaging and Delivery, limits the Technical Volume to 50 pages and Business Volume to 20. Is the Table of Contents included in that page count?
A: No, the Table of Contents is not included in the page count.
Business Question 22
Q: Attachment 14 requests a presentation of cost for a sample task. This task will take less than a year. Is this a separate analysis from a five-year build up of costs?
A: Attachment 14 is an example only. Each Offeror should use their best business judgment to determine cost, schedule and performance for their proposal.
Business Question 23
Q: It is not clear whether the BARDA will send out these Past Performance Questionnaires or if the bidder is to send them out. If the bidder is expected to distribute the questionnaires, how many responses are desired?
A: Offeror should ensure point of contacts are notated on each proposal so the Government can distribute the Past Performance Questionnaires.
Business Question 24
Q: Are attachments 10 and 11 for information purposes at the proposal stage?
A: Attachment 10 Past Performance Questionnaire is a non-cost factor, see M.1. General, page 61. Attachment 11 ACH Vendor/Miscellaneous Payment Enrollment Form is a sample form for informational purposes.
Business Question 25
Q: Is the Payment Information Form to be included in the Business Proposal?
A: No an Invoice is not required in the Business Proposal.
Business Question 26
Q: We would like to confirm the proposal due date as November 3, 2010 at 4:30 pm.
A: Yes the due date is 3 November 2010, 4:30pm EDT.
Business Question 27
Technical Question 1 Q: Can BARDA provide the anticipated level of required security (e.g. Confidential)?
A: Proposed work will not involve classified information.
Technical Question 2 Q: 'Regarding the SOO on page 9-10 of the RFP, we understand that we "may choose to respond to one or more areas... and are not expected to respond to the SOO in its entirety." However, there are multiple components within an individual Technical Capability. Can our response be directed at selected components within an individual Technical Capability? For example in C.1.9 if we have the capability to expose animals to only toxic industrial chemicals by one route of administration, can we still respond to this Technical Capability even though our response is partial?'
A: Yes. If desired, Offerors may respond to only selected components within an individual capability.
Technical Question 3 Q: If a respondent cannot perform the studies specified in the RFP, but can describe its facilities, personnel, and procedures to perform similar types of studies in other species/routes of exposure, would this be considered responsive to the RFP? In addition, if it is acceptable for the respondent not to address the specific studies in the sample tasks, what financial information should included (in lieu of price quotes for the specific studies in the sample task order SOW)?
A: Offerors may respond to the Example Task Order with an LD50 study using an alternative animal model and route of exposure determined by the Offeror to be representative of the Offeror's proposed capabilities. The agent used in this proposed study should be selected from the list provided in the PHEMCE Implementation Plan. https://www.medicalcountermeasures.gov/BARDA/PHEMCE/enterprise/strategy/strategy.aspx
Technical Question 4 Q: Animal Model Capability Matrix, it states “Vendors shall complete and submit the following attachment tables with their technical proposal.” Should these tables be included in the technical proposal or in the appendix section? Are these tables included in the page limit? The concern is that once these charts are filled out and in order to make sure they are readable, they will take several pages, thus leaving less for the technical discussion.
A: The organization of the proposal is left to the discretion of the Offeror, with the understanding that all tables, charts, etc. must be contained within the 50-page limit allowed for the technical proposal and 50-page limit allowed for appendices.
Technical Question 5 Q: The Example Task Order Statement of Work lists an LD50 study in cynomolgus monkeys for Bacillus anthracis using aerosol challenge. Is a license for both B. anthracis and aerosol challenge required for pricing out the task order, since this is not stated in the minimal requirements for proposal bid?
A: Licensing for B.anthracis and aerosol challenge is not required for preparing a cost estimate. The Task Order included in the RFP should be considered a sample task order. Offerors may respond to the Example Task Order with an LD50 study using an alternative animal model and route of exposure that is determined by the Offeror to be representative of the Offeror's proposed capabilities. The agent used in this proposed study should be selected from the list provided in the PHEMCE Implementation Plan. https://www.medicalcountermeasures.gov/BARDA/PHEMCE/enterprise/strategy/strategy.aspx
Technical Question 6 Q: Is not having an aerosol challenge capability and a license for B. anthracis considered a significant disadvantage in the performance evaluation?
A: No. Not having aerosol challenge capability and a license for B. anthracis is not considered a disadvantage in responding to this RFP. Licensing requirements will be identified in individual Statement of Work Task Orders as they are issued.
Technical Question 7 Q: How shall we approach the task order example in Attachment 14 in the absence of the required licenses?
A: Licensing for B.anthracis and aerosol challenge is not required for preparing a cost estimate. Offerors may respond to the Example Task Order with an LD50 study using an animal model and route of exposure determined by the Offeror to be representative of the Offeror's proposed capabilities. The agent used in this proposed study should be selected from the list provided in the PHEMCE Implementation Plan. https://www.medicalcountermeasures.gov/BARDA/PHEMCE/enterprise/strategy/strategy.aspx
Technical Question 8 Q: Example of Task Order Statement of Work, should these be included in the technical proposal or in the appendix section? Are they included in the page limit?
A: The Example Task Order is central to the Offerors response to the RFP and therefore should be included in the technical proposal.
Technical Question 9 Q: Our understanding is that this proposal addresses all NIAID Category A & B priority pathogens, whether Select Agent or Non-Select Agent. Please confirm.
A: The RFP addresses influenza and all agents listed in the PHEMCE Implementation Plan. https://www.medicalcountermeasures.gov/BARDA/PHEMCE/enterprise/strategy/strategy.aspx
Technical Question 10 Q: In the radiation animal models portion of the RFP, there is no mention of development of models for internally deposited radionuclides and internal radiation. Only external. Is this interpretation correct? If so, would there be any benefit to the proposer and BARDA if capabilities for developing radionuclide models were described?
A: Models for internally deposited radionuclides and internal radiation are covered by this RFP.
Technical Question 11 Q: Will each part of proposal, i.e., biological, chemical and irradiation, be evaluated on the individual basis? If one part of the proposal does not meet the qualification and is not awarded, will the proposal be rejected in full or other parts will be evaluated on their own merits.
A: Each proposal submitted in response to the specified area will be evaluated based on its own merits.
Technical Question 12 Q: Will each part of proposal, i.e., biological, chemical and irradiation, be evaluated on the individual basis? If one part of the proposal does not meet the qualification and is not awarded, will the proposal be rejected in full or other parts will be evaluated on their own merits.
A: Each area (e.g., C, B, R, N) of the Offeror’s proposal submitted in response to the RFP will be evaluated based on its own merits.
Technical Question 13 Q: As noted in the RFP, it may be difficult for one institution to provide resources and expertise to address all study types; therefore would there be interest in the respondent providing a team approach that could accommodate a greater array of study types?
A: HHS/BARDA recognizes that a single organization or institution may not have the expertise and facilities required to perform all of the activities set forth in the Statement of Objectives and, consequently, that the Offeror(s) may need to be supported to a certain extent by the expertise and resources of subcontractors to perform some of the activities required.
QUESTIONS ASKED AND ANSWERED DURING THE PRE-PROPOSAL CONFERENCE
BQ1: Can the CVs be included in the appendices?
A: Yes, CVs can be included in the appendices of the technical proposal.
Business Question 1
BQ2: Is there a page limit in the appendices for the business proposal?
A: The page limit for the business appendices will be 50 pages.
Business Question 2
BQ3: Is this the last day for submitting questions?
A: No. Questions can be submitted until proposal submission date. Questions submitted 1-2 days in advance of submission date are not guaranteed a response.
Business Question 3
BQ4: If 5 years of fixed burden labor rates are included in the advanced understandings, how can you say that indirect rates in effect at the time of task order would be applicable?
A: Indirect rates are normally updated on a year-to-year basis and the prevailing rate will be used for the task order proposal. For example, if it’s year 3 or year 4 of the contract period, the rates should be updated annually and the prevailing rate would be applicable to the task order.
Business Question 4
BQ5: For hand delivery of proposals to the front desk, what is the procedure?
A: Because of the security of the Federal Southwest Complex, if planning to hand deliver proposals, please notify via email Jeannett Jackman or Darrick Early at least two days in advance. Without advance notice, Offerors may not be able to gain access to the facility in order to deliver proposals on time. Late proposals will not be accepted.
Business Question 5
BQ6: Page 24 references 2706 Form for Financial Reporting and in Attachment 8 it states that payment requests should be submitted on a contractor self-generated form. Which is correct?
A: Prior to contract award, the financing and invoicing form can be discussed/negotiated.
Business Question 6
BQ7: In reference to invoice payment, our payroll system reports in percentage of effort – not hourly rate. To report in hourly rates would require a manual invoice be generated outside of the self-generated forms that come from our payroll system. The accuracy of the invoice cannot be verified with the labor costs distribution reports that are generated from the financial management system since they do not include hourly rates. Can we submit our proposal in percentage of effort rates? Can we submit using both hourly rates and percentage of effort knowing our invoices would be generated in percentage of effort?
A: Because this is an IDIQ contract designed for task orders, using individual negotiated, fully-loaded (i.e. direct labor costs, overhead costs including program management, G&A expenses and profit) hourly labor rates will be contained in the contract. CLIN Pricing for Task Orders will be based on the Pricing Table which represents all labor rates and ODCs etc… for performance of the requirement(s) as specified in individual Task Orders. These fully-loaded hourly labor rates are the ceiling rates representing the maximum rates allowable for Prime and Subcontractors. These rates will be compared to your monthly invoice to ensure correct labor category and rates are captured and billed accordingly.
Business Question 7
BQ8: It is our understanding that BARDA will be using submitted hourly labor rates for bidding purposes and will include them in the advanced understanding section of the contract. Invoices for cost reimbursement task orders are submitted using current actual salary rates with the current negotiated indirect rates in accordance with our institution’s agreement with HHS. Is this correct?
A: No, in order to determine that submitted proposals are fair and reasonable, the labor rates provided in the base year and options periods should be the labor rates proposed. BARDA does understand that indirect rates may rise, and this will be the only justification for an increase in labor rates during the base year and option period. Therefore cost of living adjustments and any other factors that may affect labor rates should be proposed up front and in accordance with commonly accepted inflationary index from the Bureau of Labor and Statistics.
Business Question 8
BQ9: We understand that fully burdened rates for each labor category are to be shown for each of the five contract years. Should the burdened rates include our proposed fee or do you want the proposed fee broken out and shown separately?
A: Fee should be broken out separately for each year.
Business Question 9
BQ10: We assume the Reimbursement CLINs shown in Section b.2 (pg 4) are for subsequent use and not meant to be addressed in this cost proposal, since the values would be dependent on the year, number, and dollar amounts if we were to be awarded any tasks.
A: Yes, the CLINs shown will be in the resultant Task Order(s).
Business Question 10
Business Question 11 BQ11: Can Federally Funded Research and Development Center (FFRDC) propose under this RFP?
A: In accordance with FAR 35.017-1, FFRDC’s may not compete against non-FFRDC’s in response to Federal agency requests for proposals.
TQ1: Are domestic institutions given preference over foreign institutions in responding?
A: No.
Technical Question 1
TQ2: Would BARDA accept several proposals (e.g. one for Rad-Nuc, one for Biological, and another for Chemical part) from three different PIs in the same organization?
A: No. Each institution should submit one proposal that covers each section (Chem, Bio, and/or Rad/Nuc) the Offeror is proposing to do work.
Technical Question 2
TQ3: Attachment 13 – table with organisms – are we limited to these only? Can we include other priority A and B pathogens (cryptosporidium, microsporidia, etc)?
A: Offerors are limited to flu or organisms described in the PHEMCE Implementation Plan. https://www.medicalcountermeasures.gov/BARDA/PHEMCE/phemce.aspx
Technical Question 3
TQ4: For options, do we propose other tasks, then provide budget for each?
A: Please provide budgetary information in regards to the capabilities for the entire 5 year period of performance.
Technical Question 4
TQ5: There is a statement on page 3 requiring the qualification of pilot studies to follow GLP requirements. What is considered a pilot study? This is unclear for GLP. Please clarify the need for GLP for this program in general.
A: This is a research and development program for developing animal models. While pilot studies are not required to be GLP, the endpoint is a pivotal study. The FDA generally considers the final pivotal study to be GLP. Although every study conducted will not be GLP, facilities are required to have GLP capabilities so that GLP studies can be conducted when appropriate. .
Technical Question 5
TQ6: Do facilities need to be GLP-compliant?
A: Yes.
Technical Question 6
TQ7: Does the Offeror need to propose all four CBRN tasks or can we submit for only partial tasks?
A: Offerors should only submit proposals for areas in which they have capabilities. Offerors are not required to submit proposals for all of the four tasks.
Technical Question 7
TQ8: What do you mean by multiple awards?
A: This is an IDIQ contract, which means BARDA expects to have multiple contract awards and will submit multiple task orders over the period of performance. After the contract award process, as task orders are generated, they will be send to Offerors who have received a contract award in that area (Chem, Bio, or Rad/Nuc).
Technical Question 8
TQ9: If Chem, Bio, and Rad-Nuc are to be evaluated separately, than based on the page limit, a bidder who bids on one area will have 50 pages to address one area. However, bidders who bid on all three areas only have one-third that amount to present their approach. It seems that each area should have a limit rather than one overall limit, especially since the areas are being evaluated separately.
A: After further evaluation it has been decided that Offerors will have 50 pages per area for the technical proposal. Offerors should only submit one proposal that covers all areas. Offerors will be still be only allowed 50 pages total (for all for three areas) for technical proposal appendices.
Technical Question 9
TQ10: If there is no level of security – for example, Confidential – why is an IT security plan required?
A: For clarification, in the USG, terms such as “confidential” and “classified” are related to levels of security clearance. Security in this context refers to locked doors, personnel screening, data protection, etc.
Technical Question 10
TQ11: Can you confirm that the radioactive nuclide capability is not required for [institution] only. It tends to apply only to the biological countermeasures part.
A: Radioactive nuclide capabilities is a requirement if the Offeror is responding to the applicable subject area, i.e.. Rad/Nuc. For example, if the Offeror is submitting a proposal for work in the Bio area, radioactive nuclide capabilities are not required. Offerors should have the appropriate licensures for the areas in which they are applying.
