About this file
This is Addendum No. 1 to RFP 5-B164-P-00021-00 for Argonne National Laboratory's Rapid Response Department Site Wide General Construction Blanket Purchase Agreement (BPA), issued on January 9, 2025. The addendum provides clarifications through eight questions and answers addressing key contractual details.
The Q&A clarifies that the Superintendent can serve triple roles (Superintendent, SSHO, and QC) with proper certifications, and their rate is a fully burdened labor category for both straight and overtime work. All labor rates must be fully burdened, including subcontractor rates. Materials will have a maximum markup of 10%, and paint is not considered a consumable. The addendum confirms that G&A costs are to be factored into hourly rates, even though this may result in multiple applications of G&A when multiple trades are used on a single task order. Successful bidders must provide appropriate bonding within 10 business days of contract award.

This addendum is being issued to modify the subject Proposal (RFP) as follows:
I. RFI and Responses:
1. Contractor Question: Please confirm if Superintendent can be “triple-hatted” and can simultaneously serve as the Superintendent, SSHO, and QC.
ANL Response: Yes. However, designated person must have proper certification to perform all of the above specified roles (Superintendent, Site Safety and Health Officer, and Quality Control). Should ANL require additional manpower for those tasks based on workload, that will be defined during the Task Order proposal process. Superintendent is not to perform Project Management work or other administrative functions.
2. Contractor Question: Confirm Superintendent is not part of the General and
Administrative (G&A) for straight/overtime time work.
ANL Response: Yes, Superintendent is a defined labor category for both straight and overtime and is therefore a fully burdened rate (per Enclosure No. 7 - Proposal Form).
Superintendent is not to perform Project Management work or other administrative functions.
3. Contractor Question: During the pre-bid conference, it was stated that, General and
Administrative (G&A) which also includes the cost for the Project Manager is to be factored in the hourly rates, however, this approach makes it difficult to calculate accurate rates without knowing the number of trades required for each task order. If
G&A is included in the hourly rates for each trade and we end up working with five trades under a single task order, the G&A cost would effectively be applied five times to that task order. Please clarify.
ANL Response: It is possible that this can occur. However, as stated in the RFP, the structure of this contract is such that all identified labor and equipment categories have fully burdened rates which will be incorporated into the contract for the specified contract period.
4. Contractor Question: Please confirm how materials will be billed.
ANL Response: Please reference Article III - Compensation and Article IV - Manner of
Payment within Enclosure 1A - Sample Construction Blanket Purchase Agreement.
5. Contractor Question: Please confirm the allowed markup on materials.
ANL Response: Maximum 10%.
6. Contractor Question: With regards to the labor pricing sheet. When we are logging the subcontractors rates do we use the cost of what they are billing us or should this have our mark up as well like our in house rates that are fully burdened?
ANL Response: All labor rates on Enclosure No. 7 - Proposal Form shall be fully burdened.
7. Contractor Question: Is paint considered a consumable?
ANL Response: No.
8. Contractor Question: Please confirm If there is a Bid Bond/Bid Guarantee required with the BPA proposal and subsequent Task Orders.
ANL Response: Appropriate bonding will be required from the successful bidders within 10 business days of contract award (please see below snip regarding Bonds and
Insurance from Enclosure 1A - Sample Construction Blanket Purchase Agreement).
ALL OTHER TERMS AND CONDITIONS OF THE ABOVE REFERENCED RFP
REMAIN THE SAME.
