About this file

This is Amendment 5 to RFP No. 47PK0124R0019 for the SYLPOE FMCSA Bus Inspection Facility project in San Diego, CA, issued by GSA Public Buildings Service. The amendment primarily revises technical evaluation requirements related to past performance and experience submissions.

Key changes include: allowing 8(a) prime contractors to use one project from a small business first-tier major subcontractor (performing >30% of contract) for each of Evaluation Factors 1, 2 and 4, with the remaining two projects coming from the prime; removing the requirement that the same three projects be submitted for all factors; incorporating language regarding past performance ratings for small business concerns per 13 CFR 125.11; and extending the proposal due date to January 27, 2025 at 4:00 PM PT. The amendment also updates the wage determination and includes a revised SF1442 reflecting the new closing date. Offerors must acknowledge receipt of all amendments with their proposal submissions or risk rejection.

Amendment 5 – 1/7/2025

THIS AMENDMENT IS ISSUED TO ADD OR CHANGE THE FOLLOWING ITEMS IN REQUEST FOR

PROPOSAL NO. 47PK0124R0019:

1. Under Item 2 of Amendment 3 - 12/12/2024, the responses to Question 5, 6, 8 and 11 (regarding technical evaluation submission requirements) have been revised. Accordingly, delete the Amendment 3 Questions 5, 6, 8, 11, and responses in their entirety, and replace with the following:

Question 5. Factor 1: Experience on Specialized Experience on “Similarly Complex” Projects – Can key subcontractor experience be provided in conjunction with Offeror’s past experience to meet relevant experience required under Factor 1? Key subcontractor involvement and experience is requested under Factor 4 and would lend to illustrating project team approach.

Response:

If an 8(a) prime contractor proposes a team of small business subcontractors and specifically identifies a small business, first-tier major subcontractor that will play a meaningful role in the contract, GSA will consider the past performance and experience of that small business, first-tier major subcontractor for one (1) of the required projects under Evaluation Factor 1 - Specialized Experience on Similar Projects, for one (1) of the required projects under Evaluation Factor 2 - Past Performance, and for one (1) of the required projects under Evaluation Factor 4 - Experience Coordinating with other Entities. The remaining two(2) required projects for Factors 1, 2, and 4 must then be from the 8(a) prime contractor itself.

A "meaningful role" is defined under this solicitation as performing more than 30% of the overall contract amount of the requirement. In order to substantiate a "meaningful role" in the contract, the 8(a) prime contractor must provide evidence, in the form of a Teaming Agreement or Commitment Letter between the prime contractor and the small business, first-tier major subcontractor, which shows the planned relationship between the companies and the involvement of the small business, first-tier major subcontractor in the performance of the contract.

Additionally, under Amendment 5 the requirement for the same 3 projects to be submitted for Factors 1, 2, and 4 has been changed; the 3 projects submitted for each factor ARE NOT required to be the same.

Question 6. Will the government consider allowing key sub commitment letters, resulting in allowing the prime to use key sub experience in Factor 1?

The remaining two(2) required projects for Factors 1, 2, and 4 must then be from the 8(a) prime contractor itself.

subcontractor, which shows the planned relationship between the companies and the involvement of the small business, first-tier major subcontractor in the performance of the contract.

Additionally, under Amendment 5 the requirement for the same 3 projects to be submitted for Factors 1, 2, and 4 has been changed; the 3 projects submitted for each factor ARE NOT required to be the same.

Question 8. If the proposer is a JV or a part of the Teaming Agreement, can the past experience of each of the joint ventures or each of the members of the teaming agreement be used to meet the Past Performance and Prior Experience requirements?

Response:

The FAR defines Contractor team arrangements, as follows-

(1) Two or more companies form a partnership or joint venture to act as a potential prime contractor; or

(2) A potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program.

For JV’s submitting offers, the 3 projects submitted for Experience and Past Performance can be for projects completed by the JV entity itself, or the 3 projects can be projects completed separately by the JV members.

For Prime contractors submitting offers that include a Teaming Agreement, the following applies:

Question 11. Please confirm if PPQs and Experience on “Similar Work” projects performed by Teaming Agreement partners can be considered relevant and will be considered toward Factor 1 and Factor 2.

Response:

For Prime contractors submitting offers that include a Teaming Agreement, the following applies:

2. In accordance with 13 CFR 125.11 Past performance ratings for certain small business concerns, the following language is herein incorporated under this Amendment 5 into The Solicitation, Section II.D. Technical Proposal, Item 2. Evaluation Factor 2 – Past Performance (35%) , page 11:

GSA will consider the past performance of certain small business offerors that have been members of joint ventures or have been first-tier subcontractors. GSA shall consider the small business' past performance for the evaluated contract or order similarly to a prime contract past performance.

(A) Small business concerns that have been members of joint ventures —

(1) Joint venture past performance.

(i) When submitting an offer for a prime contract, a small business concern that has been a member of a joint venture may elect to use the experience and past performance of the joint venture (whether or not the other joint venture partners were small business concerns) where the small business does not independently demonstrate past performance necessary for award. The small business concern, when making such an election, shall:

(a) Identify to the contracting officer the joint venture of which the small business concern is or was a member;

(b) Identify the contract or contracts of the joint venture that the small business elects to use for its experience and past performance for the prime contract offer; and

(c) Inform the contracting officer what duties and responsibilities the concern carried out or is carrying out as part of the joint venture.

(ii) A small business cannot identify and use as its own experience and past performance work that was performed exclusively by other partners to the joint venture.

(B) Small business concerns that have performed as first-tier subcontractors —

(1) Responsibility of prime contractors. A small business concern may submit a rating of its subcontractor past performance from the prime contractor for a contract on which the concern was a first-tier subcontractor and which included a subcontracting plan. The rating provided by the prime contractor to the first-tier small business subcontractor shall utilize the five-scale ratings system found in FAR 42.1503 (48 CFR 42.1503):

Exceptional, Very Good, Satisfactory, Marginal, and Unsatisfactory. The prime contractor must include, at a minimum, the following evaluation factors in the requested rating:

(i) Technical (quality of product or service);

(ii) Cost control (not applicable for firm-fixed-price or fixed-price with economic price adjustment arrangements);

(iii) Schedule/timeliness;

(iv) Management or business relations; and

(v) Other (as applicable).

(2) Joint ventures that performed as first-tier subcontractors. A small business member of a joint venture may submit a past performance rating under paragraph (B)(1) of this section, where a joint venture performed as a first-tier subcontractor.
