(16) Description:

(i) This is a combined synopsis/solicitation – Request for Quote / Proposal for commercial items prepared in accordance with the format in Subpart 12.603 Streamlined Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes / proposals are being requested and a written solicitation will not be issued. Solicitation is being issued on as an Unrestricted acquisition via Open Market Procedures to the Contract Opportunities Website (sam.gov).

(ii) Solicitation Number: SP4701-26-R-0005; the solicitation will be issued as a request for quote

(RFQ).

(iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 effective January 13, 2017.

(iv) The North American Industrial Classification System (NAICS) code for this acquisition is

541519 (Size Standard: 150 EMPLOYEES). This requirement is being solicited as an Unrestricted acquisition via Open Market Procedures to the Contract Opportunities Website (sam.gov) & supported by a Justification & Approval on an Other Than Full & Open Competition basis due to the sole- source brand-name requirement.

The offer must delineate the firm’s ability to meet every aspect (item) of the Government’s requirement in order to be considered technically acceptable and the package must attest to the fact that the firm can provide the required deliverables. Furthermore, the Government will review each proposal to confirm that the firm can meet all mandates contained within the Bill of Material (BoM) / Statement of Work (SOW) for the corresponding requirement.

a. This RFP will be posted to SAM.gov Contract Opportunities as unrestricted action under NAICS Code: 541519.

b. Offerors are required to submit pricing in the format contained within the attached

Bill of Materials (BoM). Each line item must be separately priced and be included in calculation of the overall total price.

c. Offers shall be submitted electronically to:

(ix) The FAR provision, 52.212-2, Evaluation – Commercial Items, applies to this acquisition. The evaluation criterion for the technical quotation and price quotation is lowest priced technically acceptable. Award shall be made to a responsible offeror whose quotation is lowest priced and technically acceptable based on the total price of all line items identified in the attached BoM. For this acquisition, offers that take no exception to the terms and conditions of the solicitation, including the required items, will be considered technically acceptable. In order to be determined technically acceptable, offerors must submit pricing for all items listed in the BoM.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

FAR 52.203-19 Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements

(a) Definitions. As used in this clause--

“Internal confidentiality agreement or statement” means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

“Subcontract” means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.

“Subcontractor” means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.

(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).
