NOTICE TO OFFERORS

CONTRACT FORMAT:

Offerors should note that the format of this contract is in accordance with Federal Acquisition Regulations (FAR), promulgated by the General Services Administration (GSA), effective April 1, 1984, including all applicable revisions. Applicable FAR provisions and clauses are incorporated in this contract by reference or full text as indicated in the INDEX before the D-pages in this booklet.

FAR provisions and clauses incorporated by reference can be accessed on the Internet website at https://www.acquisition.gov/. Offerors are encouraged to review the documents thoroughly before submitting a proposal.

PROPOSAL BOOKLET AND OFFER SUBMITTAL:

It is the responsibility of the Offeror to verify that this proposal is complete as listed in the Table of Contents. The Offeror is responsible for submitting all required forms and documents with the offer.

Offerors should use the Checklist for Offer Submission included in this booklet to check that their proposals are complete.

CONSTRUCTION CONTRACTS:

Additional guidance is given in FAR Subpart 35.005 where the majority of the project work is complex and specialized such as restoration work, bridge painting, and proprietary construction techniques (i.e. proprietary Cintec arch strengthening.) There are exceptions and they will be reviewed on a case-by-case basis.

HAZARDOUS MATERIALS IDENTIFICATION AND MATERIAL SAFETY DATA:

As required by FAR Clause 52.223-3, Hazardous Materials Identification and Safety Data, the apparent low Offeror must submit prior to award a Material Safety Data Sheet (MSDSs) for all hazardous materials that the Offeror identifies in paragraph (b) of this clause in Section G of this booklet. Failure to submit MSDSs may render the Offeror ineligible for award of contract. The apparent low Offeror should submit their MSDSs within two weeks after bid opening.

INTERNET BASED DATA BASES - REQUIRED INPUT:

According to FAR Subpart 4.1102 contractors are required to be registered in the System for Award Management (SAM) at the time an offer is submitted. Access the following web site to register: https://www.sam.gov/.

PAYMENT:

Offerors are advised to review the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP), subsection 109.05, concerning direct and indirect payment included under a pay item in the bid schedule.

PROGRESS PAYMENTS:

ALL payments will be made via Electronic Funds Transfer (EFT) as such; the payment information in SAM must be accurate in order for contractors' invoices to be considered proper invoices for the purpose of prompt payment under DOT contracts. Contractors must input and maintain (update as necessary) their EFT information in the SAM database. Offerors are advised that under FAR Clause 52.232-5, Payments Under Fixed Price Construction Contracts, upon request, progress payments will include premiums paid by the Contractor to obtain performance and payment bonds as required under this contract. These payments shall not be made in addition to the contract price. As specified in the FP, “Section 151 - MOBILIZATION", payments for performance and payment bond premiums shall be included in mobilization.

WELFARE-TO-WORK INITIATIVE:

The President’s Welfare Reform Bill was initiated to assist welfare recipients and hopefully aid welfare recipients to find gainful employment. In support of this bill, Contractors are encouraged to hire welfare recipients whenever possible and to use welfare recipients in performance of duties on Government contracts.

INCREASING SEAT BELT USE IN THE UNITED STATES:

The President’s Executive Order 13043 dated April 16, 1997, was issued to increase the use of seat belts in the United States. In support of this Order, contractors and subcontractors are encouraged to adopt and enforce on-the-job seat belt policies for their employees when operating company-owned, rented, or personally owned vehicles.

REPAIR STORM DAMAGE ON PR-191, PR-9938, PR-988, PR-9966, PR-930, AND PR-

REQUEST FOR PROPOSALS

RFP No. 693C73-21-R-000021

Project Description: The project consists of repairing multiple storm damaged sites in PR-191, PR-930, PR-988, PR-9938, PR-9966, and PR-186 within El Yunque National Forest for the United States Forest Service. The work includes the construction of retaining walls (gravity gabion walls, anchor soldier pile wall, gabion-faced soldier pile walls, and contractor designed gravity gabion wall), a reinforced soil slope, a rock buttress, roadway shoring systems, asphalt concrete pavement reconstruction, shoulder and ditch reconditioning, culvert replacements, and other miscellaneous work. The project is located in the Municipalities of Rio Grande and Luquillo, Puerto Rico.

The construction cost for the project is estimated to be more than $10,000,000.00.

Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.

These include the Plans, Special Contract Requirements (J Pages), and supplemental Government Furnished Information.

Procurement Overview of the Project: In accordance with Federal Acquisition Regulation (FAR) Part 15.101-1, the Eastern Federal Lands Highway Division (EFLHD) is conducting a Best Value Trade-off Source Selection Process for this project. Under this Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two-step RFP will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B Pages).

During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified Offerors based on a confidence rating evaluation criteria as stated in the RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information. The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government will proceed with the second step (trade-off evaluation) without requesting further information from any Offeror; however, the Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.

During step two, the Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15.101-1. This process permits tradeoffs between price and technical “noncost” factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.

All evaluation factors other than cost or price, when combined, are approximately equal in their importance when compared to cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor. Only one price proposal may be submitted by each Offeror and the price proposal must be based upon the Offeror’s own technical proposal.

Contract award is anticipated to be no earlier than August 2021, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block 12a of the SF-1412 and FAR Clause 52.228-15), but no earlier than October 2021. Construction operations are divided in phases as shown in the Construction Phasing Map (Plan Sheet N01).

The contractor needs to complete work on Phase 1 before proceeding to Phase 2. Phase 3 work can be completed concurrently with work on Phases 1 and 2. The roadways shall be kept open to all traffic during construction operations, except for PR-9938 for which only pedestrian access needs to be maintained. The contractor will be responsible of implementing measures to protect cultural and biological resources within El Yunque National Forest. Subsections 104.05, 108.01, and Sections 107 and 156 of the Special Contract Requirements (J-Pages) include additional construction activity restrictions.

It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal other than what is necessary to support the technical proposal. Offerors should limit their technical proposal to the information required by this Notice, and other information that may be relevant to the qualifications and experience of the Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.

Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.

Supplemental Work: Offerors are expected to provide qualified and experienced staff to develop appropriate pre-construction or construction protocols as designated by Federal, state, and local regulations/guidelines, including but not limited to the following:

• Work Plan.

• Accident Prevention Plan.

• Health and Safety Plan.

• Environmental Management Plan.

• Waste Management Plan.

• Recycling Plan.

Submittals: Each Offeror must provide the required number of Technical and Price Proposals as described below to EFLHD in separate, sealed envelopes/boxes clearly addressed and identified for “Project No. PR ERFO FS 2017-1(3).”

Submit three (3) bound paper copies, one (1) unbound copy, and one (1) CD-ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”

Submit two (2) unbound paper copies and one (1) CD-ROM copy of the Price Proposal. Submit the Price Proposal separately from the Technical Proposal in a sealed envelope/box and clearly labeled as the “Price Proposal.”

Block 9:

In accordance with FAR Provision 52.236-27, Site Visit, a Government representative can be available to show the project to prospective bidders. All requests for site visits see Section E of the solicitation and e-mail all questions concerning this construction project to the following e-mail address eflhd.contracts@dot.gov. Interested parties must provide the Solicitation Number and the relevant project name with all requests and questions.

Block 11:

Maximum Time Allowed for the Contract if all schedules are Awarded at the Same Time:

If the Government awards the contract as Schedules A + B + C+ D +E + F + G, the performance period to complete all contract work will be 1285 calendar days.

Maximum Time Allowed for Each Schedule of Work if Awarded Separately:

If the Government awards the contract as Schedules A + B + C, the performance period to complete all contract work will be 1045 calendar days.

If Schedule D (Government Option 1) is exercised after the award of the original contract, the performance period of the contract will be extended 60 calendar days and the performance of Schedule D work is to be simultaneous with the performance of the executed contract.

Block 12A:

Furnish performance and payment bonds in accordance with FAR Clause 52.228-15.

Block 13:

A bid guarantee in the amount of not less than 20 percent of the bid price or $3 million, whichever is less, is required with this bid. If the bidder fails to provide the required bid guarantee, such failure may require rejection of the bid. Reference FAR Provision 52.228-1, Bid Guarantee.

Basis for Award:

EFLHD intends to award a fixed price contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)); therefore, the Offeror's technical and price proposal should be clear and complete and contain the Offeror's best terms. The Government reserves the right to conduct discussions if later deemed necessary. The Government further reserves the right to reject any or all offers if such action is in the Government's best interest.

The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical “non-cost” factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.

Evaluation of Award:

All evaluation factors other than cost or price, when combined, are approximately equal in their importance when compared to cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor. The technical proposal of the Offeror awarded the contract will be incorporated into the contract by reference and the contractor shall be bound by its contents. In case of discrepancies between the technical proposal and contract requirements, the contract requirements will prevail, as determined by the Contracting Officer.

PROPOSAL INSTRUCTIONS

PROJECT: PR ERFO FS 2017-1(3)

OFFERORS PLEASE NOTE: Before preparing the proposal, carefully read the Instructions to Offerors. While preparing the proposal, comply with the following:

Submit all required proposal information to Eastern Federal Lands Highway Division (EFLHD) in sealed envelopes/boxes clearly addressed and identified for “Project No. PR ERFO FS 2017-1(3) - Solicitation No. 693C73-21-R-000021.” Submit all proposals so that they will arrive at the address shown in Block 7 of the SF-1442 on the due date specified in Block 13 of the SF-1442. Send proposals directly to the attention of the person listed in Block 9 of the SF-1442.

Submit three (3) bound paper copies, one (1) unbound copy, and one (1) CD ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”

Submit two (2) unbound paper copies and one (1) CD ROM copy of the Price Proposal. Submit the Price Proposal copies separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal.”

It is the Offeror’s sole responsibility to see that its proposal is received. Proposals received after the time due will be rejected without consideration or further evaluation. In addition, it is the Offeror’s responsibility to ensure all requirements of both the Technical Proposal and Price Proposal are included in their respective envelopes/boxes.

EVALUATION OF PROPOSAL DOCUMENTS

STEP 1 – TECNICAL PROPOSAL EVALUATION

The Technical Proposal is limited to 75 pages, 8.5” x 11” size paper, printed on one side only, pages numbered, and using Times New Roman font size 12. Gantt charts, site maps, or charts can be submitted on single sided sheets up to 11” x 17”. The technical proposal cover letter, outside covers, and section dividers do not count toward the 75-page limit.

An Evaluation Board will evaluate your technical proposal using the following evaluation criteria:

Factor 1 – Planned Approach to Construction and Project Understanding

The Government will review and evaluate each Offeror’s understanding of the contract work and overall approach to managing and constructing the project.

Describe the Offeror’s approach to the following elements:

1. Methods and ability to complete the contract work on time and within budget including construction of earth retaining structures, drainage, pavement reconstruction, coordination with utilities and other contractors, traffic control, erosion control, and other contract work.

2. Construction of earth retaining structures and related work while accommodating traffic and protecting the existing natural resources within the project limits.

3. Designing, constructing and use of excavation protection and shoring to meet OSHA worker protection requirements, maximize the width of the open road, provide safe and reliable access, and maintain traffic operations at all times.

4. Traffic control, including how the Offeror will minimize impacts to traffic, coordinate material delivery, hauling operations, and overall access with other contractors, and how public safety will be managed. Describe how to perform the work with the Government and project stakeholders to help oversee the successful traffic control implementation and how public information efforts will be addressed.

5. Performing work on PR-9938, including trucking of material to/from the repair sites, while accommodating safe pedestrian access to the Mt. Britton Trail.

6. Coordinating and addressing unforeseen utility conflicts with utility owners to minimize impacts to the project schedule.

7. Designing and constructing the retaining wall at PR-191 Km 7.2.

8. Constructing the wall at PR-191 Km 7.9 while maintaining traffic at all times.

9. Minimize unnecessary disturbance to the natural Forest environment, including historical structures, vegetation, fauna, and waterways. Discuss approach to meeting environmental requirements and permits, including monitoring and protecting biological and cultural resources.

10. Subcontracting and subcontractor management. Include the works to be subcontracted and approach to ensuring that work is completed within the project’s schedule and budget.

FACTOR 1 – PLANNED APPROACH TO CONSTRUCTION AND PROJECT

Acceptable Proposal shows an adequate construction approach and understanding of the requirements to manage and complete the project for the 10 elements.

The proposal has no major deficiencies, only minor deficiencies.

Marginal Proposal shows an adequate construction approach and understanding of the requirements to manage and complete the project for at least 5 of the 10 elements. The proposal has a few major deficiencies.

Unacceptable Proposal has not demonstrated an adequate construction approach and understanding of the requirements to manage and complete the project.

Factor 2 – Project Management and Controls

The Government will review and evaluate the Project Management and Controls of the Offeror by considering the Offeror’s approach to the project’s QA/QC, schedule, and coordination.

Offerors demonstrating effective and efficient project management procedure will be more favorably rated.

1. Describe the planned approach to overall quality assurance and quality control, in order to deliver a quality construction project on-time and within budget.

2. Describe the proposed Quality Control Plan.

3. Identify the system to be used and describe the functionalities for managing the construction schedule and include critical activities, durations, logical relationships, work limitations and restrictions, and construction milestones.

4. Describe the means and methods that will be used to plan and control the scheduling of work to ensure the project is constructed on time or ahead of schedule, and mitigate schedule delays resulting from inclement weather, unforeseen issues or conflicts.

5. Discuss the approach to meet the project schedule for the following scenarios:

(a) The Base Contract (Schedules A, B, and C) and Government Options 1, 2, 3 and 4

(Schedules D, E, F, and G) are awarded simultaneously.

(b) Government Options 1, 2, 3 and 4 (Schedules D, E, F, and G) are awarded 1 year after award of the Base Contract.

6. Describe overall approach to coordinating with EFLHD, the United States Forest Service, subcontractors, other construction projects within the Forest, and other affected stakeholders.

7. Describe the coordination procedures for working with utility owners for all planned work and identify how any unplanned utility conflicts will be addressed without significantly impacting the project schedule.

8. Describe overall approach to management of issues and conflict resolution to maintain the project on time and within budget.

Factor 3 – Qualifications and Past Performance

The Government will evaluate the qualifications of the Offeror by considering the Offeror’s example projects, past performance, and proposed project team, as described below. Offerors demonstrating a higher level of successful past performance in the evaluated areas will be more favorably rated.

(a) Example Projects and Past Performance: List 3 projects, performed (completed or currently under construction) within the past 5 years, similar in scope, complexity and magnitude to the PR ERFO FS 2017-1(3) project. Provide customer/owner point of contact, phone number, and email address for each relevant project. Include details regarding project budget vs. total cost and scheduled completion date vs. actual completion date. Provide a statement indicating the Offeror’s experience and technical competence in road construction in high profile, environmentally and culturally sensitive locations, as well as experience with traffic control in high traffic volume areas where maintaining traffic was paramount. List any relevant experience working with the Eastern Federal Lands Highway Division (EFLHD), FACTOR 2 - PROJECT MANAGEMENT AND CONTROLS RATINGS

Acceptable

Proposal shows adequate approaches, procedures, and understanding of the requirements for the 8 elements. The proposal has no major deficiencies, only minor deficiencies. Normal contractor effort and close Government monitoring will likely be able to overcome any difficulties.

Marginal

Proposal shows adequate approaches, procedures, and understanding of the requirements for at least 4 of the 8 elements. The proposal has a few major deficiencies. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.

Unacceptable

Proposal has not demonstrated adequate approaches, procedures, and understanding of the requirements to manage and complete the project. It is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.

(b) Proposed Team: Provide an organizational chart and submit resumes of key personnel to be involved in the project, indicating their specific experience within the past 5 years performing technically similar road and earth retaining structure construction work, construction project management, and construction QA/QC work for EFLHD and /or a similar DOT. At a minimum, include the Project Manager, Construction Superintendent, Traffic Safety Supervisor, and the Construction QA/QC Manager, each having a minimum of 2 years’ experience within the past 5 years performing technically the same or similar work.

List any subcontractors whom the Offeror proposes to provide services and indicate their experience performing similar work to the one they will be performing for this project.

(c) Capacity: Provide a brief statement indicating the Offeror’s capability to ensure work will be completed on time and within budget. Such areas of interest include financial resources, human resources, geographical location, available equipment, as well as knowledge and experience with working in historic and environmentally sensitive areas.

Include any statements as to integrity, reasonable and cooperative conduct, and commitment to QA/QC and customer satisfaction. Provide information on current project workload and how this project would be accommodated within it. Include customer, total cost, percent completed, and projected completion date for each project listed.

(d) Legal Condition. Answer and elaborate on the following questions:

(1) Within the last 10 years, has the Offeror ever been, or proposed to be, suspended, debarred, or determined non-responsible, based upon an allegation of unsatisfactory performance or fraud?

(2) Within the last 10 years, has the Offeror ever had a contract terminated for default, either as a prime, subcontractor, or a partner in a joint venture?

FACTOR 3 – QUALIFICATIONS AND PAST PERFORMANCE
