REQUEST FOR PROPOSALS

693C73-22-R-000021

Project Description: The project consists of repairing damage caused by Hurricanes Irma and Maria on PR- 14, Km 54.3-54.4; PR-722, Km 5.7; PR-796, Km 4.4; PR-179, Km 13.25; and PR- 181, Kms 8.7 and 46.4. The work includes embankment reconstruction, reinforced soil slope systems construction, drainage systems installation, concrete retaining wall, sheet pile wall, soldier pile retaining wall, milling and overlay, pavement reconstruction, pavement markings, removal and replacement of guardrails, signage, temporary traffic control, and other miscellaneous work. The project is located in the Municipalities of Aibonito, Caguas, Guayama, Gurabo, and Patillas, Puerto Rico.

The project will be split into multiple work schedules, with the cost of the entire project expected to fall within the price range of between $5,000,000 and $10,000,000.

Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.

These include the Plans, Special Contract Requirements (J Pages), and supplemental Government Furnished Information.

Procurement Overview of the Project: In accordance with Federal Acquisition Regulation (FAR) Part 15, the Eastern Federal Lands Highway Division (EFLHD) is conducting a Lowest Price Technically Acceptable Source Selection Process for this project. Under this Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two steps will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B Pages).

During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified Offerors based on the pass/fail (acceptable/unacceptable) evaluation criteria as stated in the RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information.

The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government may proceed with the second step (lowest price evaluation) without requesting further information from any Offeror; however, the Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.

During step two, only technical proposals determined to be acceptable, either initially or as a result of discussions, will be considered for award. The price proposals corresponding to the acceptable technical proposals will be opened and ranked according to price and the contract will be awarded to the lowest responsive, responsible Offeror as stated in the RFP’s Proposal Instructions - Basis of Award (B Pages). Only one price proposal may be submitted by each Offeror and the price proposal must be based upon the Offeror’s own technical proposal.

Contract award is anticipated to be no earlier than July 2022, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block 12a of the SF- 1412 and FAR Clause 52.228-15), but no earlier than August 2022.

It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal other than what is necessary to support the technical proposal. Offerors should limit their technical proposal to the information required by this Notice, and other information that may be relevant to the qualifications and experience of the Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.

Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.

Electronic proposals must contain the required signatures (electronic or by hand).

Basis for Award:

The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals for technical acceptability.

After all of the technical proposals have been evaluated, the Offerors that were found technically acceptable will be ranked according to price and the contract will be awarded to the responsive, responsible Offeror with the lowest Evaluation Total Price of Project, which is defined as:

Schedule A (Base Contract) - $ Schedule B (Government Option 1) - $

Schedule C (Government Option 2) - $

The Government will award the project as a Base Contract (Schedules A) with the option to award Schedule B (Government Option 1) and Schedule C (Government Option 2); see FAR Clause 52.217-5.

Evaluation of Award:

Award will be made to an offeror whose technical submittal and price proposal contain the combination of the technical qualifications (past performance of same type of projects) and price that offers the best value to the Government. Past performance will be evaluated by pass/fail. In determining which proposal offers the greatest value to the Government, price will be given greater weight. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of proof of acceptability for technical qualifications rests with the offeror.

Please Note:

This solicitation is a Request for Proposal (RFP). Therefore, there will not be a public bid opening and proposals are not available for review.

EVALUATION OF PROPOSAL DOCUMENTS

STEP 1 - TECHNICAL ACCEPTABILITY - Experience and Past Performance Performing Landslide Repairs and Proposed Project Team.

1.A. TECHNICAL ACCEPTABILITY EVALUATION DESCRIPTION

Competing Technical Proposals will be evaluated against the solicitation requirements; they are not compared with each other. Each of the technical evaluation factors described below will be rated on a pass/fail (acceptable/unacceptable) basis and must receive a passing score for an Offeror's proposal to receive further consideration. Failure to receive a passing score for any single technical evaluation factor will result in rejection of an Offeror's proposal notwithstanding passing scores for the other technical evaluation factors. Proposals which satisfy the technical requirements of the solicitation, in light of the evaluation criteria, will be determined technically acceptable.

Offerors will be evaluated on past performance and experience to manage landslide repair at multiple sites simultaneously in environmentally and culturally sensitive locations including the construction of earth retaining structures (including sheet pile walls, reinforced concrete walls, soldier pile retaining walls, and mechanically stabilized earth slopes), implementing temporary traffic control measures per MUTCD, performing pavement reconstruction and paving, implementing erosion and sediment control, and constructing culverts and other storm drain system installations and repairs.

1.B. TECHNICAL PROPOSAL EVALUATION FACTORS

Submit the following qualifications and information, and label as the Technical Proposal. The Technical proposal should address each of the factors in the same order as listed below.

(a) Relevant experience and past performance

The Offeror must have a minimum of five (5) years of experience performing landslide repair and roadway reconstruction work, as shown in Section 1.A above, that was similar in scope, cost, and difficulty to the work required by the contract resulting from this RFP.

(1) Provide a statement indicating the Offeror’s experience and technical competence performing work in environmentally and culturally sensitive locations, including implementing erosion control plans and related construction permitting activities.

(2) Provide a statement indicating experience with implementing and maintaining temporary traffic control and detours in state owned roadways or roadways where maintaining traffic access at all times was paramount.

(3) List any relevant experience delivering projects for Eastern Federal Lands Highway Division (EFLHD) and the Puerto Rico Highway and Transportation Authority

(PRHTA).

(4) Provide a list of three (3) to five (5) projects, successfully performed within the past five (5) calendar years (completed or currently more than 80% completed) showing the relevant experience.

(a) Provide customer/owner point of contact, phone number, and email address for each relevant project.

(b) Include Offeror’s project management staff including Project Manager and/or Superintendent.

(c) Discuss the similarities in project scope, cost, and constructability of the Offeror’s sample projects with the proposed project.

(d) Present the contract performance details for the sample projects. As a minimum, include information regarding original award and final project cost and schedule.

Discuss reasons for project delays and/or cost overruns.

(e) Present information requested for the sample projects in the following format:

Maximum of five (5) pages (8-1/2” x 11” sheet) using Times New Roman 12-point font. Keep the discussion for any one sample project within one (1) page (8-1/2” x 11” sheet).

(b) Proposed Project Team

(1) Provide an organizational chart of the Offeror’s key personnel selected to deliver this project. At a minimum, include the Project Manager, Construction Superintendent, Traffic Safety Supervisor, and the Construction QA/QC Manager.

(2) Provide resumes and a table summarizing each key personnel’s specific experience.

Each proposed key personnel shall have a minimum of three (3) years’ experience within the past five (5) years performing technically the same or similar work and have any required certifications. Limit the resumes to one (1) page (8-1/2” x 11” sheet) for each key personnel. Limit the table summarizing each key personnel’s specific experience to one (1) page (11” x 17” sheet).

(3) Provide a table listing any subcontractors whom the Offeror proposes to contract with for delivering the project. If none of the work will be subcontracted, indicate so.

Discuss the subcontractor’s experience in performing similar work to the one they will be performing for this project. Limit your table to one (1) page (11” x 17” sheet).

STEP 2 - LOWEST PRICE - Cost to Perform the Proposed Work

2.A. LOWEST PRICE EVALUATION DESCRIPTION

Only Price Proposals from Offerors that passed the technical acceptability phase will be opened and evaluated. Any hard copy Price Proposals from Offerors that did not pass the technical acceptability phase will be returned unopened. All acceptable Price Proposals will be reviewed and evaluated for completeness and reasonableness.

2.B. COMPLETING THE BID SCHEDULE

Complete the Bid Schedule(s) by handwriting in ink or typing. Specify a Unit Bid Price, in figures with cents to only two decimal places, for each pay item in the Unit Bid Price column for which a quantity is given. Do not enter or tender a Unit Bid Price for any pay item for which no estimated quantity appears in the Bid Schedule. Determine the products of the respective unit prices and quantities, and show them, in figures, in the Amount Bid column. If a Unit Bid Price and Amount Bid have been inserted by the Government for a pay item, do not change the Unit Bid Price and Amount Bid for the pay item. Determine the Bid Total for each specific individual Schedule of Work by adding the amounts of the listed items and show in the block provided for that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.

To be eligible for award, Offerors must submit prices for each pay item.

Review Subsection 109.05 of the SCR (Special Contract Requirements) regarding scope of payment for direct and indirect payment work.

Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Price Proposal Summary page (B-11). Fill in the Evaluation Total Price of Project in the space provided on the Price Proposal Summary page (B-11).

The completed Bid Schedule, pages B-1 through B-11, is considered the Offeror's Price Proposal.

The amount in Block 17 of the SF 1442 should be completed as follows:

Schedule A - $ .

Schedule B - $ .

Schedule C - $ .

2.C. SCHEDULES OF WORK

The Bid Schedule is comprised of the following separate schedules and options of work:

Schedule A (Base Contract) - Pages B-1 thru B-4 Schedule B (Government Option 1) - Pages B-5 thru B-8 Schedule C (Government Option 2) - Pages B-9 thru B-10

The Government will award the project as a Base Contract (Schedule A) with the option to award Schedule B (Government Option 1) and Schedule C (Government Option 2); see FAR Clause 52.217-5.

The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price, by proper utilization of programmed funds and upon receipt of any additional funds or permits required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract) and permitting issues for the individual schedules are resolved by that time, the Government may award Schedule B (Government Option 1) and Schedule C (Government Option 2) at that time. If additional funding is required and/or permitting issues have not been resolved for the award of Schedule B (Government Option 1) and Schedule C (Government Option 2), and funding is received and permitting issues are resolved after the award of Schedule A (Base Contract), the Government has the right to exercise Schedule B (Government Option 1) and Schedule C (Government Option 2), at the unit prices bid no later than 180 calendar days from the Notice to Proceed for Schedule A (Base Contract).

2.D. COMPLETION OF WORK

The Government has estimated the number of calendar days necessary to complete all contract work from the effective date of the Notice to Proceed to contract completion for the various contract award scenarios. The maximum number of calendar days allowed (i.e., the contact performance period) is shown in Block 11 of the SF-1442 and described below.

If the Government awards the contract as Schedules A + B + C, the performance period to complete all contract work will be 670 calendar days.

If the Government awards the contract as Schedules A + B, the performance period to complete all contract work will be 590 calendar days.

If the Government awards the contract as Schedules A + C, the performance period to complete all contract work will be 620 calendar days.

If the Government awards the contract as Schedule A only, the performance period to complete all Schedule A work will be 575 calendar days and will start on the effective date of Schedule A’s Notice to Proceed.

If Schedule B (Government Option 1) is exercised after the award of the original contract, the performance period of the contract will be extended 50 calendar days and the performance of Schedule B work is to be simultaneous with the performance of the executed contract.

If Schedule C (Government Option 2) is exercised after the award of the original contract, the performance period of the contract will be extended 90 calendar days and the performance of Schedule B work is to be simultaneous with the performance of the executed contract.

In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the Special Contract Requirements (SCR). Specific work limitations may be (but are not limited to):

National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc.); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc.). The Government also considered time required for preparing material and drawing submittals, and the allowable Government review times for those submittals (Subsection 104.03 of the SCR).

Offerors are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-

15) may result in the start of construction activities to be no earlier than August 2022. See Subsection 108.01 of the SCRs for additional details.

2.E. PRICE PROPOSAL SUBMITTAL

As stated above, the completed Bid Schedule, pages B-1 through B-11, is considered the

Offeror’s Price Proposal. Submit the Price Proposal separately from the Technical Proposal in accordance with the directions provided on page one (1) of the Proposal Instructions.

BASIS FOR AWARD

The Government will award the project to the lowest priced/technically acceptable responsible Offeror. The Contracting Officer intends to evaluate all proposals for technical acceptability.

After all of the technical proposals have been evaluated, the Offerors that were found technically acceptable will be ranked according to price and the contract will be awarded to the responsive, responsible Offeror with the lowest Evaluation Total Price of Project, which is defined as:

Schedule A (Base Contract) Bid Total + Schedule B (Government Option 1) Bid Total + Schedule C (Government Option 2) Bid Total.
