FEDERAL HIGHWAY ADMINISTRATION
EASTERN FEDERAL LANDS HIGHWAY DIVISION
GREAT SMOKY MOUNTAINS NATIONAL PARK
PROJECT NP-GRSM 126(1)
REPLACEMENT OF FIVE BRIDGES ON FORGE CREEK ROAD
REQUEST FOR PROPOSALS
RFP No. 693C73-20-R-000015
Project Description: The project consists of removal and reconstruction of the Forge Creek Bridges #1 thru #4 and the Mill Creek Bridge with stone masonry-faced, reinforced concrete abutments and piers, steel beams, timber decks and railing, reinforced concrete approach slabs, riprap, streambank restoration and other miscellaneous work. The project is located in Blount County, Tennessee.
The construction cost for the project is estimated to be between $1,000,000 and $5,000,000.
Scope of Work: The detailed scope of work to be undertaken by the successful Offeror under the contract for this project is outlined in the Request for Proposal (RFP) solicitation documents.
These include the Plans, Special Contract Requirements (J Pages), and supplemental Government Furnished Information.
Procurement Overview of the Project: In accordance with Federal Acquisition Regulation (FAR) Subpart 15.101-1, the Eastern Federal Lands Highway Division (EFLHD) is conducting a Best Value Trade-off Source Selection Process for this project. Under this Notice, the EFLHD (also referred to as “the Government”) is soliciting all eligible Contractor firms/teams (Offerors) to participate in a two-step RFP process. The two steps will include the submittal of two proposal packages; a Technical Proposal and a Price Proposal. A description of these proposals and their requirements can be found in the RFP’s Proposal Instructions (B Pages).
During step one, a selection evaluation board will review and evaluate the technical proposals submitted by all interested, responsive Offerors. The selection committee will select qualified Offerors based on a confidence rating evaluation criteria as stated in the RFP’s Proposal Instructions - Evaluation of Proposal Documents (B Pages). Offerors should submit technical proposals that are acceptable without additional explanation or information. The Government may make a final determination regarding a technical proposal’s acceptability solely on the basis of the technical proposal as submitted. The Government may proceed with the second step (trade-off evaluation) without requesting further information from any Offeror; however, the Government may request additional information from any Offeror with a technical proposal considered reasonable and close to acceptable, and may discuss any technical proposal with any Offeror. Only one technical proposal may be submitted by each Offeror. The step one technical proposal shall not include any prices or pricing information.
During step two, the Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical (“non-cost”) factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.
All evaluation factors other than cost or price, when combined, are significantly more important than cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor. Only one price proposal may be submitted by each Offeror and the price proposal must be based upon the Offeror’s own technical proposal.
As stated in FAR Clause 52.236-1, the Contractor shall perform on the site, and with its own organization, work equivalent to at least 15% of the total amount of work to be performed under the contract.
Contract award is anticipated to be no earlier than August 2020, with Notice to Proceed anticipated to be issued after the receipt of valid Performance and Payment Bonds (see Block 12a of the SF-1412 and FAR Clause 52.228-15), and the anticipated start of construction activities to be no earlier than November 2020. Construction activities requiring a full roadway closure are required to be completed by May 27, 2021, as specified in Subsection 108.01 of the Special Contract Requirements (J Pages). See Subsection 108.01 for additional construction activity restrictions.
It is not the intent of EFLHD to receive project specific design or engineering recommendations as part of the step one technical proposal. Offerors should limit their technical proposal to the information required by this notice and other information that may be relevant to the qualifications and experience of the Offeror. No reimbursement will be made for any expenses associated with the preparation of a step one technical proposal or a step two price proposal.
Obligation to Keep Team Intact: In connection with the services covered by this procurement process, any in-house personnel, subcontractors, and outside associates will be limited to the individuals or firms that are specifically identified during the step one technical proposal. The Contractor shall obtain the Contracting Officer’s written consent before making any substitution for these designated in-house personnel, subcontractors, or outside associates.
Supplemental Work: Offerors are expected to provide qualified and experienced staff to develop appropriate pre-construction or construction protocols as designated by Federal, state, and local regulations/guidelines, including but not limited to the following:
• Work Plan.
• Accident Prevention Plan.
• Health and Safety Plan.
• Environmental Management Plan.
• Waste Management Plan.
• Recycling Plan.
Submittals: Each Offeror must provide the required number of Technical and Price Proposals as described below to EFLHD in separate, sealed envelopes/boxes clearly addressed and identified for “Project No: NP-GRSM 126(1).”
Submit one (1) bound paper copy, one (1) unbound copy, and one (1) CD-ROM copy of the Technical Proposal. Submit the Technical Proposal copies separately from the Price Proposal in a sealed envelope/box and clearly labeled as the “Technical Proposal.”
Submit two (2) unbound paper copies and one (1) CD-ROM copy of the Price Proposal. Submit the Price Proposal copies separately from the Technical Proposal in a sealed envelope and clearly labeled as the “Price Proposal.”
Submit all proposal documents by the due date specified in Block 13 of the SF-1442 to the following address:
Federal Highway Administration Eastern Federal Lands Highway Division 21400 Ridgetop Circle Sterling, VA 20166 Attn: C. Shawn Long

If the offeror fails to provide the required bid guarantee, such failure may require rejection of the offer. Reference FAR Provision 52.228-1, Bid Guarantee.
Block 17:
Amounts should be completed as follows:
Schedule A - $ Schedule B (Option 1) - $ Schedule C (Option 2) - $
Basis for Award:
EFLHD intends to award a fixed price contract without discussions with offerors (except clarifications as described in FAR 15.306(a)); therefore, the offeror's technical and price proposal should be clear and complete and contain the offeror's best terms. The Government reserves the right to conduct discussions if later deemed necessary. The Government further reserves the right to reject any or all offers if such action is in the Government's best interest.
The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical “non-cost” factors and allows the Government to accept other than the lowest priced offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.
Evaluation of Award:
All evaluation factors other than cost or price, when combined, are significantly more important than cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor. The technical proposal of the firm awarded the contract will be incorporated into the contract by reference and the contractor shall be bound by its contents.
Please Note:
This solicitation is a Request for Proposals (RFP). Therefore, there will not be a public bid opening and proposals are not available for review.
Other:
The estimated price is expected to fall within the price range of $1,000,000 to $5,000,000.
Responsibility of offerors shall be evaluated in accordance with the information provided on the Offeror’s Qualifications Form, which can be downloaded from the beta.SAM.gov web site.
FP-14 versions can be downloaded at the FHWA web site. FHWA web site is http://flh.fhwa.dot.gov/resources/specs/ then click on “Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects.”

that individual Schedule of Work. In case of multiplication errors, the Amount Bid for the item will be based on the Unit Bid Price.
To be eligible for award, Offerors must submit prices for each pay item.
Review Subsection 109.05 of the FP (standard specifications book) regarding scope of payment for direct and indirect payment work.
Fill in the Bid Total(s) for each individual Schedule of Work as directed on the Cost Proposal Summary page. Fill in the Evaluation Total Price of Project in the space provided on the Cost Proposal Summary page.
The Offeror’s Price Proposal is considered to be a combination of the completed Bid Schedule (pages B-1 to B-7) and the completed Cost Proposal Summary page (page B-8).
The amount in Block 17 of the SF 1442 should be completed as follows:
Schedule A - $ .
Schedule B - $ .
Schedule C - $ .
SCHEDULES OF WORK
The Bid Schedule is comprised of the following separate schedules and options of work:
Schedule A (Base Contract) - Pages B-1 thru B-3 Schedule B (Government Option 1) - Pages B-4 thru B-6 Schedule C (Government Option 2) - Page B-7
The Government will award the project as a Base Contract (Schedule A) with the option to award Schedules B and C (Government Options 1 and 2); see FAR Clauses 52.217-4 and 52.217-5.
The purpose of the multiple schedules and options is to give the Government maximum flexibility in completing the project in a timely manner and at a cost-effective price, by proper utilization of programmed funds and upon receipt of any additional funds required to award the contract. If complete funding is in place at the time of award of Schedule A (Base Contract), the Government may award Schedules B or C (Government Options 1 or 2) at that time. If additional funding is required for the award of Schedules B or C (Government Options 1 or 2), and is received after the award of Schedule A (Base Contract), the Government has the right to exercise Schedules B and C (Government Options 1 and 2) at the unit prices bid according to the following schedule:
Schedule B (Government Option 1): No later than December 2, 2020 (or 30 days after the start of construction activities as stated in Subsection 108.01 of the Special Contract Requirements (J Pages)).
Schedule C (Government Option 2): No later than January 2, 2020 (or 60 days after the start of construction activities as stated in Subsection 108.01 of the Special Contract Requirements (J Pages)).
COMPLETION OF WORK
The Government has estimated the number of calendar days necessary to complete all contract work from the effective date of the Notice to Proceed to contract completion for the various contract award scenarios. The maximum number of calendar days allowed (i.e., the contact performance period) is shown in Block 11 of the SF-1442 and described below.
If the Offeror chooses to exercise a completion date of May 27, 2021 and the Government awards the contract as Schedules A + B + C, the performance period to complete all contract work will be 207 calendar days.
If the Offeror chooses to not exercise a completion date of May 27, 2021 and the Government awards the contract as Schedules A + B + C, the performance period to complete all contract work will be 398 calendar days.
If the Government awards the contract as Schedule A only, the performance period to complete all Schedule A work will be 140 calendar days and will start on the effective date of Schedule A’s Notice to Proceed.
If Schedule B (Government Option 1) is exercised after the award of the original contract, the performance period to complete all Schedule B work will be 110 calendar days and will start on the effective date of Schedule B’s Notice to Proceed.
If Schedule C (Government Option 2) is exercised after the award of the original contract, the performance period to complete all Schedule C work will be 20 calendar days and will start on the effective date of Schedule C’s Notice to Proceed.
In developing a construction schedule to determine the number of calendar days, the Government considered and included the work limitations shown in Sections 108 and 156 of the FP and Special Contract Requirements (SCR’s). Specific work limitations may be (but are not limited to): National legal holidays, weekends, rush hours, night work, specified no work periods, work or traffic control phasing, etc. The Government also considered those work items that are weather sensitive and when those work items will be performed. Specific work items are (but not limited to): those that require a minimum ambient air temperature (asphalt paving and surface treatment, pavement striping, stone masonry, etc); those that require maintaining a minimum surface temperature (concrete pavement, structural concrete, painting, etc); and those that have specific planting seasons (turf establishment, sod, trees, plants, etc). The Government also considered time required for preparing material and drawing submittals, and the allowable
Government review times for those submittals (Subsection 104.03 of the FP and SCR’s).
Bidders are to assume that the award of the contract and approval of the Contractor’s Performance and Payment Bonds (see Block 12a of the SF-1442 and FAR Clause 52.228-
15) may result in the start of construction activities to be no earlier than November 2020.
See Subsection 108.01 of the SCR’s for additional details.
STEP 3 – BEST VALUE DETERMINATION
All evaluation factors other than cost or price, when combined, are significantly more important than cost. The Technical Proposal of the Offeror awarded the contract will be incorporated into the contract by reference and the Contractor shall be bound by its contents.
