The contractor shall include in the rationale for late delivery, the expected date for the delivery, and the projected impact of the late delivery. Such notification in no way limits any Government contractual rights or remedies including, but not limited to, a consideration or termination. It shall be implicit that a response to an RFP or delivery order with no items identified on backorder is a declaration that the items are available at time of proposal submission.
4.4 ORDER TRACKING
The contractor shall maintain an order tracking system that permits ordering agencies to track the location of an order at any time, from the moment the order is shipped, to the point of delivery and acceptance. The Offeror must demonstrate understanding of order bound for an international end-point by providing a sample electronic version of a label appropriately marked in accordance with the most recent FED-STD 123H and MIL-STD-129 as of the date of solicitation issuance. Any request and subsequent increase will be incorporated at time of option exercise.
SECTION 6 - SPECIAL CONTRACT REQUIREMENTS
6.1 CONSIDERATION FOR LATE DELIVERY
GSA reserves the right to make the following considerations for late delivery. Late delivery will be calculated on the original due date based on the contracted ARO terms for the contract regardless of reported shipment status. Therefore, a backorder will not extend the delivery date:
● For orders 1-5 calendar days late, 2% reduction of the late purchase order value contract price for the applicable orders
● For orders 6-10 calendar days late, 3% reduction of the late purchase order value contract price for the applicable orders
● For orders 11+ calendar days late, 4% reduction of the late purchase order value contract price for the applicable orders
● For orders where tracking data is not entered or submitted by the contractor, thereby rendering the Government unable to evaluate on-time performance for said orders, a reduction equal to 5% of the late purchase order value contract price for the orders identified Before taking the price reduction, GSA will:
o Communicate the orders to which the reductions apply and the total reduction amount o Provide a reasonable time but not longer than 10 calendar days, for the contractor to rebut the findings o After considering any rebuttals, which may include consideration for factors outside of the contractor's control, the Contracting Officer will issue a final decision to initiate the reduction.
6.2 CHARGES FOR MARKING AND LABELING
If contractors are noncompliant with clause 552.211-73 Marking, and all other contract clauses addressing marking, labeling, and packaging, the contractor may be charged for incorrect packaging or marking.
If supplies shipped are not packaged, packed, and marked in accordance with contract requirements, the Government has the right, without prior notice to the contractor, to perform the required repackaging/repacking/remarking, by contract or otherwise, and charge the contractor at the following rates:
First hour: $150.00
Each additional hour: $70.00
A minimum of two hours is required for each incident, making the minimum change for remarking is $220.00.
The contractor may also be charged for material costs, if incurred. This right is not exclusive and is in addition to other rights and remedies provided for in this contract.
The rate in the above clause shall be determined and may be periodically updated by the Commissioner, Federal Acquisition Service, or a designee. Charges, shall be applicable to the following:
● Contractor non-compliance with GSAM 552.211-73 or for any contractor actions leading to non-compliance with proper “marking and labeling.
● Repeated or continual frustrated freight of the contractor shipments. Once a contractor has been notified, if frustrated freight continues to occur, a minimum of $220 per instance shall apply. The Government reserves the right to increase this amount at any time in the future with 30 days’ notice.”
● For more information on marking IAW MIL-STD-129R and FED-STD-123H, please see Attachment D: MIL-STD-129R and FED-STD-123H MARKING

All transactions will be submitted to and received by the prime contractor only. GSA will not conduct electronic transactions with the prime contractor’s subcontractors or dealers. Please refer to the Attachment C for further instructions.
7.2 ORDER STATUS AND DELIVERY
GSA must have an established integrated process to enhance customer service, measure performance, and have visibility across supply chain activities. The contractor must provide proof of delivery, order tracking information, and delivery confirmation status (shipping, tracking, and returns) for multiple carriers via a secure internet environment (HTML, XML). This would include seamless access to shipping functionality, from the time of order entry to time of delivery with integration into OMS Vendor Portal or EDI.
