About this file

This document is a Request for Proposals (RFP) issued by the Oregon Water Resources Department (OWRD) for the Lower Umatilla Basin Groundwater Management Area Well Sampling Project. The purpose of the project is to collect data to better understand the occurrence of nitrate contamination throughout the aquifers of the Lower Umatilla Basin Groundwater Management Area. The RFP seeks proposals from licensed pump installation specialty contractors, water supply constructors, or monitoring well constructors to remove pumps from approximately 20 domestic wells, allow OWRD staff to perform geophysical surveys, and then reinstall the pumps. Proposals are due by October 14, 2024, and the initial contract term is anticipated to end on June 30, 2025 upon completion of the project.

The RFP outlines the minimum qualifications, submission requirements, and proposal format for responding to the solicitation. It also details the solicitation process, including public notice, question submission, proposal delivery, evaluation criteria, and award notification. The successful proposer must be licensed and in good standing in the state of Oregon to operate a pump services or well construction business. Payment terms and pricing structure requirements are specified, and the state encourages participation from certified small businesses, including disadvantaged, minority-owned, women-owned, service-disabled veteran-owned, and emerging small businesses.

Terminology specific to the OregonBuys system may be found at OregonBuys.

The Oregon Water Resources Department (OWRD) is charged with carrying out the water management policies and rules set by the Water Resources Commission and with overseeing the enforcement of Oregon’s water laws.

The OWRD is organized into five divisions: Field Services, Technical Services, Water Rights and Adjudicaons, Director’s Office, and Administrave Services. OWRD headquarters and the Northwest Regional Office are in Salem, Oregon. The OWRD also has four other regional offices and 20 small field offices throughout Oregon.

The Field Services and Technical Services Divisions manage and administer the gage staon operaons and maintenance. The OWRD operates and maintains over 250 gaging staons across the state.

The Oregon Department of Environmental Quality established the Lower Umalla Basin Groundwater Management Area (LUBGWMA) in 1990, in accordance with the Oregon Groundwater Quality Protecon Act (ORS 468B.150-190) as a result of elevated regional nitrate-nitrogen concentraons in groundwater within the Lower Umalla Basin in Morrow and Umalla Counes (see Figure 1).

The purpose of this project is to collect data to beter understand the occurrence of nitrate contaminaon throughout the aquifers of the LUBGWMA. At present, there is uncertainty about the locaon and degree of nitrate contaminaon in the shallow sedimentary aquifer system and underlying basalt aquifers of the LUBGWMA. While thousands of nitrate samples have been collected and analyzed as part of Oregon Health Authority’s (OHA) effort to address the public health crisis, many of the wells sampled cannot be confidently associated with specific aquifers because the wells do not have original well logs detailing well construcon and lithology. This project will address that knowledge gap by performing geophysical surveys at approximately twenty (20) wells in key locaons across the LUBGWMA.

The LUBGWMA Well Sampling Project (Project) includes the removal of pumps from a group of domesc wells by an Oregon-Licensed well driller or pump installer licensed by the Construcon Contractors Board (Pump Contractor) contracted to OWRD. All work shall be conducted according to established, professional pump installaon standards and in accordance with applicable OARs and ORSs. The Pump Contractor shall conduct work in a manner that priorizes the health and safety of all site personnel. Should these guidelines and/or health and safety concerns conflict with elements of this technical specificaon, the Pump Contractor shall request clarificaon from OWRD before proceeding.

A subset of approximately 20 wells within the LUBGWMA will be idenfied for the Project. The Project consists of the Pump Contractor removing pumps from wells, OWRD staff performing a geophysical survey, and the Pump Contractor reinstalling the pump to the same specificaons as originally installed.

The Project must be completed before June 30, 2025. Contractors shall idenfy their ancipated mobilizaon date and job duraon in their Proposal. OWRD staff will frequently be present onsite during the duraon of the project and will work with the Pump Contractor to schedule a mutually acceptable schedule.

OWRD staff will coordinate directly with the property owners for each well to determine schedule and other specificaons. OWRD will be the primary point of contact with the well owner. Contact informaon will be provided to the Pump Contractor as needed to coordinate work and site access. The Project sites will be properes with wells throughout the LUBGWMA. Wells selected for this project are not located inside of buildings and will have immediately adjacent truck / equipment access.

DAS Procurement Services, Version 4.5 March 31, 2023 Page 6 of 17

There is no guaranteed access to ulies on each site (water, power, restrooms, etc.). The Pump Contractor will be responsible for providing all supporng Services and supplies required to complete the project Scope and will remove all unused and waste materials from the site aer compleon of the work.

The Pump Contractor will make all reasonable efforts to minimize impact to the landscape by contractor’s equipment, including use of mats or plywood. At the compleon of the work, the ground surface surrounding the well will be returned to a state substanally similar to that present before mobilizaon to the site.

The Pump Contractor will employ an effecve and efficient approach to pump removal. The pump and associated components will be stored in a sanitary manner, once removed from the well.

While the pump is removed from the well, OWRD will perform a geophysical survey with OWRD equipment.

These tests may have a duraon up to 10 hours. The Pump Contractor is not required to be onsite during the geophysical survey.

Once the geophysical survey is complete, the Pump Contractor will replace the pump to the same specificaons as originally installed. At the property owners’ request, the Pump Contractor may perform any requested repairs or maintenance on the pumps while removed from the well, provided such work does not interfere with the Project schedule or outcomes. Any addional pump maintenance or repair work performed will be at the cost of the well owner. Details of any addional pump work will be coordinated directly between the Pump Contractor and the property owner, separate from the Project.

Proposer A receives scores of 10, 9, and 9.5 for criterion worth 50 points. The SPC averages 10, 9, and 9.5 for a score of 9.5 and uses 95% as a mulplier to the possible points of 50. 50 Mulplied by 95% is 47.5. Proposer A’s points for the criterion is 47.5.

The SPC will average the scores for each Proposal in a given round of compeon (calculated by totaling the points awarded by each Evaluaon Commitee member and dividing by the number of members). The SPC will combine the average score for each Proposal with Proposer’s Price Score and Reference Score.

Aer any applicable preference has been applied, the SPC will determine the rank of each Proposal, with the highest score receiving the highest rank, and successive rank order determined by the next highest score.

Agency may, in Agency’s sole discreon, determine an apparent successful Proposer with no addional rounds of compeon. If addional rounds are conducted, Agency will rank advancing proposers at the conclusion of each subsequent round and may determine an apparent successful Proposer at any me during the Solicitaon process.

If Agency, in its sole discreon, determines that one or more addional rounds of compeon is necessary, it will select a Compeve Range to indicate the Proposers that will be invited to parcipate in a subsequent round. The Compeve Range may include all, or at Agency’s sole discreon, some (based primarily on a natural break in the distribuon of scores), of the Proposers from a previous round. Agency will post a noce in OregonBuys of its Compeve Range Determinaon and provide details about the process and schedule for the subsequent round.

Proposers excluded from a round may submit a writen protest of Compeve Range. Protest must:

• Be emailed to the SPC;

• Reference the OregonBuys Bid Solicitaon number;

• Idenfy Proposer’s name and contact informaon;

• Be sent by an authorized representave;

• State the reason for the protest; and

• Be received within 7 Calendar Days aer issuance of the Noce of the Compeve Range unless a different due date and me is specified in such noce.

Agency will address all protests within a reasonable me and will issue a writen decision to the respecve Proposer. Protests that do not include the required informaon may not be considered by Agency.

There will be no addional rounds of selecon for this Solicitaon.

Agency, if it awards a Contract, will Award a Contract to the highest ranking Responsible Proposer(s) based upon the scoring methodology and process described in Secon 4. Agency may Award less than the full Scope of Work described in this RFP.

Agency will nofy all Proposers in wring that Agency intends to Award a Contract to the selected Proposer(s) subject to successful negoaon of any negoable provisions.

DAS Procurement Services, Version 4.5 March 31, 2023 Page 14 of 17

An affected Proposer shall have 7 calendar days from the date of the Intent to Award noce to file a writen protest.

A Proposer is an Affected Proposer only if the Proposer would be eligible for Contract Award in the event the protest was successful and is protesng for one or more of the following reasons as specified in ORS 279B.410:

• All higher ranked Proposals are non-Responsive.

• Agency has failed to conduct an evaluaon of Proposals in accordance with the criteria or process described in the RFP.

• Agency abused its discreon in rejecng the protestor’s Proposal as non-Responsive.

• Agency’s evaluaon of Proposal or determinaon of Award otherwise violates ORS Chapter 279B or

ORS Chapter 279A.

If Agency receives only one Proposal, Agency may dispense with the evaluaon process and Intent to Award protest period and proceed with Contract Negoaons and Award.

Protests must:

• Be delivered to the SPC via email;

• Reference the OregonBuys Bid Solicitaon number;

• Idenfy Proposer’s name and contact informaon;

• Be signed by an authorized representave of Proposer;

• Specify the grounds for the protest; and

• Be received within 7 calendar days of the Intent to Award noce.

Agency will address all mely submited protests within a reasonable me and will issue a writen decision to the respecve Proposer. Protests that do not include the required informaon may not be considered by

Proposer must submit those excepons to Agency during the Quesons / Request for Clarificaon period set forth in Secon 1.2. if Agency agrees to make any requested changes to the Sample Contract, Agency will issue an Amendment to nofy Proposers of such changes. Following the selecon of the apparent successful Proposer, Agency may agree to negoate changes to the negoable provisions of the sample Contract listed below.
