Successful proposers must obtain annual certification from the County and comply with extensive requirements including trauma-informed care practices, cultural humility, criminal background checks for all staff, specific staffing ratios, development of comprehensive policies and procedures, establishment of FDIC-insured trust accounts for participants, provision of 24/7 crisis intervention services, and maintenance of detailed reporting on young adult outcomes. Board: The San Bernardino County Board of Supervisors.
California Department of Social Services (CDSS): Provides oversight of California’s Child Welfare and Foster Care system, Welfare-to-Work programs, Disabled and Adult programs, and licensed community care facilities. The mission of CDSS is to serve, aid, and protect needy and vulnerable children and adults in ways that strengthen and preserve families, encourage personal responsibility, and foster independence.
California Youth Connections: A non-profit organization which promotes the participation of foster youth in policy development and legislative change to improve the foster care system.
Child and Family Team (CFT) Meeting: A group that forms to meet the needs of an eligible child/youth through whatever means possible. This team includes the child/youth, parents, caregivers, relatives, county Social Worker, Probation Officer or Behavioral Health Clinician, and anyone else the youth/family identifies as a member.
Children and Family Services (CFS): The San Bernardino County department that administers programs designed to address child abuse and neglect issues. CFS provides family-centered programs and services that are designed to strengthen, preserve, and ensure children have access to safe and permanent family units. CFS provides support for families while working to reduce risk and harm to children, improving parenting skills, and developing strong social support networks for families.

RFP No. 24-07 that acts as a rent guarantee. This lease type is typically executed when the program utilizes apartments at affordable housing developments that have funding restrictions requiring units to be rented to individuals of a certain income level. Even rental units that are “affordable” are not affordable to a young adult who has recently aged out of foster care or probation, so the Contractor subsidizes the monthly rent for the individual young adult tenant in the apartment. When the thirty-six (36) month subsidy provided by the THP-Plus is over, the young adult assumes responsibility for the full amount of the rent and continues to live in the rental unit.
Discharge: Early dismissal of young adults from the THP-Plus program due to program non-compliance.
Eligible Young Adult: A young adult, who has exited foster care, is between eighteen (18) and twenty-five
(25) years of age, and had an open placement on their eighteenth (18th) birthday, or has successfully reentered Extended Foster Care (EFC) under the following criteria:
• Placed by the juvenile court in a guardianship or adopted from foster care,
• Guardian or adoptive parent(s) were receiving payments for support on or after the youth’s eighteenth
(18th) birthday,
• Guardian or adoptive parent(s) died on or after the youth’s eighteenth (18th) birthday, or
• Guardian or adoptive parent(s) no longer supports the youth and no longer receives payment for the youth’s support.
Extended Foster Care (ECF): A program implemented by California Assembly Bill (AB) 12 (2010) and AB 212 (2011), collectively known as the California Foster Connections to Success Act (CFCSA). CFCSA implements the Federal Fostering Connections to Success and Increasing Adoptions Act (H.R.6893). The FCA, or Fostering Connections Act, was signed into law on October 7, 2008, as Public Law 110-351 in California. EFC permits non-minor dependents (NMDs) to elect to continue juvenile court dependency past the age of 18 and up to the age of 21.
Facilitator: A County Purchasing Department buyer or designated individual tasked with managing the processes of the evaluation panel.
Family Search and Engagement: A set of practices designed to locate, engage, connect, and support family resources for youth who have been remanded to the juvenile dependency court (i.e., foster or probation youth). Family Search and Engagement identifies issues and activities involved in relative search, in addition to providing a variety of practical tools to assist practitioners in the day-to-day work. Resources may include access to the youth’s biological family, near kin, or Nonrelative Extended Family Member (NREFM). NREFM is defined as an adult caregiver who has an established familial relationship with a relative of the child, or a familial or mentoring relationship with the child (Welfare and Institutions Code Section 362.7), such as a godparent, a teacher, or a neighbor. The county welfare department shall verify the existence of a relationship through interviews with the parent and child or with one (1) or more third parties. The third parties may include relatives of the child, teachers, medical professionals, clergy, neighbors, and family friends.
Host Family: A family setting with a relative, current or former foster family, or another consistent caring adult who has been screened and approved by the THP-Plus provider.
Host Family Model: Participants live in a family setting with a relative, current or former foster family, or other consistent caring adult whom has been screened and approved by the THP-Plus Contractor. THP-Plus supportive services and rental subsidies are provided for up to a thirty-six (36) month period or the day when the young adult reaches his/her twenty-fifth (25) birthday. When the young adult completes their THP-Plus program, determination is made whether or not the participant moves out of the host family home on an individual basis.

Human Services (HS): San Bernardino County Human Services (HS), a system of integrated services, where the programs and resources of nine (9) County departments come together to provide a rich, more complete array of services to the citizens of San Bernardino County under one coordinated effort.
Independent Living Program (ILP): The program authorized by the Foster Care Independence Act of 1999 (Public Law 106-169) to provide education, training, employment, financial support, and services that help current and former juvenile court supervised (foster care and probation) youth achieve independence and self-sufficiency prior to exiting and after leaving the dependency and delinquency systems.
Independent Living Program (ILP) Extended Care Services: The program is designed to meet the needs of those defined as Eligible Young Adults, but have not yet attained twenty-one (21) years of age. Services include, but are not limited to, education assistance and counseling, legal assistance and counseling, career preparation, job placement and retention training, vocational assessment and training, crisis counseling, housing assistance and home management, emergency assistance, financial management and credit counseling, healthcare, parenting skills, interpersonal/social skills, time management, arranging transportation, and any other services/activity directly related to extended care for the foster/probation youth.
Eligible young adults participating in Extended Foster Care (EFC) can only participate in workshops and trainings, as they are not eligible for case management or other supportive services.
Lesbian, Gay, Bisexual, Transgender, or Questioning (LGBTQ): The group or community of individuals who self-identify as Lesbian, Gay, Bisexual, Transgender, or Questioning their sexual identity.
Master Lease Agreement: The THP-Plus Contractor leases apartments from a property manager and then sub-leases the units to young adult tenants. Property managers at privately owned apartment complexes will generally provide the master lease agreement for the THP-Plus Contractor to sign. The master lease agreement helps young adults who otherwise might not be accepted as tenants build a tenant history that will help them secure housing in the future. By master leasing apartments, the Contractor may be required to pay rent on the rental units if they are vacant between tenants. Also, as the master lease holder, maintenance requests generally come through the Contractor, and the Contractor is ultimately responsible for any damage to the unit.
Mentoring: In the THP-Plus program mentoring will include matching young adults with members of the community as well as nurturing established relationships.
Non-Minor Dependent (NMD): A current or former dependent child or ward of the juvenile court who satisfies all of the following criteria: has attained eighteen (18) years of age but is less than twenty-one (21) years of age; is in foster care under the responsibility of the County Welfare Department (e.g., CFS) or County Probation Department that entered into agreement pursuant to WIC Section 105531.1; and is participating in a transitional independent living case plan pursuant to Section 475(8) of the Federal Social Security Act (42 U.S.C. Sec. 675(9)), as contained in the Fostering Connections to Success and Increasing Adoptions Act of 2008 (Public Law 110-351), as described in Welfare and Institutions Code (WIC) 11400 (v) [Section 675(8)(B) of Title 42 of the United States Code under the Federal Social Security Act]. NMDs are eligible to attend ILP related classes, workshops, and training. Contractor will not provide case management and other support services for NMDs.
Non-Related Legal Guardian (NRLG): Individuals that are appointed by the juvenile or probate court to serve as the legal guardian for youth who have not attained the age of eighteen (18). A NRLG may be appointed regardless of parental agreement or consent. NRLGs are not related to the youth by birth or adoption. Youth who are provided care by a NRLG remain eligible for Extended Foster Care through the age of twenty-one
(21) and are eligible to attend ILP related classes, workshops, and training. Contractor will not provide case management and other support services for NRLGs.

Permanent Housing: In permanent housing the THP-Plus young adult participants receive a monthly rental subsidy and regular supportive services for the thirty-six (36) month program. At the conclusion of the program duration, the lease to the apartment is turned over to the young adult participant (if it isn’t already in the young adult’s name) and the THP-Plus young adult participant continues to live in the rental apartment.
The apartment remains their home and is no longer connected to the program.
Personally Identifiable Information: Information which can be used to distinguish or trace an individual’s identity, such as their name, social security number, address, etc., alone or when combined with other personal or identifying information which is linked or linkable to a specific individual.
Policies and Procedures Manual: The document that encases all of a Contractor’s decisions about supportive services, staffing, and other program considerations. This document directs how the program will be run on a day-to-day basis and how the Contractor will handle unforeseen circumstances. Important considerations when developing the policies and procedures including the following:
a. It is important to solicit input from former foster youth in the development of the program’s policies and procedures.
b. Clarify the roles and responsibilities of the Contractor, the young adult, and County agencies throughout the Policies and Procedures Manual.
c. Excerpts of the program policies and procedures will be required to document proof of compliance when obtaining certification from the County.
d. County officials may perform site visits to verify compliance, which may involve a review of the organization's policies and procedures.
Probation Department: County agency responsible for protecting the community through assessment, treatment, and control of adult and juvenile offenders by providing a range of effective services based on legal requirements and recognized professional standards.
Proposal: The offer to provide specific goods or services at specified prices and/or other conditions specified in the RFP.
Provider Plan: The document that informs the State as to what type of program the THP-Plus Contractor will offer, who it will serve, and what the cost will be. The Provider Plan is submitted to the County. An important part of the Provider Plan is the THP-Plus Estimated Cost per Month per Participant Budget, which will demonstrate to the County how the Contractor will use the THP-Plus funds. The Provider Plan should also include a condensed version of the Contractor’s Policies and Procedures Manual.
Purchasing Agent: The Director of the County Purchasing Department.
Remote (Scattered) Site: Independent housing where the Contractor’s staff do not live in the same building;
this may include apartments, single family dwellings or condominiums rented or leased by the THP-Plus provider in various locations, not necessarily near each other.
Request for Proposal (RFP): The request for an offer from Proposers interested in providing the identified services sought to be procured by the County. The RFP specifies the evaluation factors to be used and contains or incorporates by reference contractual terms and conditions applicable to the procurement.
Scattered Site: See Remote (Scattered) Site.
Services: The requested services described in this RFP.

Subcontractor: An individual, company, firm, corporation, partnership or other organization, not in the employment of or owned by Contractor who is performing services on behalf of Contractor under the Contract or under a separate contract with or on behalf of Contractor.
Transitional Age Youth (TAY) One-Stop Centers: Centers that are administered by the County Department of Behavioral Health and provide integrated mental health services to youth ages sixteen (16) to twenty-five (25), who exhibit mental and behavioral disabilities, are or were juvenile justice dependents or wards, and may be emancipating from foster care, group homes, the juvenile justice system, or county jail. TAY One- Stop Centers allow TAY to select and utilize services needed to maximize their individual potentials (e.g., Recovery, Wellness, and Resiliency Model) in the community and prepare for independent entry into the community.
Transition Funds: Incentive and savings money for young adults who are placed in the THP-Plus program at the time of transfer to a new proposer. The monies are one-time receipt and will be released to the young adult upon exit from the THP-Plus program.
Transitional Housing: Requires tenants to move when the thirty-six (36) month program is complete or at age twenty-five (25), whichever comes first (young adult must be working on their TILP). THP-Plus programs that elect transitional housing as their model are required to help young adults secure housing where the rent is no more than 30% of their income.
Transitional Housing Lease Type: Transitional housing may be owned by the THP-Plus Contractor, in which case the Contractor would lease the unit directly to the tenant. However, in most cases, the THP-Plus Contractor will enter a master lease agreement with a private property manager and sublease the units to young adult participants. The THP-Plus Contractor pays the full monthly rent to the property manager, and the young adult participants pay graduated monthly rent to the THP-Plus Contract. At the completion of the thirty-six (36) month program period, the young adult tenant vacates the unit, and the THP-Plus program subleases the unit to a new program young adult.
Transitional Housing Program-Plus (THP-Plus): A transitional housing placement opportunity for former foster and probation young adults ages eighteen (18) to twenty-five (25) years, who are aging out of the foster care and/or probation systems. The program provides affordable housing and comprehensive supportive services for up to thirty-six (36) months. The young adult is expected to be actively working on their TILP. The goal of THP-Plus is to help former foster/probation young adults make a successful transition from out-of-home placement to independent living.
Transitional Independent Living Plan (TILP): The document designed by the California Department of Social Services (CDSS) that outlines specific skills, education or training goals needed to facilitate a successful transition to adulthood, mutually agreed upon by eligible eighteen (18) to twenty-five (25) year old emancipated foster/probation youth and the County Welfare Department, Probation Department, or the Independent Living Coordinator. The document will include the specific tasks youth and other relevant parties will complete to achieve these goals, agreed upon timelines, outcomes, and identify all individuals responsible for assisting in completion of the plan. Contractors shall use the most recently revised version of the TILP upon issuance. The TILP is generally revised semi-annually.
Trauma-Informed Care: Organizations, programs, and services that are based on an understanding of the vulnerabilities or triggers of trauma survivors that traditional service delivery approaches may exacerbate, so that these services and programs can be more supportive and avoid re-traumatization. For more information, refer to the National Child Traumatic Stress Network at http://nctsn.org/.
Youth Villages LifeSet Program: Provides at-risk youth and young adults leaving the foster care, juvenile justice and mental health systems the intensive in-home support and guidance they need to make a successful transition to adulthood. Program success is defined as young adults maintaining stable and http://nctsn.org/

RFP No. 24-07
This will allow issuance of any necessary amendments or addendums to the RFP. It will also help prevent the opening of a defective RFP and exposure of Proposals upon which an award could not be made.
Protests based on any omission or error, or on the content of this RFP, may be disallowed if not submitted in writing to the attention of the RFP Contact, prior to the deadline for submission of questions identified in Section II or at least ten (10) calendar days before the Deadline for Proposals (whichever occurs last).
D. Incurred Costs
The County is not obligated to pay any costs incurred by Proposer in the preparation of a Proposal in response to this RFP. Proposers agree that all costs incurred in developing a Proposal are the Proposer’s responsibility.
E. Amendments/Addenda to RFP The County reserves the right to issue amendments or addendums to this RFP if the County considers that changes are necessary or additional information is needed. Additionally, the County may terminate this procurement process at any time.
Changes to a Proposal or withdrawal of a Proposal will only be allowed if a request is received prior to the Deadline for Proposals. No amendments or withdrawals will be accepted after the Deadline for Proposals.
F. Best Value Evaluation As established in this RFP, the County realizes that criteria other than price are important and will award Contract(s) based on the Proposal that best meets the needs of the County. The County seeks the optimal combination of quality, price, and various qualitative elements of the required Services that will provide the County the greatest or best value for its money.
G. Right of Rejection Offers must comply with all of the terms of the RFP, and all applicable local, state, and federal laws, codes, and regulations. The County may reject as nonresponsive any Proposal that does not comply with all of the material and substantial terms, conditions, and performance requirements of the RFP. Further, the County may reject a proposal from any entity that is a parent, affiliate, or subsidiary, or that is under common ownership, control, or management with any other entity submitting a Proposal in response to this RFP.
A Proposer may not qualify the Proposal nor restrict the rights of the County. If Proposer does so, the Proposal may be determined to be a nonresponsive counter offer and the Proposal may be rejected.
No Proposal shall be rejected, however, if it contains a minor irregularity, defect or variation. If the irregularity, defect or variation is considered by the County to be immaterial or inconsequential, the County may choose to accept the Proposal.
Minor irregularities may be waived by the Purchasing Agent when they are any of the following:
1. Do not affect responsiveness;
2. Are merely a matter of form or format;
3. Do not change the relative standing or otherwise prejudice other offers;
4. Do not change the meaning or scope of the RFP;
5. Are trivial, negligible, or immaterial in nature;
6. Do not reflect a material change in the work; or
7. Do not constitute a substantial reservation against a requirement or provision.
In such cases the Proposer will be notified of the deficiency in the Proposal and given an opportunity to correct the irregularity, defect or variation or the County may elect to waive the deficiency and accept the Proposal. The decision to provide a waiver shall in no way modify or compromise the overall purpose of the submittal, nor excuse the Proposer from compliance with all requirements if awarded a Contract.

This RFP does not commit the County to award a contract. The County reserves the right to reject any or all Proposals if it is in the best interest of the County to do so. The County also reserves the right to terminate this RFP process at any time.
H. Reserved
I. Clarification of Offers
In order to determine if a Proposal is reasonably susceptible for award, communications by the Facilitator for the evaluation panel are permitted with a Proposer to clarify uncertainties or eliminate confusion concerning the contents of a Proposal. Clarifications may not result in a material or substantive change to the Proposal. The evaluation by the panel may be adjusted as a result of a clarification under this section.
J. Public Records Act All Proposals and other material submitted become the property of the County and are subject to release according to the California Public Records Act (Government Code § 7920.000). All Proposal information, including cost information, will be held in confidence during the evaluation and negotiation process.
Thereafter, Proposals are subject to becoming a non-exempt public record.
If a Proposer believes that any portion of its Proposal is exempt from public disclosure, it must indicate the specific portions believed to be confidential and not subject to disclosure on Attachment I - Public Records Act Exemptions. The Proposer also must include a brief description that sets out the reasons for exemption from disclosure. Each stated exemption must include a citation to supporting legal authority, including statutory authority or case law, to support exemption from the Public Records Act. Requested exemptions that do not meet the requirements of this section will not be considered.
The County will use reasonable means to ensure that such information is safeguarded but will not be held liable for inadvertent disclosure of the information. Proposals marked “Confidential” in their entirety will not be honored, and the County might not deny public disclosure of any portion of Proposals so marked.
By submitting a Proposal with portions identified in Attachment I as “Confidential,” Proposer represents that it has a good faith belief that such portions are exempt from disclosure under the California Public Records Act. Proposer may be requested to obtain legal protection from disclosure should a Public Records Act request be received. In the event the County does not disclose the information marked “Confidential,” Proposer agrees to reimburse the County for, and to indemnify, defend (with counsel approved by County) and hold harmless the County, its officers, employees, agents, and volunteers from and against any and all claims, damages, losses, liabilities, suits, judgments, fines, penalties, costs and expenses, including without limitation, attorneys’ fees, expenses and court costs of any nature arising from or relating to the County’s non-disclosure of any such designated portions of a Proposal.
K. Employment of Former County Officials Information must be provided in Attachment G regarding former County Administrative Officials (as defined below) who are employed by or represent Proposer. The information provided must include a list of former County Administrative Officials who terminated County employment within the last five years and who are now officers, principals, partners, associates or members of Proposer and should also include the employment and/or representative capacity and the dates these individuals began employment with or representation of Proposer. For purposes of this section, “County Administrative Official” is defined as a member of the Board of Supervisors or such member’s staff, Chief Executive Officer or member of such officer’s staff, County department or group head, assistant department or group head, or any employee in the Exempt Group, Management Unit or Safety Management Unit.
Failure to provide this information may result in the Proposal being deemed non-responsive.

L. Iran Contracting Act of 2010 In accordance with Public Contract Code section 2204(a), the Proposer certifies upon submission that the Proposer signing the Proposal is not identified on a list created pursuant to subdivision (b) of Public Contract Code section 2203 (http://www.dgs.ca.gov/pd/Resources/PDLegislation.aspx) as a person (as defined in Public Contract Code section 2202(e)) engaging in investment activities in Iran described in subdivision (a) of Public Contract Code section 2202.5, or as a person described in subdivision (b) of Public Contract Code section 2202.5, as applicable.
Proposers are cautioned that making a false certification may subject the Proposer to civil penalties, termination of an existing contract, and ineligibility to bid on a contract for a period of three (3) years in accordance with Public Contract Code section 2205. Proposer agrees that signing the Proposal shall constitute signature of this Certification.
M. Disclosure of Criminal and Civil Proceedings The County reserves the right to request the information described herein from the Proposer selected for Contract award. Failure to provide the information may result in a disqualification from the selection process and no award of Contract to the Proposer. The County also reserves the right to obtain the requested information by way of a background check performed by an investigative firm. The selected Proposer may also be asked to provide information to clarify initial responses. Negative information provided or discovered may result in disqualification from the selection process and no award of Contract.
The selected Proposer may be asked whether the firm, or any of its partners, principals, members, associates or key employees (as that term is defined herein), within the last ten years, has been indicted on or had charges brought against it or them (if still pending) or convicted of any crime or offense arising directly or indirectly from the conduct of the firm’s business, or whether the firm, or any of it partners, principals, members, associates or key employees, has within the last ten years, been indicted on or had charges brought against it or them (if still pending) or convicted of any crime or offense involving financial misconduct or fraud. If the response is affirmative, the Proposer will be asked to describe any such indictments or charges (and the status thereof), convictions and the surrounding circumstances in detail.
In addition, the selected Proposer may also be asked to disclose whether the firm, or any of its partners, principals, members, associates or key employees, within the last ten years, has been the subject of legal proceedings as defined herein arising directly from the provision of services by the firm or those individuals. “Legal proceedings” means any civil actions filed in a court of competent jurisdiction, or any matters filed by an administrative or regulatory body with jurisdiction over the firm or the individuals. If the response is affirmative, the Proposer will be asked to describe any such legal proceedings (and the status and disposition thereof) and the surrounding circumstances in detail.
For purposes of this provision “key employees” includes any individuals providing direct service to the County. “Key employees” do not include clerical personnel providing service at the firm’s offices or locations.

(See Attachment D and the following United States General Services Administration’s System for Award Management website https://www.sam.gov). Proposer also certifies in Attachment D that if it or any of the subcontractors listed in the Proposal are business entities that must be registered with the California Secretary of State, they are registered and in good standing with the Secretary of State.
