About this file

The City of Kentwood, Michigan has issued a Request for Proposals (RFP) No. 25-016-536 for Fire Hydrant Commercial Blast and Painting services. The project seeks qualified contractors to commercially blast and paint approximately 200-250 fire hydrants per year within the city's six-square-mile water district, which serves Kentwood and Wyoming. In the first year, 218 hydrants on major streets will be painted, followed by 200 hydrants on local streets in subsequent years. The RFP is structured for a one-year initial contract with options to extend for four additional one-year terms. Proposals are due on Wednesday, July 9, 2025, at 10:00 AM (EDT), with the city anticipating contract award at the City Commission meeting on August 11, 2025, and work to commence shortly thereafter.

The contract will be awarded on a unit price basis, with bidders required to provide pricing for hydrant painting in each of the five potential contract years. Contractors must follow specific technical specifications, including using Tnemec Series paint (Safety Yellow for hydrant barrels, tops, caps, and chains) and adhering to Steel Structure Painting Council (SSPC) standards. The project requires contractors to provide their own vehicles, staff, and equipment, with no subcontractors allowed. Each hydrant will be thoroughly prepared through blast cleaning, primed, painted, and finished with a clear coat. The city will pay a unit price per hydrant painted, with priority given to contractors who maintain consistent pricing throughout the contract term. Contractors must also provide proof of insurance, references, and comply with detailed procedural and safety requirements.

Contractor's obligation of indemnity shall not be limited or extinguished by the availability of insurance coverage for the Indem-nified Losses, it being the intention of the parties that: (1) Contractor will indemnify the City to the broadest extent possible; and (2) the City need not seek coverage for Indemni-fied Losses under any insurance policy or self-insurance that the City maintains. Further, nothing in this Section shall be construed to limit or extinguish the Contractor's obligation to maintain insurance as provided in this Contract. The Contractor's obligations pursuant to this Sec-tion shall survive any expiration or termination of this Contract.

20. The City may elect to add or remove from the Scope of Work as envisioned in this RFP, or choose not to proceed with any Work, as deemed in the best interest of the City.

21. Termination – Default by Contractor: If Contractor commits any of the acts specified in this Section, the City may, by giving 30 days’ notice in writing thereof to Contractor, with-out prejudice to any other rights or remedies given the City by law or by this Contract, ter-minate the services of Contractor under this Contract and complete the Work for the Project by whatever method the City may deem expedient. 22.5. Persistently disregard any law or ordinance relating to the Work or the comple-tion thereof;

22.6. Fail to maintain in force and effect the insurances called for herein; or

22.7. Otherwise, commit a material or substantial violation of any provision of this

Contract.

Should the Contract be terminated as a result of the Contractor’s default for reason(s) speci-fied in this Section, the City shall be entitled to complete the Work, and the Contractor shall not receive any further payment pending the satisfactory completion of the Work. If the ex-penses incurred by the City in completing the Work, including any compensation paid by the City for managerial, administrative, or supervisor services in completing the Work, ex-ceed the unpaid balance of the Contract Sum, then such excess shall be promptly paid by the Contractor to the City.

22. Default by the City: Extension of time shall be Contractor’s sole remedy for any delay un-less the same shall have been caused by acts constituting intentional interference by the City with Contractor’s performance of the Work, where such acts continue after Contrac-tor’s written notice to the City of such interference. Amendments: No action, conduct, omission, prior failure, or course of dealing by the City shall act to waive, modify, change, or alter the requirement that Change Orders must be in writing and signed as provided herein. Such Change Orders are the exclusive methods for effecting any change to the scope of the Work. Contractor understands and agrees that the Contract Amount, the terms and conditions of the Contract, and/or the term of the Contract, as provided in Item 5. (page 6 of this RFP), cannot be changed by implication, oral agree-ments, actions, inactions, course of conduct, or Change Order, but only through a written Amendment to the Contract. Only the Mayor of the City of Kentwood and/or their designee and/or appointed successor is authorized to execute any Amendment to the Contract on be-half of the City.

25. Governing Law and Remedies: Any contract to result from this RFP shall be executed and delivered and is intended to be performed in the State of Michigan and shall be con-strued and enforced in accordance with, and the rights of the parties shall be governed by, the laws of the State of Michigan. The parties agree that the sole jurisdiction and venue for any action brought pursuant to or to enforce this agreement shall be in the state courts in Kent County, Michigan and the prevailing party in any such action shall, in addition to any other remedies to which that party is entitled at law or in equity, be entitled to recover its

26. Attorney Fees: The defaulting party must pay the non-defaulting parties’ fees, costs, and expenses, including reasonable attorney’s fees, for enforcement of the Contract through ap-peals and collection.

27. Waiver: The failure of either party to insist, in any one or more instances, on the perfor-mance of any of the terms, covenants or conditions of the Contract, or to exercise any of its rights, shall not be construed as a waiver or relinquishment of such term, covenant, condi-tion or right with respect to further performance.

28. Severability: It is the intent of the parties to the Contract that the Contract be enforceable to the fullest extent permitted by law. If, however, any provision or portion thereof of the Contract is held to be invalid or unenforceable by a competent authority having the appro-priate jurisdiction, the balance of the Contract and/or the surviving portion(s) of any provi-sions hereof will remain binding and enforceable in accordance with its terms and condi-tions and any provision held invalid or unenforceable will immediately be revised and amended to the minimum extent necessary in order for it to be valid and legally enforcea-ble, consistent with the original intent of the Contract.

29. Mutually Drafted: The parties to the Contract expressly agree that the Contract was jointly drafted, and that both had the opportunity to negotiate its terms and to obtain the assistance of counsel in reviewing its terms prior to execution. Therefore, the Contract shall be con-structed neither against nor in favor of either party but shall be construed in a neutral man-ner.
