About this file

The document is a Request for Proposal (RFP) from the New Hampshire Department of Corrections (NHDOC) for Prison Rape Elimination Act (PREA) Audit Services. The RFP seeks a United States Department of Justice certified PREA Auditor to conduct comprehensive audits of multiple correctional facilities across New Hampshire from April 1, 2026, through March 31, 2029, with the potential for a one-time three-year contract extension. The audit schedule is structured over three years, targeting specific facilities each year: Year 1 includes Northern NH Correctional Facility, Concord Transitional Work Center, and Calumet House; Year 2 focuses on NH State Prison for Men and North End Transitional Housing Unit; and Year 3 covers NH Correctional Facility for Women and Shea Farm Transitional Housing Unit.

The cost proposal requires bidders to provide pricing for each facility's audit, with an option to separately identify costs for any potential Corrective Action Plan (CAP) periods. The audits must follow strict PREA standards, including conducting facility tours, reviewing documentation, interviewing staff and inmates, and submitting a comprehensive audit report within 30 days of completion. The contract includes provisions for detailed reporting, potential facility additions or removals, and specific requirements for auditor qualifications, such as having at least three years of auditing experience, a bachelor's degree, and passing a criminal background check. The total contract value will be determined by the sum of individual facility audit costs across the three-year period.

SECTION B: Description of Agency/Division/Program

NHDOC is an executive agency of the State of New Hampshire charged with overseeing the State’s correctional facilities supervising inmates, patients and probation and parolees by providing a safe, secure and humane correctional system through a continuum of services that promotes successful re-entry into society for the safety of our citizens and in support of crime victims.

SECTION C: Scope of Services

1. PREA Auditing Services:

The Prison Rape Elimination Act (PREA) is a federal law enacted in 2003 and was created to eliminate sexual abuse while in confinement. Federal funds were provided for research, programs, training and technical assistance to address sexual abuse.

In addition, the legislation mandated the development of national standards. The National Prison Rape

Elimination Commission (NPREC) developed recommended national standards for reducing prison rape. The final standards became effective on June 20, 2012, when they were published by the US

Department of Justice (USDOJ). PREA standards were developed to help confinement facilities prevent, detect and respond to sexual abuse and harassment of inmates and are intended to:

• Assist agencies in establishing a zero-tolerance policy of inmate sexual abuse or harassment;

• Increase accountability for sexual safety of those in contact with inmates; and

• Afford agencies discretion and flexibility, to the extent feasible, in a way that meets the standards.

The final PREA Standards include provisions that are specific to Audit and State Compliance: (1)

Prison Rape Elimination Act National Standard 115.93 indicates that the agency shall conduct audits pursuant to Standard 115.401 (2) Standard 115.401 indicates that the frequency and scope of audits are as follows:
