About this file
This is a Questions and Answers document issued by the Colorado Department of Education (CDE) in response to offeror inquiries regarding RFP-DAA-2016000062 for Grade 10 and College Entrance Exams assessment services. The RFP solicits comprehensive assessment services including test development, manufacturing, packaging, scoring, data analysis, and reporting for statewide standardized exams. Key clarifications address subcontractor definitions, requiring any contractors responsible for critical aspects of assessment delivery to be formally designated as subcontractors. The document specifies data file requirements, including student enrollment data layouts with detailed field specifications for district/school codes, student identifying information, demographic data, disability status, English learner proficiency levels, and continuity enrollment indicators. The CDE requires both 24/7 access for security monitoring and annual audit rights for confidential information protection. Offerors must propose solutions for scoring procedures, including hand-scoring percentages and any automated or AI-based scoring methodologies, which must be research-based and demonstrate reliability across student subgroups including English learners, students with disabilities, and minorities. The state will not reimburse contractor travel costs for meetings or trainings, with all such expenses to be incorporated into the proposal cost response.
Pricing proposals must be submitted on flash drives with specific formatting requirements, including 25 drives containing narrative and confidential materials, 15 drives with cost proposals, and 2 contract negotiation material drives. Liquidated damages for deliverable non-performance will be determined during contract negotiation and will not exceed 10 percent of contract value, except for deliverables affecting assessment administration dates or individual student report delivery. Online testing may be proposed as a cost option with associated negative cost impacts on the total program price, though the base proposal must address paper-based testing. The document includes a comprehensive sample enrollment file layout specifying data field requirements, valid values, and formatting standards for student information submission through CDE's Data Pipeline system. No service-disabled veteran-owned small business participation is required. Offerors may propose alternative personnel structures and management arrangements to meet Colorado's needs, with flexibility in role titles and organizational approach.

IV. Definitions, subcontractor; E. subcontracts
We maintain long-term business partnerships with organizations that support operational services and capabilities across all national assessments and are not specific to state and specific contract. Can CDE confirm that these operational partners are not considered subcontractors?
Answer: No. There is insufficient information to determine the meaning of “long term business partnerships with organizations that support operational services and capabilities across all national assessments and are not specific to state and specific contract” to confirm that “operational partners” are not subcontractors. If these partners are responsible for the developing, manufacturing, packaging/receiving, scoring, analyzing, reporting, etc. the assessments to be delivered under the proposal, they should be considered a subcontractor. Any contractor that will need to be utilized in the completion of critical aspects of the Colorado contract should be considered a subcontractor.

Answer: 3 days
4.
22
and 1.WW Binding Offer and 4.D.1 Additional Response Requirements If an Offeror affirms its acceptance of the terms and requirements of the RFP under the provisions of 1.WW, will its exceptions to legal terms and conditions (and other provisions) still be considered? These provisions appear to be in conflict with 4.D.1, which directs bidders to identify any term and condition they are questioning and provide alternative language with their proposals.
Answer: Yes, exceptions to legal terms and conditions in the Master Contract will be considered. See also answer to question 24 below.
5.
18
and 1.TT.4 Protection and Exhibit 1 Master Contract The language of the RFP conflicts with the Audit provision of the Master Contract. Will CDE require 24/7 access to inspect and monitor access and use of Confidential Information and physical and logical security control effectiveness (page 18) or annual audit rights? (Master Contract, page 32)
Answer: CDE requires both.

3.1.8 Travel
and 3.3.2.d Project Meetings Section 3.1.8 states that “Awarded Offeror may be required to travel to various statewide locations to meet project requirements/training. All anticipated travel expenses are to be included in the Offeror’s component cost response. Therefore, the total price quoted for this project should include any travel, lodging or per diem costs to be incurred by Offeror’s personnel to provide services requested.” Section 3.3.2.d indicates that “the state shall bear no cost for the time and travel of the Contractor for attendance at any meeting.” Does this mean that the State will accept costs for trainings but not for meetings? What if the two are combined, such as the DAC meeting?
Answer: The state will not bear costs for travel of contractor personnel to any trainings or meetings. The contractor will be responsible for travel costs of its personnel to all trainings and meetings.

Please clarify extent to which vendors should describe their online testing system, online testing processes, and online testing experience. Additionally, please provide guidance on locating this information within the proposal and any applicable page limits.
Answer: The RFP requires information to be presented for paper testing in the narrative and for base costing. Do not include information regarding online testing in the narrative. At the time of contract award (or renewal), if it is in the state’s best interest to allow for additional modes of testing, evidence supporting the readiness and appropriateness of the Offeror’s system will be reviewed.
20.
82
4.D Additional Response Requirements
Please confirm that Attachments 3-9 need not be submitted at this time. Additionally, please provide any appropriate guidance on placing completed Attachments, Exhibits, and other documents within the proposal; for example, does the State prefer that such documents are presented in the order they appear in the RFP or may the Offeror group related documents?
Answer: Attachments 3-9 are required to be submitted with the proposals by noon on December 4th. They may be arranged in the order that will best facilitate the review of the proposal. Attachments 8 and 9 must be submitted according to the instructions in Section 4E of the RFP.

22
146
Attachment 10 Cost Sheet
May online testing be proposed as a cost savings option? If yes, may the Offeror include a negative dollar amount at the end of the cost sheet to indicate that it is an option and to illustrate its impact on program price?
Answer: The RFP requires information to be presented for paper testing in the narrative and for base costing. Do not include information regarding online testing in the narrative. Online testing may be presented as a cost option on the cost sheet with a negative cost associated with it.
23.
Throughout
Terminology
Throughout the proposal CDE mentions program manager, project manager, program coordinator, and program assistant. Does CDE envision four different individuals serving in these roles or are some terms used interchangeably? If four people are expected to be named, can CDE further distinguish the roles?
Answer: Offerors are to propose a solution, including personnel plan, to meet Colorado’s needs. There is flexibility in how the Offeror proposes to meets its management responsibilities. Roles and titles tend to vary by organization. The following definitions can be considered when responding to the RFP:
· Program Manager – ultimately responsible and accountable for the ongoing program as a whole
· Project Manager – oversees specific aspects of the program that are of shorter duration than the program as a whole (ex. math development if required for augmentation)
· Program Coordinator - varies depending on the organization. Could be responsible for arranging all meetings and trainings and maintenance of program documentation
· Program Assistant – provides administrative support for the program
24.
Multiple
Exceptions to terms and conditions
There are a number of contradicting provisions regarding whether exceptions are permitted, including those cited in the question above. Will the State consider exceptions to the RFP terms, as well as the legal terms and conditions in the Master Contract?
Answer: Only exceptions will be to legal terms and conditions in the Master Contract.
