2 DESCRIPTION OF SERVICES/COMMODITIES

2.1 Overview & Project Description

The City of Madison is soliciting proposals from qualified firms to provide an assessment regarding the feasibility of building of an anaerobic digester facility capable of processing the region’s organic wastes.

The primary waste stream for this facility will be source separated food wastes from households, restaurants, grocery stores, and food production facilities. The size of the facility will be able to process an initial capacity of 20,000 tons of organic wastes a year with an ability to expand processing capability to 40,000 tons.

The assessment will include an analysis of the financial value of the biogas produced from an organic wastes anaerobic biodigester if the gas is transported to the Dane County Rodefeld Landfill for injection into the TransCanada interstate pipeline. The assessment will also include an analysis of the financial value of the solids produced by this same digester.

The assessment will include anaerobic digester facility design recommendations, including capital costs, that would best fit the source separated organic wastes input, including pre-processing options to create a clean feedstock whereby the digestate byproduct would be suitable for composting. The assessment will also assess potential locations at or near the Rodefeld Landfill campus where a digester facility could be sited. And include a 10 and 20 year pro forma operating budget for the facility.

The selected Consultant is expected to work closely with City staff as part of the project team to successfully complete this study.

2.2 Project Background

Recycling in Madison began in 1968 with bundles of newspapers collected at the curb. For these past fifty years, Madison has remained committed to diverting wastes from the landfills in ways that are both economically sound and environmentally beneficial.

Food wastes make up the largest fraction of the solid waste sent to the landfill by the City of Madison. In order to reach to reach zero waste and renewable energy goals, and uphold the recycling tradition of Madison, it is important to find a way to keep food wastes from the landfill.

Since 2005, the City of Madison has actively researched anaerobic biodigestion. From 2011 to 2018, the Streets Division operated a source-separated organics pilot collection program to collect food wastes from homes and restaurants within certain areas of the city. In 2019, plans are to perform a second short-term pilot of food scraps collection in order to test lessons learned during the earlier long term pilot. In 2012, Organic Waste Systems completed a feasibility study that included benchtop testing of the City’s potential organic waste feedstock. And later a financial analysis of a digester was performed by Baker Tilly. While the previous studies were valuable , they assumed the digester would be solely for the City of Madison and assumed electricity generation as the use of the biogas.

2.3 Project Deliverables

The consultant will be expected to produce a study that will assess and make recommendations on the below categories:

Anaerobic Digester Facility Recommendations A comprehensive equipment assessment will be completed to recommend the appropriate anaerobic biodigestion technology and pre-processing equipment that will capture biogas generated by source-separated organics waste feedstock and create a digestate clean enough to be appropriate for composting.

RFP 8819.doc Page 8

The recommendations should include the ability to compress and clean the captured biogas so it can be injected into the TransCanada natural gas pipeline via the renewable natural gas facility located at the Dane County Rodefeld Landfill.

The facility recommendations should also consider a tipping floor area so that vehicles collecting the source-separated organics wastes would have the ability to dump at this facility so the material can be processed.

The recommendations will also include start-up and operations costs of the facility. This will include a 10 and 20 year pro forma operating budget.

The recommendations will include location options located at or near the Dane County Rodefeld Landfill site.

The facility will process at minimum 20,000 tons of source-separated food scraps a year with the ability to be scaled up to 40,000 tons a year.

Biogas & Compost Financial Analysis Analysis of the economic value of the biogas generated by the anaerobic biodigester facility if the gas is injected into the TransCanada pipeline via the injection point located at the Dane County Rodefeld Landfill campus.

An analysis of the volume and value of the digestate if used as compost that will be produced following the anaerobic digestion process of the facility.

Feedstock Analysis A comprehensive survey to estimate the available source-separated feedstock available in Dane County from sources that include but are not limited to municipal waste haulers, private waste haulers, food production facilities, and groceries.

2.4 Final Study Production

The final study, including its various parts and notes, shall be submitted electronically in a format agreed to by the City of Madison. A minimum of ten color hard copies of the final study shall also be provided.

All work material generated, including by not limited to data analysis, photographs, illustrations, will be the sole property of the City of Madison for use as deemed appropriate.

Project Schedule and Progress Reports The project must be completed within one year from the award of the contract.

Quarterly reports on progress will be submitted to the City of Madison to track progress and ensure project will be delivered on time.

Monthly check-ins phone meetings on progress will be held to ensure progress on the project continues.

2.5 Cost Proposal

Submit fee and expense schedule necessary to accomplish the project deliverables. The fee submittal shall address:

1) A not-to-exceed cost to provide the project deliverables for this study

2) An itemized cost breakdown for each task and deliverable

3) Hourly rate schedule by personnel and the proposed number of hours budgeted for each member of the project team

RFP 8819.doc Page 9

4) Include the respective percentage of sub-consultants involvement, if any, in each phase of the work

5) Direct and indirect costs in itemized detail

6) Costs proposed shall be included of all costs related to completing the project, including but not limited to preparation, travel, transportation, communication, reproduction, labor, overhead, profit, etc.

7) Respondents shall indicate any additional work outside the scope of work identified in this RFP that it believes is needed and the cost of such work

The feasibility study described within the RFP will be funded through an EPA grant of $39,000. Cost proposals shall not exceed this amount.

City of Madison staff will be available to complete outreach and research in service of this project so the final study as outlined above can be delivered by the selected respondent within the timeframe allotted.

Within the cost proposals, if City of Madison staff time is required, indicate which tasks within the deliverables would be required by City staff to complete in order to meet the $39,000 overall budget.

The words "bid" and "proposal" are synonymous, as are the words "bidder," "proposer" and "contractor." The phrases "request for proposal," "invitation for bids," "request," "invitation," and "solicitation" shall also be synonymous.

As applied to the winning or selected bidder, the words "bid," "proposal," and "contract" are synonymous.

2. Entire Agreement, Order of Precedence. These standard terms and conditions shall apply to any Purchase Order issued as a result of this Request for Bid/Proposal, except where expressly stated otherwise in the RFP or in a written instrument covering this purchase signed by an authorized representative of the City and the Contractor, in a form approved by the City Attorney (a “Separate Contract”). If such a separate contract is executed it shall constitute the entire agreement and no other terms and conditions, whether oral or written, shall be effective or binding unless expressly agreed to in writing by the City.

If a Separate Contract is not executed, these Standard Terms and Conditions, the City’s request for proposals, the version of the vendor’s bid that was accepted by the City, and the City’s Purchase Order (if any) shall constitute a contract and will be the entire agreement.

Order of Precedence: If there is a conflict between this Section A and any terms in the vendor’s accepted bid or proposal, this Section A shall control unless the parties expressly agree to another order of precedence, in writing. If there is a conflict between this Section A and a Separate Contract, the terms and conditions of the Separate Contract shall control.

I. TERMS FOR SUBMISSION OF BIDS: The following section applies to the bid/selection process only.

3. This invitation for bids does not commit the City to award a contract, pay any costs incurred in preparation of bids, or to procure or contract for services or equipment. The City may require the bidder to participate in negotiation and to submit such additional price or technical or other revisions to his or her bids as may result from negotiation. The bidder shall be responsible for all costs incurred as part of his or her participation in the pre-award process.

The City reserves the right to accept or reject any or all bids submitted, in whole or in part, and to waive any informalities or technicalities which at the City’s discretion are determined to be in the best interests of the City. Further, the City makes no representations that a contract will be awarded to any offeror responding to this request. The City expressly reserves the right to reject any and all bids responding to this invitation without indicating any reasons for such rejections(s).

The City reserves the right to postpone due dates and openings for its own convenience and to withdraw this solicitation at any time without prior notice.

Any price increase proposed shall be submitted sixty (60) calendar days prior to subsequent contract periods and shall be limited to fully documented cost increases to the bidder which are demonstrated to be industry-wide.
