About this file

This is a Statement of Work (Schedule A) for RFP 260000002393, issued by the State of Michigan for forestry management services at the MPSCS Tower Site in Stanton. The project involves the removal of designated trees and clear cutting of identified vegetation within defined project boundaries to support site development, ensure environmental and structural safety, and maintain compliance with applicable state and local regulations. The scope of work includes removing all trees within the fall radius (minimum 60 feet) of utility wires, guy wires, compound fencing, structures, and driveways; removing all trees and thick underbrush north of the shelter compound; removing dead trees cut to ground level with stump grinding; chipping all wood and debris; and leaving the site in a condition suitable for mowing upon completion. The project requires use of tracked feller buncher equipment and a dedicated mulcher. Bidders must submit before and after photographs of similar telecommunication site projects completed with guy anchors, along with a comprehensive project plan within 30 calendar days of contract award. All contract activities must be completed within 45 business days from receipt of order. The contractor must attend a preproposal meeting and project kickoff meeting, and final approval requires an on-site walkthrough with MPSCS Tower and Site Services team members.

Pricing is firm for the entire length of the contract, with price adjustments based on documented changes in actual contractor costs following a 30-day review and negotiation period by both parties. The contractor must appoint one Program Manager and at least one crew lead as key personnel, both of whom must be on-site during work and available for state inquiries within 24 hours. The state reserves approval rights over key personnel assignments and may require a 30-calendar day training period for replacement personnel. Unauthorized removal of key personnel without prior written state consent may result in $1,000 per individual credits and potential contract termination for cause. Invoices must be submitted via email to the program manager and payment will be made by electronic funds transfer. The contractor must supply all required equipment, provide time-elapsed photographs throughout the project, maintain data retention and retrieval capabilities for all project photographs, and is subject to liquidated damages of $5,000 plus $100 per day for late or improper completion. The contractor must disclose any subcontractors, including their legal business names, addresses, telephone numbers, descriptions of services, pricing, and prior working relationships.

RFP 260000002393

MPSCS Tower Site Forestry Management This schedule identifies the anticipated requirements of any Contract resulting from this RFP. The term “Contractor” in this document refers to a bidder responding to this RFP, as well as the Contractor who is awarded the contract. The term “bidder” is used to identify where specific responses to the RFP are required. Yellow fields are also used to identify areas where a bidder response is required.

The Contractor must respond to each requirement or question and explain how it will fulfill each requirement. Attach any supplemental information and reference it appropriately within your response.

Background This project involves the removal of designated trees and the clear cutting of identified vegetation within the defined project boundaries. The purpose of this work is to support planned site development, ensure environmental and structural safety, and maintain compliance with applicable state and local regulations. All tree removal and clearing activities will be conducted in a controlled, responsible manner that prioritizes worker safety, minimizes disruption to surrounding areas, and protects adjacent natural resources.

Prior to the start of work, the project area will be reviewed to confirm tree markings, verify protection zones, and identify any environmentally sensitive areas requiring avoidance or mitigation. Only the trees and vegetation explicitly approved for removal will be cleared. All debris will be handled, transported, and disposed of in accordance with regulatory requirements and established project procedures.

Erosion control and site‑stabilization measures will be installed and maintained throughout the duration of the work to reduce environmental impact. Upon completion of clearing operations, the site will be inspected to ensure that all work has been carried out according to project specifications and applicable standards.

Scope Removed designated trees:

· Removing all trees within fall radius (no less than 60 feet from center of object) of utility wires, guy wires, compound fence, compound, shelter, driveway

· Remove all trees and thick underbrush north of the shelter compound between shelter and the soybean field

· Use tracked feller buncher- to prepare for hollow diseased ash trees.

Emerald Ash Borer are invasive wood-boring beetles that are feeding on the inner bark of the tree cutting off the tree’s water and nutrient transport which will inevitably cause tree mortality

· Extreme Caution to remove trees without damaging the compound Vendor is responsible to any damage to site

· Obtain adequate fall distance

· Conduct a site‑specific hazard assessment prior to beginning work, identifying overhead utilities, unstable trees, steep terrain, traffic exposure, restricted access points, and any other elevated risks

· Dedicated mulcher to mulch up the field

· The site must be left in a condition suitable for mowing upon completion of work

Mandatory Minimums

· Vendor is required to supply all required equipment to complete the job

· Removing all dead trees cut to the ground level, stump grind the stump, chip all wood and debris and disposed of in the area that is not getting cut, to ensure the site is left in a condition suitable for mowing upon completion of work:

· Chipping to ensure no dry debris to catch fire

· Chipping to ensure all logs have been disposed of

· Site walk with MPSCS Tower and Site Services team members

· Final Scope of work will be determined at project kickoff

· Safety plan and steps

· Ensure company is aware of property lines

General Requirements

Requirement 1 See Mandatory Minimums Samples Bidder needs to supply before and after photographs of a telecommunication site with guy anchors where a similar project has been completed Bidder must submit samples that match the proposed Contract Activities by the proposal deadline. Each sample must be clearly labeled with your name and the RFP number, and provided with the proposal as an attachment via SIGMA.

Quality Assurance Program Final approval or walk through with MPSCS Tower and Site Services team member must be completed with bidder

Bidder Response

Project Plan This site has large mature trees. There are multiple dead trees near striking distance of guy wires/compound, some even nearly touch guy wires, extreme caution must be taken to remove these high-risk trees without damaging the compound. Tracked feller buncher with leveling cab is required for safe completion of site. Trees are mainly black cherry with some ash. The trees are mature, and we may need to go past 60 feet to obtain adequate fall distance. There is thick under brush and will require a dedicated mulcher to complete this site. Schedule A – Attachment 1 – Key Personnel

1. Key Personnel The Contractor must appoint one (1) Program Manager and at least one (1) crew lead who will be directly responsible for the day-to-day operations of the Contract (“Key Personnel”). Key Personnel must be specifically assigned to the State account, be knowledgeable on the contractual requirements, and respond to State inquiries within 24 hours.

Contractor’s Key Personnel must be on-site at assigned locations while work is being performed.

The State has the right to recommend and approve in writing the initial assignment, as well as any proposed reassignment or replacement, of any Key Personnel. Before assigning an individual to any Key Personnel position, Contractor will notify the State of the proposed assignment, introduce the individual to the State’s Project Manager, and provide the State with a resume and any other information about the individual reasonably requested by the State. The State reserves the right to interview the individual before granting written approval. In the event the State finds a proposed individual unacceptable, the State will provide a written explanation including reasonable detail outlining the reasons for the rejection. The State may require a 30-calendar day training period for replacement personnel.

Contractor will not remove any Key Personnel from their assigned roles on this Contract without the prior written consent of the State. The Contractor’s removal of Key Personnel without the prior written consent of the State is an unauthorized removal (“Unauthorized Removal”). An Unauthorized Removal does not include replacing Key Personnel for reasons beyond the reasonable control of Contractor, including illness, disability, leave of absence, personal emergency circumstances, resignation, or for cause termination of the Key Personnel’s employment. Any Unauthorized Removal may be considered by the State to be a material breach of this Contract, in respect of which the State may elect to terminate this Contract for cause under the Termination for Cause section of the Standard Contract Terms. It is further acknowledged that an Unauthorized Removal will interfere with the timely and proper completion of this Contract, to the loss and damage of the State, and that it would be impracticable and extremely difficult to fix the actual damage sustained by the State as a result of any Unauthorized Removal. Therefore, Contractor and the State agree that in the case of any Unauthorized Removal in respect of which the State does not elect to exercise its rights under Termination for Cause, Contractor will issue to the State the corresponding credits set forth below (each, an “Unauthorized Removal Credit”):

For the Unauthorized Removal of any Key Personnel designated in the applicable Statement of Work, the credit amount will be$1,000.00 per individual if Contractor identifies a replacement approved by the State and assigns the replacement to shadow the Key Personnel who is leaving for a period of at least 30-calendar days before the Key Personnel’s removal.

Contractor acknowledges and agrees that each of the Unauthorized Removal Credits assessed above: (i) is a reasonable estimate of and compensation for the anticipated or actual harm to the State that may arise from the Unauthorized Removal, which would be impossible or very difficult to accurately estimate; and (ii) may, at the State’s option, be credited or set off against any fees or other charges payable to Contractor under this Contract.

The Contractor must identify the Key Personnel, indicate where they will be physically located, describe the functions they will perform, and provide current chronological résumés.

The Contractor must identify all Key Personnel that will be assigned to this contract and include the following:
