About this file
This is a Confidential Treatment Form for RFP 260000000882 issued by the State of Michigan through Michigan.gov/MiProcurement for advertising services with the Michigan State Lottery (MSL). The form serves as a mandatory submission requirement with all proposals, regardless of whether confidential information is included. Bidders must complete either Section 1, indicating no confidential treatment is requested, or Section 2, indicating that confidential treatment is requested for specific materials. All forms must be signed and dated by the individual who signed the bidder's proposal and submitted with the bid package.
Section 2 of the form requires bidders requesting confidential treatment to specifically identify protected information by proposal page number, section number, and paragraph number, designate the material type as Trade Secret (TS), Proprietary Financial Information (FI), or Proprietary Information (PI), and provide detailed written justification citing applicable FOIA exemptions under MCL 18.1261 or relevant case law. Bidders are explicitly prohibited from requesting confidential treatment for resumes, pricing, and marketing materials. Bidders must also submit a redacted "Public Copy" of their proposal with all confidential information removed and clearly labeled. The State reserves the right to determine whether designated materials qualify for confidential treatment and retains final authority over disclosure decisions in response to FOIA requests, with no obligation to notify bidders of requests or public release decisions. Failure to submit a completed CT Form or improper completion may result in rejection of the proposal as non-responsive or full public disclosure without redaction following an award recommendation.
