About this file
This is an Exhibit B Method of Compensation document from the Florida Department of Transportation (FDOT), District Six, detailing compensation terms for cultural resource assessment surveys and NEPA compliance services in Miami-Dade and Monroe Counties. The contract operates as a term contract for indefinite quantity services, with work assigned on an as-needed basis through Letters of Authorization (LOA) issued by the Department's Project Manager, specifically the District Cultural Resources Coordinator. Services are initiated and completed as directed by the Project Manager, with the contract term running from January 2026 through January 2031 and potential renewal options available. The total maximum contract amount is listed as "TBA" (To Be Announced), with currently approved funding also marked as "TBA"; the Department will provide written authorization when subsequent funding is approved and encumbered. Execution of the agreement does not guarantee work authorization.
Compensation is structured through hourly billing rates established in Exhibit C for various labor classifications, with progress payments made upon satisfactory completion and Department approval of deliverables. For each LOA, the vendor must prepare work estimates based on contract rates and authorized expenses; once the Department's Project Manager approves a maximum limiting amount or lump sum amount, the LOA is issued. Labor costs are billed on a portal-to-portal basis with no payment for personnel or equipment mobilized or demobilized outside District Six. All work authorized by FDOT District Six is paid as local work. Monthly invoices (three copies) must itemize actual man-hours and allowable costs incurred, submitted to Victoria Vogt, M.S., FCCM at the Planning and Environmental Management Office in Miami. Non-contract items and additional equipment must receive written Project Manager approval prior to expenditure, with vendors required to obtain three competitive quotes and use the lowest quote. Tangible personal property purchased under the contract transfers to FDOT upon completion of services or contract end, whichever occurs first.

EXHIBIT "B"
METHOD OF COMPENSATION
1.0 PURPOSE:
This Exhibit defines the limits and method of compensation to be made to the Vendor for services set forth in Exhibit “A”, Scope of Services, and the method by which payments shall be made.
2.0 ASSIGNMENT OF WORK:
The DEPARTMENT shall request Vendor services on an as-needed basis. Services to be provided on each project will be initiated and completed as directed by the Department’s Project Manager (the District Cultural Resources Coordinator). The Department’s Project Manager may issue a notice of available funds/funds authorization, followed by the issuance of a work authorization/Letter of Authorization" (LOA), for the assignment of work. The process for the assignment of work is described below.
3.0 COMPENSATION:
For the satisfactory performance of services detailed in Exhibit “A”, Scope of Services, the Vendor shall be paid up to a Maximum Amount of $ TBA. It is agreed that this amount will be the limit of all compensation due the Vendor for performance of the services described in Exhibit “A”. The Vendor shall not provide services that exceed the maximum amount without an approved Amendment from the Department.
The total Maximum Amount of this agreement is expected to be funded by multiple appropriations and the State of Florida’s performance and obligation to pay under this contract is contingent upon annual appropriation by the Legislature.
Currently $ TBA, of the total Maximum Amount has been approved and encumbered for this contract. Therefore, it is agreed that the Vendor will not be obligated to perform services nor incur costs which would result in exceeding the funding currently approved and encumbered, nor will the Department be obligated to reimburse the Vendor for costs or make payments in excess of currently established funding. The Department will provide written authorization, if and when subsequent funding is approved and encumbered for this contract.
This is a Term Contract for an Indefinite Quantity whereby the Vendor agrees to furnish services during a prescribed period of time. The specific period of time completes such a contract. The Department, based on need and availability of budget, may increase or decrease the Budgetary Ceiling by Amendment. Execution of this Agreement does not guarantee that the work will be authorized.

4.0 ESTABLISHMENT OF LETTER OF AUTHORIZATION AMOUNT:
For each "Letter of Authorization" (LOA), the Vendor, following the Scope of Services as set forth in Exhibit A, shall prepare an estimate of work and price based on the rates established in Exhibit C, and allowable expenses for each task assigned.
Once an acceptable Maximum Limiting Amount or Lump Sum Amount has been agreed upon by the Vendor and the DEPARTMENT’S Project Manager, a "Letter of Authorization" (LOA) shall be issued by the Project Manager. All work authorizations shall be completed within the term of this Agreement.
The amount established for each assignment/project shall set forth a detailed budget which will define anticipated man-hours needed for each labor classification, plus the cost of agreed and authorized expenses, to complete the assignment. Items not included on the price proposal will be negotiated on an “as needed” basis.
Additional equipment (non-contract items) may be required to perform services under this contract. This equipment is not known at this time and will be determined, and negotiated, on a case-by-case basis. The rate for this equipment must include the price for the equipment (purchase, rental, etc.) transport to/from the site, and the cost of the operator.
All non-contract items must be approved by the Project Manager in writing prior to the expenditure. For all additional equipment (non-contract items), the Consultant must request three (3) quotes and use the lowest quote. The Vendor will submit the quotes in writing for DEPARTMENT records. All non-contract items and non-rate sheet items necessary to complete the assignment for work not listed in Exhibit B will be reimbursed at cost.
All work authorized by the FDOT District Six, which includes Miami-Dade and Monroe Counties, will be paid as local.
There shall be no payment for personnel or equipment mobilized or demobilized outside of the District. Labor costs are billed on a portal to portal basis.
5.0 PROGRESS PAYMENTS:
Payment shall be made at the contract hourly billing rates in Exhibit “C”, Price Proposal, for services provided and upon satisfactory completion of the services and approval and acceptance of the contract deliverables by the Department. Payment for expenses shall be made on the basis of actual allowable cost incurred, as authorized and approved by the Department. The contract hourly billing rates shall include all overhead and operating margin costs, including but not limited to, salaries, profits, travel, administrative expenses, materials, equipment, insurance, all other incidentals and all direct and indirect costs required to complete the contract services.
For the satisfactory performance of the services detailed in each "Letter of Authorization" (LOA), the Vendor shall be paid up to the amount of each Authorization issued of a Maximum Limiting Amount LOA.
Exhibit “B”, Method of Compensation Page 4 of 4 DOT-RFP-26-6199LS
For issuance of a Lump Sum Amount LOA, the Vendor will receive progress payments for the subject task based on the percentage of task that has been completed and accepted by the DEPARTMENT during the billing period.
The Vendor shall submit monthly invoices (3 copies) in a format acceptable to the Department:
Invoice for tasks to be paid as Maximum Limiting Amount shall include itemization of actual man-hours and actual allowable cost incurred.
Invoices for tasks to be paid as Lump Sum shall be submitted on a monthly basis until the task is completed, and each invoice shall indicate the percent complete.
Invoices shall be submitted to: Florida Department of Transportation
Victoria Vogt, M.S., FCCM Planning and Environmental Management Office
1000 N.W. 111 Avenue, Rm. 6111 Miami, Florida 33172
6.0 DETAILS OF UNIT RATES:
Details of Unit Rates are contained in Exhibit C, for the performance of the Vendor’s services set forth in Exhibit A, attached hereto and made a part hereof.
7.0 TANGIBLE PERSONAL PROPERTY:
This contract may include the purchase of Tangible Personal Property as defined in Chapter 273, F.S., and is acquired in accordance with Rule 60A-1.017, Florida Administrative Code.
The specific property(ies) and line item cost(s) will be determined on a case-by-case/project-by-project basis and will be subsequently transferred to and controlled by the DEPARTMENT upon completion of services or end of the contract, whichever occurs first.
Upon receipt of property, the Vendor shall forward to the DEPARTMENT a copy of the purchase invoice/property description/serial number and date of receipt. The DEPARTMENT will forward inventory control label(s) to be affixed to all property. The Vendor will accommodate physical inventories required by the DEPARTMENT.
