PART III: CONTRACT CONDITIONS
1) CONTRACT PROCESS
The attached Proposed CM/GC Contract contains contract terms and conditions, as well as the General conditions applicable to the Work, and will form the basis of the final CM/GC Contract. Owner will attempt to negotiate a contract with the top ranked firm. During contract negotiations following selection of the highest ranked Proposer, Owner may entertain suggestions on refinement of the Proposed CM/GC Contract and its Exhibits only when:
a) The general work scope remains the same;
b) The field of competition does not change as a result of material changes to the requirements stated in the RFP; and
c) Acceptance of the proposed change would not likely affect proposed CM/GC Fees.

This contingency is not for the exclusive use by the CM/GC but is meant to be utilized by the team if needed during the course of construction. The College will have the CM/GC utilize a smartsheet to govern the spend down management of this contingency. Whether the CM/GC recommends specifying escalation, estimating, bidding, market, design and/or contractor’s contingency is available for discussion when being developed as a team, however, it is all part of the same bucket and should be considered as such. Overtime (OT) hours will need to be pre-approved by the college as a contingency use item prior to being utilized. Contingency items should be submitted in a timely manner. Items that have not been finalized and awaiting backup for a significant amount of time (>60 calendar days) shall be deemed as not needed changes in either time or dollars and should be removed from the log and/or cleared to zero impact.
5) CONTRACTOR OBLIGATIONS
The prospective CM/GC should note that OWNER will also require AS PART OF THE CM/GC PRECONSTRUCTION SERVICES a full description of items that will be contained in the proposed GMP and the activities that make up the proposed GMP. After preparation, a complete copy of the GMP estimate, including all details within the GMP Supporting Documents, shall be provided to Owner and the architect.
Owner will monitor the competitive processes used to award subcontracts by the CM/GC in accordance with Article 11 of the Proposed CM/GC Contract. The following minimum requirements shall be used:
a) The CM/GC shall solicit sealed bids or quotes from subcontractors in a manner consistent with industry practice, and make award decisions based on cost or, if not on cost, on another identified alternative competitive basis as approved in advance by Owner. When there are

b) Procedures for selection of subcontractors shall adhere to applicable State guidelines requiring good faith efforts to develop employment opportunities for minority-owned, women-owned (MWBE) and emerging small businesses (ESB). The recommended goal for MWBE participation is 12% and the recommended goal for ESB participation is 10%.
c) The CM/GC shall use its best efforts to obtain at least three bids or quotes for the particular work to be subcontracted. Owner may make exceptions to this practice in advance of the procurement.
d) CM/GC Subcontractor BUY-OUT process- All competitive bids shall be presented and compared by a line by line “estimate to bid matrix” so the College can review and clearly understand the normalization process used to develop sub award recommendations and to see where the college compares to GMP estimates. This includes self-performed work by the CM/GC. All self-performed work will need a high level of accounting transparency and be acceptable to the owner.
e) A draft CPM schedule shall be presented to the college during preconstruction phase. Prior to the GMP establishment a CPM schedule shall be presented to the college that fits within the college schedule expectations. CPM should show the clear critical path of activities that affect the end date completion of the project.

PART IV: SCOPE OF WORK
1) PROJECT DESCRIPTION
The for Building 12 Demolition, Public Safety Relocation and Elevated Platform Remediation project (the “Project”) addresses the 2020 Bond project goals of updating the campus earthquake and safety upgrades and reduction of deffered maintantance.
Project Scope and Background:
Public Safety currently resides in Building 12 which is planned for demolition and major mainaintance and will need to be relocated to Building 15. Relcoation will require site work improvements to provide adequate emergency egress from the area surrounding Building 15.
Lane Community College (“LCC”) is seeking a contractor to provide logistics coordination and construct the building modifications for the relocation of LCC’s Public Safety office currently located in Building 12 to Building 15. In addition, the contractor team should construct the remediation addressed by deferred maintenance issues with the elevated platform that is adjacent to Building 15. As part of the Project, the contractor team needs to be prepared to work closely and in collaboration with several other AE firms that are directly linked to this scope, namely the site civil access and parking lot work associated with Building 15 designed by KPFF Civil Engineers, the demolition of adjacent Building 12 designed by Henneberry Eddy Architects, and the Woofter Bolch Architects team selected to design the Building 15 Public Safety Relocation and Elevated Platform Remediation work. Adjacent and separate from this CM/GC is the work that will be constructed of the Major Maintenance work on Building 16, designed by Rowell Brokaw Architects that Fortis Construction is constructing. The selected contractor must be able to work with the adjacent Building 16 project team.
RELOCATION AND ELEVATED PLATFORM REMEDIATION Page | 17
Critical Project Goals:
The primary Project goal is to minimize risk in the case of natural disaster of disruption to critical campus services of the Public Safety office and the Central Utility Plant (CUP).
Temporary bracing and evacuation protocols are in place to limit risk of structural deficiencies found in the 1970s portion of Building 12. Public Safety is the final full-time occupant of the building. The resulting yard area will provide increased emergency vehicle access to the southeast section of the campus.
Demolition of the 1970s portion of Building 12 and structural improvements of the remaining portion of Building 12 will significantly reduce risk of disruption to the campus CUP. Relocating the final building occupant (Public Safety) is a critical path to the execution of the demolition and seismic improvements.
Building 15 has been selected as the new location for the Public Safety office. Along with interior changes to the building and selected building systems, improved access for emergency response was determined to be a requirement for the success of the location.
Widening of the existing access road and development of a secure parking area for emergency response vehicles addresses concerns of access from the east side of campus. Known structural deficiencies, including seismic stability, present a risk of collapse of the elevated platforms on the west side of Building 15. The elevated platforms
LCC - RFP 24/25-09 - CM/GC Services for Building 12 Demolition, Public Safety Relocation and Elevated Platform Remediation are currently part of the egress pathway from the upper level of Building 15. Structural failure of the elevated platform would impact the function of Public Safety operations in such a critical event.
Critical Project Risks:
The potential for structural failure of the Building 12 roof truss structure has been identified as significant in the case of heavy roof load due to snow, ice, or other loading.
Damage to Building 12 has the added risk of shutting down all utility infrastructure of the LCC campus due to the location of the CUP within the building. The elevated platforms show significant degradation of concrete materials. Spalling concrete has the risk of delamination from the structure. Falling concrete presents risk of injury to pedestrians, vehicles, and equipment below the structure. Both of these structures have limited resistance to seismic loads, presenting significant risk of damage and possible structural failure.
Noise and traffic disruption from construction activities can have significant impacts to delivery of classes and student performance. Activities related to the construction of the east access road, demolition of Building 12, and remediation of structural deficiencies of the elevated platforms have significant risk of impacting access (including emergency response) to campus activities and creating noise that could impact classroom activities in adjacent buildings.
Coordination of schedules between projects is critical. The goal is focused on seismic stability of the remaining Building 12 CUP, and the interrelation of the Project to achieve this goal is complex. Relocation of Public Safety from Building 12 is evident. In addition to moving occupants from Building 12, it is anticipated that equipment and furnishings related to Public Safety will need to be moved to their new locations. This will include impacts to Building 12 electrical and life-safety systems that will require coordination with the demolition schedule.
The Project will therefore entail many challenges and require careful planning and coordination during the design and construction phases for effective and efficient completion. Robust budget and schedule controls are essential to the Project’s success.
Owners Requirements for CM staffing during pre-construction services: LCC expects at least one primary team member to be involved from project inception to close-out. Pre-construction services staff to include project manager, estimator, and site superintendent as appropriate to establish project costs, logistics, schedule, and design value assessment throughout the design process. Expectations for collaboration with adjacent Building 16 Renovations project team and project logistics.
Other pre-construction services: CM/GC to assist in establishing a target value budget and project scheduleing across the vaired phases of the project. Ongoing opinion of probable cost, constructability reviews, long lead procurement findings and recommendations, detailed cost reports and project schedules are to be issued at Schematic Design, and Design Development phase of the design. Design Development cost report may be used as a basis of contract GMP.
Project-specific professional experience: The team should be familiar with the preservation and enhancement of existing buildings, demolition and structural remediation work. The project team should have experience with the project type, scale, and systems as described within.
LCC - RFP 24/25-09 - CM/GC Services for Building 12 Demolition, Public Safety Relocation and Elevated Platform Remediation
2) DESIGN/DELIVERY METHOD
The college will utilize the Construction Management/ General Contractor method for the construction of this project as an alternative method of contracting from the traditional Design/Bid/Build method. The college intends to select a Construction Manager/ General Contractor (CM/GC) firm during the design phase of the project. After reviewing the design documents, providing preconstruction services, the CM/GC will provide the college with a Guaranteed Maximum Price (GMP) proposal to complete the work shown on the construction documents that meets the College’s budget. The project will proceed to completion after the college accepts the GMP.

PART V: PROPOSAL CONTENT AND ANALYSIS
1) PROPOSAL ANALYSIS PROCESS
Written proposals submitted to the College in accordance with this RFP will be evaluated by a review committee consisting of college employees and the project architect. Any firm’s response to this RFP shall be considered de facto permission to the College to disclose Part VI, and associated summary, when completed, to selected viewers.
Proposals should not exceed forty (40) pages total excluding required forms in Appendices.
Proposals shall be analyzed on the following basis:
a) Proposals will be read by the members of the review committee. Proposals will be divided into two groups, those which are considered responsive and responsible, and those which are not. Of those considered responsive and responsible, proposals will be ranked in terms of the evaluation factors shown in Part VI;
b) “Responsive” means that the proposal has complied with all the requirements of this invitation;
c) “Responsible” means that the Proposer has been truthful, that pertinent negative information has not been withheld, that the proposal is not a sham, that the named staff are qualified as specified, that the Proposer is adequately financially sound for a reasonable expectation of completion of the work, and that the Proposer, in the judgment of the College, is capable of performing the work.
d) The College may request supplementary submittals and written or verbal clarifications from any proposer in order to ensure each Proposer a full and careful review of qualifications, capabilities, and fees.
e) A shortlist of candidates may be developed based on the ranking of Proposals.
Interviews of candidate firms will be held at the discretion of the committee.
Interviews will be ranked in terms of the evaluation factors shown in Part VI.
f) Proposers shall be ranked by the review committee based on evaluation of responses and oral interviews, with the first ranked firm being that firm which is deemed to be the most appropriate and fully able to perform the services and the second-ranked firm being the next most appropriate, etc., all in the sole judgment of the review committee.
f) The review committee will then submit its ranked list to the President for approval, the top-ranked proposer usually being awarded the contract. If, for any reason, the top-ranked firm is unacceptable, the process will be repeated until a firm acceptable to the College is identified.
