About this file

The document is a question-and-answer log for Request for Proposals (RFP) 202503052 issued by the Maine Department of Environmental Protection (DEP) for a Pre-Qualified Vendor List (PQVL) for Natural Resource Damage Assessment and Restoration (NRDAR) services. The RFP seeks expert vendors to provide comprehensive environmental damage assessment and restoration assistance related to oil and hazardous material discharges, with vendor specialization opportunities in categories including Wetlands, Injury Determination, Restoration, NRDAR Expertise, and NRDAR Calculations. The proposal submission deadline is October 28, 2025, with a contract term from January 1, 2026 to December 1, 2031. Vendors will be eligible for semi-annual enrollment and potential invitation to mini-bid processes for specific NRDAR projects.

The procurement utilizes a 100-point evaluation process, with points distributed across Organization Qualifications and Experience (40 points), Proposed Services (30 points), and Cost Proposal (30 points). The cost proposal will be scored using a mathematical formula that awards the lowest bid 25 points, with proportional point reductions for higher-cost submissions. Rate sheets are fixed for the entire contract length, and vendors must submit detailed documentation including organizational qualifications, project examples, organizational charts, and insurance certificates. The Department of Environmental Protection reserves the right to negotiate contract terms, remove vendors from the PQVL for unsatisfactory performance, and select multiple vendors for the pre-qualified list. While no specific budget ranges are detailed, the multi-year contract structure suggests a robust and competitive procurement process with potential for ongoing work throughout the five-year contract period.

10/15/2025Under Submission Format, Company Rate Sheet is listed under File 2, Appendix C. Later, the rate sheet is listed as part of the Cost Proposal, File 3. Should the Company Rate Sheet go in the File 3 Cost Proposal?10/16/25No, the Rate Sheet should be included in File 2 and is referenced in the Cost Proposal. If there are any additional rates necessary to cover the costs of the hypothetical scenario they should be included in File 3.
10/15/2025The hypothetical cost scenario asks bidders to estimate injuries and damages to human health, which seems like toxic torts rather than NRDAR. Can you please clarify what human health information the trustees will need in this scenario?10/16/25Damages for NRDAR are calculated to include the loss of profits during the time it takes for the natural resource to be restored to baseline levels. These losses can be from recreation and tourism which are impacted by human health injuries. For the scenario, we need to know the human health injury and the time it would take to return the area to baseline levels to properly estimate damages. The toxic substance is diesel fuel.
10/15/2025If selected for the PQVL, will it be possible to add subcontractors who are not listed in our response to the RFP (p. 12)?10/16/25Yes, provided bidders supply us with the subcontractor information, as outlined on page 12.
10/15/2025Given the uncertain nature of future work, will it be possible to add expenses in the future as needed (p. 13, Section IV.1.a)?10/16/25Rate sheets are fixed for the entire length of contract, as outlined on page 23.
10/15/2025In addition to current rates, should bidders submit escalated rates for outward years (p. 13, Section VI.1.a)?10/16/25No, rate sheets are fixed for the entire length of the contract, as outlined on page 23.
10/15/2025The hypothetical cost scenario (p. 23) involves several RFP specialized areas of expertise, especially wetlands, injury determination and restoration. How should we respond to the cost scenario if we do not intend to bid on all of the relevant areas10/16/25Bidders will need to provide a subcontractor and identify that subcrontractor as outlined on page 12.
10/15/2025If selected for a mini-bid, would the award be FFP or T&M?10/16/25The Department will select one vendor based on the project-specific cost proposal submitted during the “mini-bid” process of those pre-qualified vendors who can meet the specific service requirements.
10/15/2025Is the requirement to submit three (3) project examples in total, or three per service category? Can you confirm we can submit more than three project examples (three is the minimum)?10/16/25Three total projects satisfies the requirement. Bidders are welcome to add more projects by adding more tables to the Qualification & Experience FORM on page 23.
10/15/2025For project references, is it permissible to include "confidential" clients as long as we indicate the industry and general location along with the project summary?10/16/25For project examples it is not permissible to include confidential client names. Without the client name and contact information, we would have no way of verifying that those projects reflect the experience and expertise desired for this RFP.
