About this file

This is a Land Lease Agreement template from the Michigan Department of Natural Resources (DNR) for the installation and operation of solar electric generating systems on state-owned property. The agreement establishes the terms under which a lessee may enter designated premises to install, construct, maintain, and operate ground-based and rooftop-mounted solar systems. The lease term is specified as an initial period (dates to be determined), with provisions for renewal as a year-to-year tenancy if the lessee remains in possession following expiration. The lessee is responsible for all aspects of system design, construction, installation, commissioning, interconnection, operation, and maintenance at its sole cost and expense. The lessee must comply with all applicable federal, state, and local laws, obtain necessary permits, and follow the DNR's environmental, safety, and health performance standards. Upon lease expiration or cancellation, the lessee has up to 180 days to remove all structures and improvements and restore the premises to original condition.

Rent is payable annually in an amount to be determined, with a $10 per day late fee for overdue payments and potential lease termination for non-payment. The lessee must maintain general liability insurance with a minimum aggregate limit of $2,000,000, property insurance on all buildings and improvements at full replacement value, and workers' compensation and auto coverage as required by law. The lessee is fully indemnified and holds the DNR harmless from all claims, injuries, and damages arising from lease activities. The DNR reserves the right to cancel the lease with 30 days' notice if the premises are no longer used for the stated purpose, with 90 days' notice if cancellation is deemed in the state's best interest, or immediately for non-compliance with lease obligations or fraudulent application information. The agreement is governed by Michigan law and disputes are resolved through the Parks and Recreation Division Chief's written decision.
