The WDNR seeks a completely operational, 30' to 35' centerline length, modified V-design, heavy-duty aluminum walk-around cabin boat with dual 350 HP outboard motors, comprehensive electronics, and matching trailer. The vessel must accommodate a minimum of 16 persons, comply with U.S. Coast Guard and National Marine Manufacturer's Association standards, and maintain a 10-year minimum lifespan with limited downtime for scheduled maintenance. The RFP was issued June 15, 2017, with written inquiries due by June 30, 2017, and proposals due by July 25, 2017 at 2:00 PM CST. An optional vendor meeting was scheduled for June 27, 2017. Vendor interviews are reserved for August 8, 2017, with notification of intent to award estimated for August 10, 2017, and contract start date of August 18, 2017. The contract term extends from August 18, 2017 through full acceptance of the boat, with delivery to the Washburn Marina in Washburn, Wisconsin on an FOB destination basis.

Proposals are evaluated on a 1,000-point scale based on purchase price (250 points), company history and qualifications (100 points), references and experience (100 points), quality and compatibility of goods and services (300 points), product/ordering detail (50 points), and additional information including rebates and innovations (200 points). Certified Minority Business Enterprises and Disabled Veteran Owned Businesses may receive up to a 5% price preference. The supplier must provide firm pricing for the contract period, with any price increases requiring 60 days' notice and full documentation of industry-wide cost increases. All materials and workmanship must meet high commercial boat-building standards, with the hull warranted for a minimum of 10 years against defects in materials and workmanship. The supplier bears all costs for vessel testing, trials, and transportation back to the manufacturing facility if modifications are required following lake trials. Proposals must include financial stability documentation, detailed vessel specifications, work plans with timeframes, warranty information, and references from at least three similar projects completed within the past five years.

1.0 GENERAL INFORMATION

1.1 Introduction

The Wisconsin Department of Natural Resources (WDNR) is requesting a proposal for the manufacture, testing, and delivery of a Lake Superior Law Enforcement Patrol vessel. It is the intent of WDNR to receive proposals that include all technical and supplier services to provide labor, materials, equipment, delivery to WDNR at Ashland, Wisconsin, and all other costs for a completely operational vessel as described in this Request for Proposal. The proposal should address the delivery, schedule of milestones, and timeframe that may be actually required if different from WDNR’s desired delivery and acceptance date

1.2 Procuring and Contracting Agency

This Request for Proposal (RFP) is issued by the Wisconsin Department of Natural Resources which is the sole point of contact for the State of Wisconsin during the selection process. The person responsible for managing the procurement process is Robin Brietzman (RFP project manager)

The contract resulting from this RFP will be administered by the Wisconsin Department of Natural Resources – Division of Finance. The contract administrator and DNR manager is Robin Brietzman.

1.3 BACKROUND

Agency or DNR – Wisconsin Department of Natural Resources.

The current, primary Lake Superior law enforcement patrol boat has been used intensively since 2006 for monitoring the commercial fishery on Lake Superior, which is required through the Lake Superior Commercial Fishing Agreement between the State of Wisconsin and the Red Cliff and Bad River Tribes. Law enforcement officers from each of the Agreement agencies work jointly from this vessel during patrol (Grid Check) efforts. Additionally, the patrol boat is used for law enforcement of recreational boating and sport and charter fishing activities in and around the Apostle Islands area of Lake Superior. The boat is used for participation in Port Security training and exercises in conjunction with U. S. Coast Guard (USCG) and other Port of Duluth/Superior Area Maritime Security Committee (AMSC) partners. Additionally, emergency response and search and rescue missions for lost persons and stranded boaters on Lake Superior all require call to duty for this primary response vessel.

PROJECT AND SCOPE

This request for proposal is to procure the best vessel for the efficient, effective and safe monitoring, and patrol of regulated activities on the waters of Lake Superior, which can be a harsh, unforgiving, and challenging environment during patrol activities.

During a limited open-water commercial season, properly functioning equipment is critical and unplanned downtime is not an option. Law enforcement commercial fishing monitoring effort’s effectiveness, efficiency, and safety rests entirely on the operation of this vessel on Lake Superior .

Vessel design and suitability for patrol to accomplish broad missions on Lake Superior are paramount considerations. Patrol efforts can extend great distances and encompass many hours on the water. Safety and comfort of officers is critical during challenging weather and extreme temperature conditions.

It is vitally important that this patrol vessel function without failure, with limited downtime for scheduled maintenance for a minimum 10-year lifespan. Locating expert technicians to service our larger patrol boats has always been a challenge in northwest Wisconsin without considerable travel and scheduling difficulties. Having access to service facilities in close proximity can reduce the time spent on maintenance and repairs. Explain your recommendations for service to this vessel.

Guidelines for the minimum vessel requirements are outlined in the Boat and Trailer Specification, attached as Attachment 1. WDNR will consider materials and performance other than those contained in the Attachment 1 provided they equal or exceed those stated.

When selecting a supplier, WDNR will take into consideration the supplier’s years of experience in construction of similar boats, how closely the supplier is able to comply with materials and performance guidelines, and the delivery and acceptance date. The delivery and acceptance date may be negotiated between WDNR and the selected supplier.

3.0 PROPOSAL SELECTION AND AWARD PROCESS

3.1 Proposal Scoring

Accepted proposals will be reviewed by an evaluation committee and scored against the stated criteria. A proposer may not contact any member of an evaluation committee except at the State’s direction. The committee will conduct a comprehensive, fair and impartial evaluation of all proposals received in response to this Request for Proposals for Lake Superior Patrol Boat. Each proposal received will be analyzed to determine overall responsiveness and completeness as defined in the

Statement of Work and the Instructions on submitting a proposal.

The Proposal will only be scored on the Department of Natural Resources purchased items.

Proposals from certified Minority Business Enterprises or from certified disabled veteran-owned businesses may have points weighted by a factor of 1.00 to 1.05 to provide up to a five percent (5%) preference to these businesses (Wis. Stats. 16.75(3m)). The evaluation committee's scoring will be tabulated and proposals ranked based on the numerical scores received.

3.2 Evaluation criteria

The proposals will be scored using the following criteria as per Department purchased Patrol Boat –

Reponses are to be marked as per 2.4 (Tab 2): Maximum Points cannot exceed 1,000 or percentage of 30%

RFP Section – General RFP Requirements (4.0) Points Percent

3.3 Right to Reject Proposals and Negotiate Contract Terms

The State reserves the right to reject any and all proposals. The State may negotiate the terms of the contract, including the award amount, with the selected proposer prior to entering into a contract.

If contract negotiations cannot be concluded successfully with the highest scoring proposer, the agency may negotiate a contract with the next highest scoring proposer.

3.4 Award and Final Offers

The State will compile the final scores (General Requirements and cost) for each proposal. The award will be granted in one of two ways. The award may be granted to the highest scoring responsive and responsible proposer. Alternatively, the highest scoring proposer or proposers may be requested to submit final and best offers. If final and best offers are requested by the State and submitted by the vendor, they will be evaluated against the stated criteria, scored and ranked by the evaluation committee. The award then will be granted to the highest scoring proposer. However, a proposer should not expect that the State will request a final and best offer. In the event of a tie, the tie breaker will be determined and awarded to the vendor who has the most items manufactured and/or assembled in the United States. In the event of a tie with the manufactured and/or assembled in the United States, a flip of a coin will determine the awarded vendor.

3.5 Notification of Intent to Award

All vendors who respond to this RFP will be notified in writing of the State's intent to award the contract(s) as a result of this RFP.

Once notification of the intent to award is made, copies of proposals will be available for public review under the supervision of agency staff. Proposal reviews will take place from 8:00 a.m. to 3:00 p.m. at

4.0 GENERAL PROPOSAL REQUIREMENTS

The Wisconsin Department of Natural Resources (WDNR) is requesting a proposal for the manufacture, testing, and delivery of a Lake Superior Law Enforcement Patrol vessel. It is the intent of WDNR to receive proposals that include all technical and supplier services to provide labor, materials, equipment, delivery to WDNR, Washburn Marina, 1 Marina Dr, Washburn, Wisconsin, and all other costs for a completely operational vessel as described in this Request for Proposal.

The proposal should address the delivery, schedule of milestones, and timeframe that may be actually required if different from WDNR’s desired delivery and acceptance date.

Objective: The objectives to be satisfied through this RFP are as follows:

This request for proposal is to procure the best vessel for the efficient, effective and safe monitoring and patrol of regulated activities on the waters of Lake Superior, which can be a harsh, unforgiving and challenging environment during patrol activities.

During a limited open-water commercial season, properly functioning equipment is critical and unplanned downtime is not an option. Law enforcement commercial fishing monitoring effort’s effectiveness, efficiency, and safety rests entirely on the operation of this vessel on Lake Superior.

Expected Services: Duration of services: August 18, 2017 – Full acceptance of finished boar TBD. The services will begin pending approval.

Materials and Workmanship:

a. Where a specific brand is named it shall be construed solely for the purpose of indicating the standard of quality, performance, or use described. Brands of equal quality, performance, and use shall be considered, provided the Supplier specifies the brand and model, and submits descriptive literature to WDNR representatives and obtains written approval.

b. All apparatus (machinery, equipment, piping, etc.) are to conform to good marine practice for vessels of this class. Materials shall be ordered to recognized standard sizes, wherever such apply, to facilitate replacement or repair. All materials and equipment, other than those supplied by WDNR, shall be new and of the best commercial quality. WDNR and Supplier shall reach written agreement as to manufactured items to be supplied for the vessel.

c. The Supplier shall provide suitable facilities and exercise proper diligence in connection with the storage, handling and installation of all WDNR supplied materials and equipment. Machinery and other components subject to damage or deterioration from exposure to weather or excessive heat, cold, or humidity shall be placed in suitable warehouses or otherwise properly protected. Special attention shall be given to manufacturer’s installation instructions.

d. All workmanship entering into the construction of the vessel shall conform to a high standard of commercial boat building practice and shall result in fair lines and smooth surfaces. Sharp and ragged edges or corners of structure which are unsightly or which could cause injury to personnel shall be removed, ground smooth, or snipped. Within tanks, bilges, peaks and any other spaces or areas which could trap liquids, limber holes of adequate size shall be provided to ensure effective drainage.
