About this file
This is Addendum No. 1 to RFP 15-26, issued by the New Smyrna Beach Utilities Commission (NSBU) on June 29, 2026, for Public Parcel Delivery and Private Parcel Entitlement Services for the Western Utility Complex. The addendum clarifies key aspects of the RFP process and proposal requirements. Respondents are permitted to include subcontracted support for parcel research, survey coordination, sketches, legal descriptions, easement support, and related parcel delivery services under either separately awardable component, provided all subcontractors, roles, and scopes are disclosed in proposals. The "RF Qualification Document" referenced on the online bid website refers to the RFP response itself, which must comply with Submittal Requirements 11 as outlined beginning on page 10 of the base RFP. Regarding Submittal Requirement 9 (Conceptual Master Plan), proposers must submit a base conceptual plan tailored specifically to the subject property and address its geographic context, site conditions, zoning requirements, and constraints; unmodified prior plans from similar projects will not be accepted, and proposers should maximize land use within applicable zoning and RFP constraints.
The addendum addresses interim financing for Component A, clarifying that it refers to short-term funding to cover Phase 1 planning, entitlement, permitting, and pre-development costs until longer-term financing is secured. If proposed, interim financing must include a standalone financing term sheet detailing sources, uses, fees, draw conditions, security, maturity, prepayment terms, and takeout strategy, while preserving NSBU's fee ownership and control without creating liens or mortgages on NSBU real property. NSBU does not express a preference for lump sum, phase-based, or retainer/hourly pricing structures; any approach is acceptable if submitted as a clear, standalone price proposal for each component consistent with RFP separation and non-blending requirements. Proposers are responsible for retaining and compensating all necessary professionals, including land use attorneys, civil engineers, surveyors, biologists, and architects required to perform the awarded scope, though NSBU may separately procure certain professionals at its sole discretion without relieving the proposer's responsibility for its own team or costs unless expressly stated in a definitive agreement.

RE: RFP No. 15-26 ADDENDUM NO. 01
To prospective vendors:
The Utilities Commission is issuing the following addendum. As such it becomes an integral part of the proposal and must be acknowledged by the return of this signed form, with your proposal form, acknowledging receipt of the addendum.
1. Does the RFP allow respondents to include subcontracted support for parcel research, survey coordination, sketches/legal descriptions, easement support, or related parcel delivery services under either of the separately awardable components?
Response:
Yes, respondents are generally allowed to include subcontracted support for parcel research, survey coordination, sketches/legal descriptions, easement support, and related parcel delivery services, provided that all requirements outlined in the RFP are met. Respondents must disclose all proposed subcontractors, roles, and scopes in their proposals. RFP respondents are responsible for their submission.
2. The online bid website asks for a RF Qualification Document. What is that and where can we get one so that we can complete and upload it?
Response:
For RFP 15-26, RF Qualification Document is your response to this RFP. Your response shall be in accordance with the Submittal Requirements (11) beginning on page 10 of the RFP.
3. Submittal Requirement 9 calls for a Conceptual Master Plan. We can share a concept plans we have done on similar projects in Florida, would that be acceptable? We are a bit confused on how a bidder could create a realistic conceptual plan without having more input from NSBU, NSB staff, site specific criteria, etc.

Response:
Submittal Requirement 9 requests a conceptual master plan for the WUC that is based on the RFP materials and the Respondent’s own due diligence. Consistent with the RFP scope, proposers must submit a base conceptual plan tailored to the subject property and to the proposer’s highest and best use for Component A and/or Component B. Submitting an unmodified prior plan that does not address this property’s geographic context, site conditions, zoning requirements and constraints, will not be accepted. Proposers should maximize land use within applicable zoning and all RFP constraints.
4. Interim Financing for Component A is mentioned throughout the bid document. Is this asking the bidder for assistance in locating a lender for NSBU's planned Component A projects? A more detailed explanation of what NSBU is looking for would be helpful.
Response:
For Component A, “interim financing” refers to short-term funding that may be proposed to cover Phase 1 planning, entitlement, permitting, and other pre-development or early work costs for the NSBU public parcel until longer-term financing or takeout is in place. Interim financing is optional; if offered, the proposal must include a standalone financing term sheet detailing sources and uses, fees, draw conditions, security/collateral, maturity, prepayment, and the proposed takeout or refinancing strategy. Any such financing must preserve NSBU’s fee ownership and control and may not create an impermissible lien or mortgage on NSBU real property.
5. Would a lump sum bid be preferred for each Component? Or should we break our fee down to each Phase? Or perhaps a retainer with an hourly fee? Any experience you can share is appreciated.
Response:
NSBU does not state a preference for lump sum vs. phase-based vs. retainer/hourly. Any of these are acceptable if submitted as a clear, stand-alone price proposal for each Component, consistent with the RFP’s separation and non-blending requirements. If proposing interim financing for Component A, include the required financing term sheet.
6. We are planning to quote a fee for our involvement under our development/consulting firm Rivals Development. However, to accomplish the desired Phases will most likely require additional professionals such as Land Use Attorneys, civil engineers, surveyors, biologists, architect, etc. Would the cost for these professionals be paid directly by NSBU? Or would that be a bidder's cost?

Under the RFP, the proposer is responsible for retaining and paying the professionals necessary to perform its awarded scope (including planning, entitlement applications, and related approvals), and is accountable for its consultants and subcontractors. NSBU, at its sole discretion, may separately procure and pay for certain professionals, but this does not relieve the proposer of the responsibility for its own team or costs unless expressly provided in the definitive agreement approved by NSBU.
