Failure to file a protest within the time prescribed in section 120.57 (3), F.S., or failure to post the bond or other security required by law within the time allowed for filing a bond, shall constitute a waiver of proceedings under chapter 120, F.S. Written notices, formal requests and proceedings must conform to the requirements set forth in chapter 28-110, F.A.C.

Any person who files an action protesting a decision or intended decision pertaining to contracts administered by the department or agency pursuant to section 120.57(3), F.S., shall post with the department or the agency at the time of filing the formal written protest a bond payable to the department or agency in an amount equal to 1 percent (1%) of the estimated contract amount. The estimated contract amount shall be based upon the contract price submitted by the protestor or, if no contract price was submitted, the department or agency shall estimate the contract amount based on factors including, but not limited to, the price of previous or existing contracts for similar commodities or contractual services, the amount appropriated by the Legislature for the contract, or the fair market value of similar commodities or contractual services. The agency shall provide the estimated contract amount to the Respondent within seventy-two (72) hours, excluding Saturdays, Sundays, and state holidays, after the filing of the notice of protest by the Respondent. The bond shall be conditioned upon the payment of all costs and charges that are adjudged against the protestor in the administrative hearing in which the action is brought and in any subsequent appellate court proceeding. In lieu of a bond, the department or agency may, in either case, accept a cashier's check, official bank check, or money order in the amount of the bond. If, after completion of the administrative hearing process and any appellate court proceedings, the department or agency prevails, it shall recover all costs and charges which shall be included in the final order or judgment, excluding attorney's fees. Questions are presented in the exact manner they were received.

Truecore Behavior Solutions, LLC – Received 02/26/2024

Question #1 Can the Department please provide the following attachments in Microsoft Word format?

o Attachment D – Past Performance for Residential Commitment Programs Evaluation

Instructions o Attachment O – Cross Reference Table

Answer #1 Yes. These Attachments will be uploaded to VIP with this addendum.

Question #2 Can the Department please provide the following documents in either Microsoft Word, Microsoft Excel format, or any other editable format?

o Exhibit 3 – Florida Minority Business Enterprise (MBE) Utilization Report o Exhibit 4 – Staffing Qualifications and Educational Requirements Chart o Exhibit 7 – Delinquency Interventions and Treatment Sessions Table

Answer #2 Exhibits 3, and 4 can be found at the following link: https://www.djj.state.fl.us/partners-providers-staff/procurement-and-contract-administration. Exhibit 7 is no longer being used. Please complete Exhibit 2, Designation and Request to Change Primary, Intervention, and Treatment Services. Exhibit 2 can be found on the link above and is an editable PDF.

Question #3 Can the Department please provide the names and titles of the evaluation / review team for this Request for Proposal?

Answer #3 Please refer to the Frequently Asked Questions document provided in the solicitation for the list of evaluators.

Question #4 The current per diem bed rate for Miami Youth Academy is $285.84 (filled) and $275.84 (unfilled). This rate was implemented in order to raise the hourly wages of direct care staff to at least $19.00 per hour as well as to increase starting salaries being provided to mental health and medical staff. The proposal bed rate for this Request for Proposal (RFP) for Fiscal Year One is $266.00 (filled) and $246.00 (unfilled), with rates topping out at $276.00 (filled) and $256.00 (unfilled) during Fiscal Years Six – Ten, respectively. Even at the maximum filled rate proposed by the Department during the last five (5) years of the contract ($276.00), this rate is still $9.84 below (per youth, per day) the rate currently being provided to the program. Even at the current per diem rate, it is challenging to meet the salary mandates implemented by the Department for direct care, mental health, and medical staff. The new requirements listed in RFP #10827 (i.e., Career and Technical Education services) will necessitate the implementation of new full-time equivalent (FTE) positions to meet the conditions of the proposal. As such, would the Department be open to increasing the per diem bed rate to ensure a provider is able to meet all staffing and youth requirements identified in the proposal?

Answer #4 By way of this addendum, the filled per diem rate is being changed to $286.00 in Year 1, up to $296.00 during Fiscal Years Six-Ten. The unfilled rate is $266.00 in Year 1.

Question #5 In the Calendar of Events listed in the Request for Proposal (RFP), it lists the anticipated start date of the new contract as November 15, 2024. In addition, the RFP document talks about the provider collaborating with the local school district. With the Florida Scholars Academy scheduled to be implemented prior to the start of the new contract, who would be responsible for education services?

Answer #5 1. The Respondent will be required to comply with the Florida Scholar’s Academy requirements.

2. Internet and Bandwidth Requirements The Respondent is required to cooperate with the Department to ensure the internet capabilities stated here are met:

https://www.djj.state.fl.us/partners-providers-staff/procurement-and-contract-administration https://www.djj.state.fl.us/partners-providers-staff/procurement-and-contract-administration

a. Programs with up to fifteen (15) devices for education services need a minimum of 8 Megabits per second (Mbps) of bandwidth.

b. All other programs with more than fifteen (15) devices for education services will need twenty (20) Mbps of bandwidth.
