As prescribed in 12.205(a)(2), insert a provision substantially as follows:

Evaluation—Commercial Products and Commercial Services (Deviation Date)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

Factor 1: Technical Factor 2: Price

a. Factor 1 – Technical/Conformance to Requirements

The Government will evaluate the quoted item to determine whether they meet the minimum salient characteristics, specifications, and data requirements identified in the solicitation.

The vendor shall provide sufficient manufacturer literature, specifications, product data sheets, certifications, and/or other documentation necessary to demonstrate compliance with the solicitation requirements.

The Government will evaluate the information submitted to determine whether the quoted item meets all material requirements. Failure to meet any criteria will result in an unacceptable technical rating.

The technical evaluation will also consider risk in determining overall acceptability. Risks pertain to the potential for unsuccessful contract performance. Risk will not receive a separate rating, rather, it will be inherent within the overall technical rating. The technical ratings are defined as follows:

Rating Description Acceptable The quotation demonstrates that the quoted item meets all material specifications and required data requirements in the solicitation.

Unacceptable The quotation fails to demonstrate compliance with one or more material specifications or required data requirements in the solicitation.

The minimum technical evaluation requirement is met when the vendor’s quotation thoroughly substantiates all the following essential criteria will be met:

Technical Criteria: See Item Description for specifications.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
