About this file
This document is a Questions and Answers record for RFI #DOR17006 Lab Proficiency issued by the Colorado Department of Revenue regarding marijuana testing facility proficiency requirements. The RFI addresses proficiency testing obligations for Licensed Testing Facilities that conduct testing on retail marijuana, retail marijuana concentrates, retail marijuana products, and medical marijuana. Testing facilities must participate in the Proficiency Testing Program three times per year per test type per marijuana category. To obtain initial certification, facilities must demonstrate at least one successful proficiency testing event within the preceding 12 months in their designated category, with continued participation required to maintain certification. The RFI specifies multiple testing categories including potency analysis requiring measurement of five cannabinoids (THC, THCa, CBD, CBDa, and CBN), residual solvent testing for six compounds (Butane, Heptane, Benzene, Toluene, Hexane, and Total Xylenes), and microbial contaminant testing for E. coli, Salmonella, total yeast, and mold levels.
The document clarifies that Licensed Testing Facilities may hold separate licenses for medical and recreational testing at the same premises with virtual separation of product. The Colorado Department of Revenue Marijuana Enforcement Division maintains a public website listing all licensed testing facilities by location and testing category. Additional testing categories including heavy metals, pesticides, and other chemical contaminants may be required in the future. Permissible contamination levels are referenced in Regulation 712(E). No pricing information, award dates, contract terms, or deadline dates are specified in this questions and answers document.

Department of Revenue Questions/Answers for RFI # DOR17006/Lab Proficiency
This document contains all inquiries submitted by bidder regarding the RFI.
Q1. Are any of the 14 Licensed Testing Facilities noted in the RFI conducting tests exclusively for the medical industry?
A1. The Licensed Testing Facilities must obtain separate licenses to conduct medical and recreational testing. Although those licenses can be located and operational at the same licensed premises, the marijuana must remain at least virtually separate within the facility. The Division cannot provide license specific data with respect to the test results reported. Our website https://www.colorado.gov/pacific/enforcement/licensees-marijuana-enforcement-division does indicate the businesses and their addresses for both medical and recreational testing facilities.
Q2. The RFI states that Testing Facilities are required to participate in the Proficiency Testing Program 3 times per year, per test type, per marijuana category. Regulation R 707 B. indicates the Facility must have successfully participated in the category within the preceding 12 months. Has the MED determined how it will address this issue?
A2. Regulation 707 (B) describes successful participation in a proficiency test event in the last 12 months in the category it seeks certification as a pre-requisite to that certification. Regulation 707 (C) describes the process to maintain certification through continued satisfactory performance in the Proficiency Testing Program as determined by MED. Therefore, to obtain certification there must be at least one successful proficiency testing event in the last 12 months and then to maintain certification there must be continued participation in the Proficiency Testing Program as determined by MED.
Q3. I was able to navigate the site but was not able to find specifics as to what testing is being requested. Are you able to provide a little more information as to what your testing needs are?
A3. Currently, MED rules require the categories of Marijuana including retail Marijuana, retail Marijuana Concentrates, and retail Marijuana products to be tested. The required testing includes testing to determine the potency of each product category as well as contaminant testing to include both microbial and residual solvent testing. Additional testing may be required in the future to include heavy metals, pesticides, or other chemicals and/or contaminants. Also, medical Marijuana is required to be tested in the test type of potency only. For potency tests, the testing facility is required to report five cannabinoids THC, THCa, CBD, CBDa, and CBN. For residual solvent contaminant testing, the testing facility is required to test for the levels of Butane, Heptane, Benzene, Toluene, Hexane, and Total Xylenes. For microbial contaminants, the testing facility is required to report the presence, or lack thereof, for E.Coli and Salmonella as well as the levels of Total Yeast and Mold in colony forming units.
Regulation 712 (E) describes permissible levels of contamination.
