About this file
This is a draft contract between the State of Colorado, Department of Revenue, Marijuana Enforcement Division (MED), and a third-party provider for the implementation and management of a proficiency testing program for licensed testing facilities in Colorado. The contract requires the contractor to design and operate a proficiency testing program that evaluates the ability of MED-licensed testing facilities to accurately conduct required marijuana testing. MED Rules M 707 and R 707 mandate that licensed testing facilities participate in the proficiency testing program, and MED Rules M 703(B)(6) and R 703(B)(6) require successful participation in a Division-approved proficiency testing program to obtain and maintain certification. The contract term has not been finalized, with the performance beginning date, initial contract expiration date, and contract maximum amount all noted as "to be determined" at the time of this draft. The State retains the option to extend the contract for successive one-year extension terms, not to exceed five years total from the effective date without State Purchasing Director approval. The contract includes provisions for an End of Term Extension of up to two months at the State's discretion.
This is a no-cost contract to the State, with payment for services to be received directly from the licensed testing facilities rather than through state appropriations. The contractor must obtain and maintain comprehensive insurance coverage, including workers' compensation, general liability ($1,000,000 each occurrence), automobile liability ($1,000,000 combined single limit), professional liability ($1,000,000 each occurrence), protected information liability ($1,000,000 each occurrence), and crime insurance ($1,000,000 each occurrence). The contractor is designated as an independent contractor and must comply with all applicable federal and state laws, including employment eligibility verification through the E-Verify Program. All work product and deliverables become the exclusive property of the State. The contract requires quarterly progress reports and detailed documentation of personnel assigned to the project, with key personnel positions subject to State approval and replacement restrictions.
