About this file

This document is a Request for Applications (RFA) #7385 for the Mortgage Origination/Flex Lending program issued by the Oregon Housing and Community Services (OHCS) department. The RFA is open to mortgage lenders who wish to become approved providers of the Flex Lending program, which offers down payment assistance to homebuyers in the state of Oregon, specifically in Marion County and the cities of Salem. The RFA does not have a deadline and will remain open for 5 years. Applicants must submit the required application materials, including information on key personnel, trade secrets, warehouse lines of credit, and origination volumes.

The RFA does not provide information on pricing terms, set-asides, incumbents, or funding sources. However, it clarifies that lenders who are already approved to offer Oregon Bond loans must still complete the application to be approved for the Flex Lending program. The RFA also emphasizes that the application is for mortgage lenders, not down payment assistance providers.

RFA #7385: Mortgage Lending Program/Flex Lending Questions & Answers

The answers provided are to questions that were submitted to the SPC via email at

OHCS.Contracts@hcs.oregon.gov.

Q1: How many copies of the “Limited Irrevocable Power of Attorney^* - Attachment E” do we need to provide?

a. “LPOA” – The LPOA only needs one copy signed by an officer designated in the Corporate Resolution

Q2: Under Key Personnel for “Sales Manager”, may I assume that would be our Sales Market Leader?

a. “Sales Manager” – If your “Sales Market Leader” is the key individual providing oversight or guidance to your sales staff, yes.

Q3: For “Affidavit of Trade Secret - If Applicant believes any of its Application is exempt from disclosure under Oregon Public Records Law (ORS 192.410 through 192.505), Applicant shall complete and submit the Affidavit of Trade Secret and a fully redacted version of its Application, clearly identified as the redacted version.” Please be so kind as to provide clarification or an example of a “trade secret”.

a. OHCS cannot advise on trade secrets further than sharing the Affidavit of Trade Secret form.

Additional guidance would be a matter for your counsel to advise you upon.

Q4: Can you confirm, if approved, will this will allow us to offer the Legacy DPA programs as well as Flex Lending and Oregon Bond programs?

a. OHCS does not administer a program called Legacy DPA.

Q5: Can you please provide a link for the Oregon Housing Legacy DPA programs?

a. OHCS does not administer a program called Legacy DPA.

Q6: For the approval letter from all warehouse lines, we have 7 warehouse lines and we don’t get letters from all of them. Is it ok if I attached just the letter from Bank of America?

a. In lieu of approval letters, please submit the Warehouse verification forms.

Q7: If a listed Principle Owner has 0.00% ownership (however role with bank is one that is listed) is the SSN # required? We are getting some pushback on providing this information for non-owners of the bank.

a. Only SSN#’s for owners >10% is required.

Q8: I am working on completing the Annual Originations section of the application . I noticed that it has YTD, 2020 and 2021 volume figures required. Is this a typo? Are you actually looking for 2022 and 2021 figures? Am I able change the 2020 to 2022 or is this the figures you are actually looking for?

a. The past 2yrs. of originations plus YTD is what is required the application has been updated to allow applicants to fill in the years represented.

Q9: I attended your webinar last Thursday and I understand there is a deadline to submit an application this Thursday. I’m so sorry, but I am a bit confused. Is this application for agencies (like DevNW) who provide down payment assistance, or is it for Mortgage Advisors to access down mailto:OHCS.Contracts@hcs.oregon.gov

P a g e 2 | 2 payment assistance for their clients? The webinar had a huge mix of attendees, and I didn’t quite catch that part.

a. The application that closed Thursday was not the Mortgage Lending Program RFA which is RFA #7385. The Mortgage Lending Program RFA is for mortgage lenders who wish to become approved with the lending program, it can be found here:

https://www.oregon.gov/ohcs/procurement/Pages/procurement-opportunities.aspx

Q10: I am already approved to provide Oregon Bond loans. Does this fall under the same application, or different?

a. An application must be completed and approved to offer the Flex Lending Program it is RFA#7385, it can be found here:

Q11. Please advise, and if I need to submit an application, could you please send me a copy of the application that you need submitted? And, when I submit it, do I just email it back to you?

a. The application to be able to offer the Flex Lending Program it is RFA#7385 and can be found here: https://www.oregon.gov/ohcs/procurement/Pages/procurement-opportunities.aspx

Instructions on where to submit the application is included in RFA#7385

Q12: There is no deadline to submit an application for the Flex Lending program, this application RFA #7385 is open for at least the next 5 years. There may have been confusion because multiple programs were being discussed on that webinar. The deadline you heard was for a program that has nothing to do with lending.

a. The application to become an approved lender under the Flex Lending Program Application & Mortgage Lending Program RFA# 7385 are one in the same. This RFA is open for 5yrs.

Q13: If you are approved to do Oregon Bond loans you still need to have the lender application completed for the Flex Lending program.

a. Lenders who wish to offer the Flex Lending Program must apply under Mortgage Lending Program RFA# 7385
