About this file
This document is a Mortgage Lending Program Origination Agreement & Mortgage Loan Purchase Contract between the Oregon Housing and Community Services (OHCS) Department and approved mortgage lenders. The agreement establishes the terms and conditions under which lenders can originate and sell mortgages to OHCS or its designated servicer under the Department's Flex Lending Program and Bond Residential Loan Program. Key requirements include that lenders must be approved, meet financial and operational standards, follow program guidelines, and transfer servicing rights to the designated servicer. Lenders are responsible for underwriting, closing, and submitting mortgages for OHCS purchase, with OHCS retaining the right to reject any non-compliant mortgages.
The agreement covers specifics such as mortgage reservations, fees, repurchase obligations, termination provisions, and terms specific to the Bond and Flex Lending programs. Lenders must maintain appropriate licensing, insurance, and quality control processes. OHCS will provide funds to purchase qualified mortgages originated by approved lenders, with servicing transferred to OHCS's designated servicer upon purchase.
