About this file

This is a Justification for Restricting Competition document submitted by the U.S. Department of State for a sole-source award to Motorola Solutions for communications equipment at the U.S. Embassy in Panama.

The Regional Security Office (RSO) at U.S. Embassy Panama requires ten Motorola VX-P949 P25 UHF-R1 Model 3 portable radios with associated accessories and software for a total estimated value of $23,050. The required equipment includes P25 conventional software, AES-256/ADP encryption, multi-key capability, chargers, keyload adapters, speaker microphones, and standard warranty coverage. These supplies are necessary to supplement the Embassy's existing Motorola P25 radio ecosystem and provide encrypted communications for security operations. The justification for sole-source procurement under FAR 12.102(a) is based on brand-name requirements. Regional Diplomatic Technology (RDT) confirmed that maintaining continuity within the existing Motorola radio ecosystem is essential for technical supportability by local personnel and RDT staff. Market research identified no alternative established commercial sources offering the complete VX-P949 configuration; secondary-market listings and accessory vendors were deemed inappropriate due to warranty and technical support requirements. No current contract mandates Motorola purchases, making the specification technically and operationally justified rather than contractually driven. The Contracting Officer has determined the anticipated cost to be fair and reasonable.

RESTRICTING COMPETITION NOT EXCEEDING THE SIMPLIFIED

ACQUISTION THRESHOLD

SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING

ACTIVITY

Department of State Contracting Activity

☒ Overseas Post U.S. Embassy Panama

Requiring Activity Regional Security Office (RSO), U.S. Embassy Panama

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING

APPROVED

Approval is requested to award on a sole-source basis to Motorola Solutions, located in the United States, for the supplies and/or services described in Section 3, on behalf of the Requiring Activity.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

The requirement is to provide ten (10) Motorola VX-P949 P25 UHF-R1 Model 3 portable radios, including the required P25 conventional software, AES-256/ADP encryption, multi-key capability, chargers, keyload adapters, speaker microphones, and applicable standard warranty, for the U.S. Embassy Panama. The total estimated value of this one-time purchase is $23,050.

These supplies are required to supplement the Embassy’s existing Motorola P25 radio environment and provide encrypted communications for the Regional Security Office (RSO).

The equipment must be capable of being configured and supported within the existing radio ecosystem and by local technical personnel and Regional Diplomatic Technology (RDT).

This purchase will allow the RSO to maintain reliable and secure communications in support of Embassy security operations and mission requirements.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING

OTHER THAN FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 12.102(a), the Contracting Officer has deemed only one source reasonably available based on the following:

☒ Brand-name

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S

UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE AUTHORITY CITED

The requirement specifies Motorola VX-P949 UHF-R1 Model 3 portable radios in order to maintain the Embassy’s existing Motorola P25 radio ecosystem and ensure continued technical supportability by both local technical personnel and Regional Diplomatic Technology (RDT).

The required equipment includes P25 conventional software, AES-256/ADP encryption, multi-key capability, chargers, keyload adapters, speaker microphones, and applicable warranty coverage.

RDT was consulted regarding the technical basis for maintaining the Motorola radio environment. RDT advised that P25 radios are generally interoperable with each other;

however, RDT technical support is focused on radios that have been fielded by RPB, past or present, provided that the equipment is not multiple generations beyond its end of life. RDT’s general guidance is to remain within the same radio ecosystem whenever possible so that both local technical personnel and RDT personnel can effectively support the equipment.

The Embassy has historically obtained its Motorola radio equipment from Motorola Solutions, and the radios currently fielded at the Embassy are part of the same Motorola radio ecosystem.

Continuing with Motorola equipment and the established Motorola Solutions source provides continuity with the equipment already in use and facilitates programming, configuration, troubleshooting, maintenance, and technical support. Motorola Solutions has also demonstrated its ability to provide the complete equipment package required for this procurement, including the specified radios, software capabilities, encryption features, accessories, chargers, and related equipment.

Although other manufacturers’ P25 radios may be technically interoperable, using equipment outside the established Motorola ecosystem could reduce the availability and effectiveness of technical support and could introduce additional support, configuration, and integration requirements. Maintaining the existing ecosystem therefore provides an operational and supportability benefit to the Embassy.

Market research was conducted to identify commercially available sources for the specified VX-P949 UHF-R1 Model 3 configuration. The research did not identify another established commercial source currently offering the complete configuration required. Secondary-market listings for VX-P949 radios were identified; however, these sources were not considered appropriate for this procurement due to the operational requirement for reliable equipment, appropriate warranty coverage, and dependable technical support. Vendors identified as offering VX-P949 accessories were not considered alternative sources because they did not offer the complete radio equipment required.

RDT confirmed that there is no current radio contract requiring the Embassy to purchase Motorola brand equipment and no contractual requirement to purchase from Motorola Solutions. Therefore, the basis for specifying the Motorola brand is the technical and operational requirement to maintain the existing, RDT-supported radio ecosystem, rather than a contractual requirement.

Based on the need to maintain continuity with the Embassy’s existing radio equipment, ensure continued support by local technical personnel and RDT, and obtain the complete VX-P949 configuration required by the Regional Security Office, Motorola equipment from the established Motorola Solutions source is considered the most appropriate source to meet the Embassy’s operational and support requirements.

SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
