About this file
This document is a Response to Questions related to RFP-158C-18, a repair solicitation for MBTA Kawasaki Commuter Rail Bi-Level Control Trailer Coach 1722 issued by the Massachusetts Bay Transportation Authority (MBTA). The repair work is to be completed within 6 months from the date the coach is received at the contractor's facilities. The RFP requires the contractor to identify and repair various body damage and system components on the coach, including the under-car section, receptacles and cables, lighting, ceiling panels, pull boxes, and junction boxes. MBTA will provide certain materials, while the contractor is responsible for other materials and completing the actual repair work.
The document addresses numerous clarifying questions submitted by the contractor, with MBTA providing detailed responses. Key details include MBTA allowing the contractor to invoice for "hidden damages" upon conditional acceptance of the coach, MBTA providing the required rubber products for window installation, and MBTA providing four complete sets of seat cushions. The contractor's Umbrella Liability Insurance requirement of $10 million was reduced to $5 million. Additionally, the contractor will not be responsible for preparing the coach for shipment, as that will be handled by MBTA/Keolis Commuter Services personnel.

RFP Technical Delaware Car Questions
1 2.2.4
CONTRACT DURATION: - Per this section the repair of car 1722 is to be completed in six (6) months from 'Notice to Proceed Date'. With the necessity to ship the car from MBTA property via 'freight railroads' and in most cases the move must be completed using two or more different freight railroads to complete the move from MBTA to Contractor's facilities there can be a significant delay in the
Contractor receiving the car once it has shipped from MBTA. The time it would take to receive the car if the Contractor's start date is based on the 'NTP' and not when the car actually is received at the
Contractor's facilities could reduce the time to complete the repair program by approximately 33% or more. Can the contract start date by revised to be the date the car is received at the Contractor's facilities?
Response
Forms
Attach, if applicable, a list of similar current contracts that demonstrates ???..'. This section seems to be the same as 'Items 'B and C' - in 'Form 'B' that is included in the MBTA Technical Specification - TS-
KRC-CTC1722 in the 'Experience' section. Please clarify if the information requested in both documents needs to be provided twice or will one submission meet the requirements for both forms?
We could add a note to the item in 'Form 'A'' that would state - 'See 'Attachment 'X' to Delaware Car
Company's Proposal for the Required Information'.
Insurance
Attachment
Item D
UMBRELLA LIABILITY INSURANCE - 'This section calls the 'Contractor' to carry and maintain
Umbrella Liability Insurance with limits not less than $10,000,000.00 per occurrence and annual aggregate, covering all work and services performed under the contract.' Delaware Car Company currently has Umbrella Liability Insurance coverage of $5,000,000.00. For a project that will be under
$500,000.00 for repair of car 1722 the Umbrella Liability Insurance of $10,000,000.00 seems excessive. Can this requirement be revised to an Umbrella Liability Insurance coverage of
$5,000,000.00?
