About this file
This is a Request for One Time Exemption from Competition submitted by the Idaho Department of Health and Welfare to the Idaho Division of Purchasing (DOP) for the procurement of Juvare EMSystems software for emergency preparedness. The exemption request, submitted by Agency Purchasing Representative JP Brady on July 1, 2016, seeks approval for a three-year direct procurement without competitive bidding. The Juvare EMSystems platform comprises four integrated programs: CORES Responder Management System, EMResource Per Capita, EMResource API/ADU, and EMResource HHS Reporting Interface. These systems support Idaho hospitals, medical centers, and volunteer medical corps by providing critical real-time data on hospital bed availability, ventilator capacity, ICU status, EMS availability, personal protective equipment inventory, and monoclonal antibody supply. The original software selection was competitively procured in 2018 under ITB18000761.
The total cost for the three-year exemption is $459,864.60. The Department justifies the exemption by asserting that ongoing maintenance, support, and licensing services are inherently sole-source due to the proprietary nature of Juvare's technical architecture, source code, and integration requirements. The software is critical for federal compliance with Public Health Emergency Preparedness and Hospital Preparedness Program mandates, and any service interruption or procurement delay would jeopardize federal grant funding and compliance with federal performance standards. The system was extensively utilized during the COVID-19 response and remains essential for managing the Strategic National Stockpile. The exemption was approved by the DOP Administrator on September 9, 2026, with additional conditions applied. The DOP also opened this exemption request to public comment, inviting suppliers to provide information supporting or contradicting the claim that competition would be impractical or unreasonable.

Request for One Time Exemption from Competition from
Idaho Division of Purchasing (DOP)
Agency Purchasing Representative (Name): JP Brady
E-mail/Phone: JP.Brady@dhw.idaho.gov 208-334-5999
Name of Agency: Health & Welfare (Department)
Request for the Purchase of: EMSystems LLC software
Cost (attach quote): $459,864.60
IDAPA 38.05.01.042.05 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.
Background
The Department maintains Juvare EMSystems software for emergency preparedness, originally procured competitively in 2018 (ITB18000761). The system supports Idaho hospitals, medical centers, and volunteers with critical data including hospital bed availability, ventilator capacity, ICU status, EMS availability, and PPE inventory. This software was used extensively during COVID-19 response and is required for federal compliance.
Description The EMSystems programs (CORES Responder Management System, EMResource Per Capita, EMResource API/ADU, and EMResource HHS Reporting Interface) support Idaho's hospitals, medical centers, and medical corps volunteers. This service is unique—no other company provides this same program. Data includes critical-care, medical/surgical-staffed, and tele-staffed hospital bed availability, ventilator and ICU capacity, emergency medical services availability, personal-protective-gear inventory, and monoclonal antibody supply.
The software is critical for Strategic National Stockpile administration and was extensively used during COVID- 19 response.
The system meets required federal mandates in statute and annual grant guidance. Failure to maintain the system results in loss of federal grant funds and inability to meet federal performance standards. Any procurement delay or service interruption would jeopardize federal compliance and risk losing critical Public Health Emergency Preparedness and Hospital Preparedness Program funding. The system provides daily situational awareness of hospital resources and enables the Department to pre-identify, register, credential, deploy, and demobilize volunteer health professionals during disasters.
Justification Competition is not possible for ongoing support, maintenance, and licensing of the existing Juvare EMSystems platform. The software is proprietary with unique technical architecture, source code, and integration requirements that only Juvare can service without voiding the warranty. While competition was feasible for the original software selection in 2018, ongoing maintenance and support services are inherently sole-source mailto:JP.Brady@dhw.idaho.gov https://adminrules.idaho.gov/rules/current/38/380501.pdf
07-01-16 due to the proprietary nature of the system. Alternative vendors cannot provide equivalent maintenance services for Juvare's specific platform, making this a true sole-source situation for continued operations.
Therefore, the Department requests a three (3) year exemption from competition for annual support, periodic upgrades, and licensing of the EMSystems software, as competitive bidding would be impractical given the proprietary nature of the system and would create unacceptable risks to Idaho's emergency preparedness mission.
