About this file

Summary

This is a Special Procurement Amendment (Amendment No. 3) submitted by the Department of Administrative Services, State Procurement Services (DAS SPS) on behalf of the Oregon Health Authority (OHA), Health Policy and Analytics Division. The request seeks approval to extend and amend Contract No. DASPS-1601-16 with Collective Medical Technologies, Inc. (CMT) for continued subscription, services, and access to the Collective Platform. The contract extension runs from January 1, 2027 through December 31, 2031 (five years), representing a continuation of services that provide real-time hospital event alerts to Oregon entities including Coordinated Care Organizations (CCOs), state Medicaid programs, long-term care offices, behavioral health teams, and other health care delivery organizations. The Collective Platform enables monitoring of Medicaid program operations and supports public health responsibilities including Multi-Drug Resistant Organism (MDRO) alerting under Oregon Administrative Rule 333-019-0052 and hemoglobinopathy notifications as mandated by Enrolled House Bill 2940 (2025). The amendment does not involve competitive bidding; rather, it extends the existing contract initially established through approved Special Procurement SP-1145-19 and its prior amendments.

The total estimated cost for the five-year amendment period is $8,425,606, increasing the contract's Not-to-Exceed amount from $14,440,234 to $22,865,840. Cost projections include $6,973,032 for CCO subsidy payments at $0.08 per Medicaid member per month; $885,882 for state program portals; $328,105 for HPA reporting; $68,355 for optional MDRO alerting; $115,548 for optional activation of ten new portals; and $54,684 for excess ad hoc reporting fees. All cost estimates incorporate maximum annual Consumer Price Index (CPI)-tied price increases of up to 3 percent as permitted under the existing contract terms. The special procurement justification rests on CMT's exclusive data agreements with every Oregon hospital, which cannot be replicated by competitors, ensuring uninterrupted access to critical real-time hospital notifications. DAS SPS will post public notice on OregonBuys for a seven-calendar-day protest period; if no sustained protests are received, the contract amendment will proceed following Enterprise Information Services endorsement and Oregon Department of Justice legal sufficiency approval.

a. Amendment Request:

DAS SPS, on behalf of OHA/HPA, requests approval of this Special Procurement (SP) request No. REQ-DASOBO-00238276, Amendment No. 3 (SP AMD-3) to amend Contract No. DASPS- 1601-16 (OHA No. 148728) (Contract) for the Collective Platform from Collective Medical Technologies, Inc. (CMT), by extending for five (5) years and increase the Not-to-Exceed (NTE) by $8,425,606 to a new total contract NTE of $22,865,840.

b. Background:

On October 28, 2021, SP No. REQ-DASOBO-00015863, Amendment No. 2 (SP AMD-2) was approved to extend Contract No. DASPS-1601-16 for an additional five (5) years and increase the NTE. The SP AMD-2 notice to the public on OregonBuys® under No. S-DASOBO-00000587 was released on October 29, 2021 and closed on November 8, 2021. No protests were received.

Table 10.b.(1) below reflects a breakdown of approved increases to the Contract NTE since Contract execution relative to the Contract and the five (5) executed Amendments:

c. Current Need:

DAS SPS, on behalf of OHA/HPA, requests approval to extend the Contract for up to five (5) years and increase the NTE by $8,425,607. The extension of time will allow OHA/HPA and entities accessing the Collective Platform under this subscription to continue accessing critical real-time hospital event alerts for their members or patients. OHA’s Collective Platform subscription makes the services available to Oregon entities, including state programs that provide care coordination to Medicaid enrollees, such as Coordinated Care Organizations (CCOs), local Oregon Department of Human Services (ODHS) long-term care field offices, local ODHS intellectual and developmental disabilities care management entities, and key behavioral health care teams (including Assertive Community Treatment).

OHA receives hospital event data from CMT for monitoring health care delivery in Oregon and specifically for oversight of the operation of the Medicaid program. Entities that may access the Collective Platform during the term of the Contract include, at the discretion of OHA/HPA, any governmental or private entity that provides care coordination to a client base inclusive of Medicaid enrollees, that provides services relating to health care delivery or health services program oversight, or that provides public health services.

d. Proposed Contracting Procedure:

1. DAS SPS will issue a public notice on the State of Oregon’s eProcurement system, OregonBuys®, as required by Oregon Administrative Rule (OAR) 125-247-0287, for a seven

(7) calendar day period, regarding approval of the SP AMD-3 Request.

2. Advertisement of the approved SP AMD-3 will include provisions that any Affected Person(s) may protest the approval of the SP AMD-3 Request.

3. DAS SPS will respond to and resolve protests, if any.

4. If no protests to this approved SP AMD-3 are received and sustained, DAS SPS, on behalf of

OHA/HPA, will proceed with amending the existing Contract to add compensation and extend the end date to December 31, 2031.

5. DAS SPS will obtain Enterprise Information Services (EIS) endorsement before executing the next Contract amendment, as required.

6. Pursuant to ORS 291.047 and OAR 137-045-0015, DAS SPS will work with the Oregon Department of Justice (DOJ) to obtain legal sufficiency approval prior to executing the Contract amendment, as required.

11. Justification for use of Special Procurement: Describe the circumstances that justify the use of Special Procurement. Attach relevant documentation.

The Contract resulted from approved Original SP-1145-19 (Attachment 1), SP AMD-1 (Attachment 2) and REQ-DASOBO-00015863, SP AMD-2 (Attachment 3) and is, therefore, tied to the SP for the life of the Contract. The only procurement method available through which the Contract can be amended as described in this SP AMD-3, is an amendment to the original, approved SP, SP AMD-1 and SP AMD-2.

This SP AMD-3 continues to ensure uninterrupted services, including those mandated by Enrolled House Bill 2940 (2025) and OAR 333-019-0052, just as stated in the 2021 justification supporting SP AMD-2 and in this SP AMD-3.

The same justifications provided in the Original SP, SP AMD-1 and SP AMD-2 (Attachments 1-3) still apply.

12. Findings to Satisfy the Required Standards: This proposed special procurement:

___X___ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:

The data agreements that Collective Medical Technologies has in place with every hospital in Oregon is the key to real time notification services being effective. While the software may be replicated, access to the data could not. It is imperative that hospital emergency departments and other health care providers receive up to date and accurate data and notifications if their patients or members are in the hospital.

The same findings and supporting facts provided in the Original SP, SP AMD-1 and SP AMD-2 (Attachments 1-3) still apply.

and

______ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:

or

__X_ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:

REQ-DASOBO-00238276_AMD-3_(1145-19, AMD-1 & 15863, AMD-2)_CMT_OHA Page 5 of 6

Every hospital in Oregon is currently submitting data to, and using data from, the EDIE system to receive real-time hospital event notifications. OHA has already expanded resources to achieve and support statewide participation in EDIE by Oregon hospitals and to support adoption and use of the Collective Platform by Medicaid-serving organizations, including CCOs and state programs.

Extending the Contract promotes public interest by supporting public health responsibilities, where appropriate, by leveraging the statewide platform for notifications to health care providers and care coordinators for:

• Multi Drug Resistant Organisms (MDRO) responsibilities for OAR 333-019-0052; and

• Known hemoglobinopathy diagnoses as required by Enrolled House Bill 2940 (2025).

The same findings and supporting facts provided in the Original SP, SP AMD-1 and SP AMD-2 (Attachments 1-3) still apply.

13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request submitted through OregonBuys®. Agency may elect to attach a signed Request as a pdf file through OregonBuys® or submit a signed hard copy Request.

Signature: e.g. Electronically in OregonBuys® _________________ Name/Title: Date:
