About this file

This is a Request for Special Procurement (SP-1145-19) submitted by the Department of Administrative Services, Procurement Services (DAS PS) on behalf of the Oregon Health Authority (OHA) to renew and extend a subscription contract with Collective Medical Technologies for real-time hospital notification services via the Collective Platform (formerly PreManage). The procurement seeks to extend the existing Contract No. DASPS-1601-16 through December 31, 2021, with a contract term spanning January 1, 2020 to December 31, 2021 (two years). The Collective Platform is a subscription-based notification software that leverages data from Collective Medical Technologies' Emergency Department Information Exchange (EDie) system, currently operating across all Oregon hospitals with emergency departments. The service provides real-time hospital event notifications to subscribers including health plans, providers, Coordinated Care Organizations (CCOs), state programs, and local long-term care field offices serving Medicaid enrollees. Users access hospital utilization information through a web portal or integrated electronic health record systems and may customize alerts based on specific criteria. DAS PS will issue public notice on the Oregon Procurement Information Network (ORPIN) and allow a seven-day protest period before finalizing the amendment and extension.

The total estimated cost for the two-year renewal period is $2,970,560, which will increase the existing contract's not-to-exceed amount from $3,320,000 to $6,290,560. Quarterly costs are broken down into CCO subsidies at $0.08 per Medicaid member per month ($1,991,235 total), State Programs ($324,000), Research and Analysis Reports ($120,000), Multidrug-Resistant Organism Reports ($25,000), and Skilled Nursing Facility subscriptions at $3,725 per site for up to 137 sites ($510,325). The special procurement is justified under Oregon procurement rules because Collective Medical Technologies holds exclusive data agreements with all Oregon hospitals, making their EDie system the sole health information exchange hospital event notification service operating statewide. OHA has already invested significant resources in statewide EDie participation by Oregon hospitals, and selecting an alternative vendor would create redundancy, require re-negotiation of data interfaces with all hospitals, and result in substantial additional expense. The procurement does not encourage favoritism or diminish competition because the underlying data access cannot be replicated by competing vendors.

9. Title: Supplies and/or Services to be Acquired:

Real time hospital notification services, Collective Platform (formerly known as PreManage) Subscription Renewal

10. Request, Background and Proposed Contracting Procedure:

a. Request:

DAS PS, on behalf of OHA, requests approval of this Special Procurement for a 2-year term to extend Contract No. DASPS-1601-16 with Collective Medical Technologies through December 31, 2021 and to increase the not-to-exceed (NTE) of $3,320,000 by $2,970,560 for a new NTE of $6,290,560 for real time hospital notification services via renewal of Collective Platform Subscription.

b. Background:

Collective Platform (formerly known as PreManage) is a subscription-based notification software service that leverages data from Collective Medical Technologies' Emergency Department Information Exchange (EDie) system that is currently operating in Oregon. All hospitals in Oregon with emergency departments are contracted with Collective Medical to use EDie and contribute ED and Inpatient Admit, Discharge, transfer (ADT) data to populate hospital event notifications in real-time. Collective Platform uses the EDie data to provide real-time hospital event notifications to subscribers outside a hospital system, such as health plans and providers (Users), for a predetermined panel of patients. Users define their patient panel by providing an eligibility file to the vendor, which is updated regularly. Once activated, Users are then able to view hospital utilization information for their patients through the Collective Platform web portal or integrated through an electronic health record system. Users may also customize alerts based on specific criteria or method of alert using Collective Platform.

The original Sole Source, SS-509-15, was created and approved by the Oregon Health Authority’s Designated Procurement Officer (DPO). DASPS-2176-15 was noticed to the public in ORPIN on December 23, 2015 and closed on January 4, 2016, with no protests received. Contracting and

SP-1145-19 Page 2 of 5 procurement authority for OHA is now under DAS PS for Information Technology supplies and services, which requires a new procurement method to be noticed to the public.

DAS PS, on behalf of OHA, intends to renew the subscription to Collective Platform, via Contract No.

DASPS-1601-16, and allow Medicaid Users to continue with subscriptions to access real-time Collective Platform alerts for their members or patients. OHA makes the subscription available to Oregon entities, including state programs, that provide care coordination to Medicaid enrollees, such as Coordinated Care Organizations (CCOs), local long-term care field offices, and key behavioral health care teams (Assertive Community Treatment). There is no additional charge to Medicaid Users for this access, but they are able to contract with CMT for any additional services desired required beyond that offered under the OHA subscription. For example, CCO s may choose to sponsor subscriptions for their key clinics and practices.

While OHA will oversee the subscription agreement and general progress, Users outside the state will be responsible for managing their day-to-day access directly with CMT. Users outside the state are required to have their own direct data use agreements. In addition to the Users, OHA will receive hospital event data from the vendor for monitoring health care delivery in Oregon and specifically for oversight of the operation of the Medicaid program.

The initial Collective Platform contract with OHA covered calendar years 2016 and 2017, in alignment with the EDie Utility project period. The EDie Utility was extended beyond 2017, and this subscription renewal aligns with that renewal. Per the original sole-source, OHA may choose to extend the Collective Platform subscription if state/federal funding is available.

The total estimated cost for the amendment period requested for these services will be:

c. Proposed Contracting Procedure:

• DAS PS will issue a public notice on the Oregon Procurement Information Network (ORPIN) as required by OAR 125-248-0287 regarding approval of this Special Procurement (SP) 1145-19 that includes a process by which an affected person may protest.

• At the completion of the seven (7) day notice period, if no protests to the SP are received and sustained, DAS PS on behalf of OHA, will negotiate an amendment and extension to the Collective Medical Technologies Contract as described above.

11. Justification for use of Special Procurement

• This program provides critical support for the Coordinated Care Organizations (CCOs), Medicaid Care management contracts, and Medicaid-serving state programs.

• The Centers for Medicare and Medicaid Services (CMS) would likely not support, nor fund a duplication of efforts should a new vendor be selected.

• Collective Medical Technologies' Emergency Department Information Exchange (EDie) system is the only health information exchange (HIE) hospital event notification (HEN) operating in Oregon across all hospitals with emergency departments.

• Collective Platform uses the EDie data to provide real-time hospital event notifications to participating health organizations and state programs serving Medicaid enrollees.

• Users are able to view hospital utilization information for their patients through the Collective Platform web portal or integrated through an electronic health record system.

• The Collective Platform supports care coordination across a continuum of critical Medicaid providers including primary care, behavioral health, dental, and long-term services and supports.

12. Findings to Satisfy the Required Standards: This proposed special procurement:

_X_ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:

The data agreements that Collective Medical Technologies has in place with every hospital in Oregon is the key to the real time notification services being effective. While the software may be replicated, the access to the data could not.

and

____ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:

or

_X__ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:

Every hospital in Oregon is currently submitting data to, and using data from, Collective Medical’s EDie system to receive real-time hospital event notifications for high-utilizers of Emergency Department (ED) services. OHA has already expended resources to achieve and support statewide participation in EDie by Oregon hospitals. Oregon has also already invested in Collective Platform to expand EDie's real time

SP-1145-19 Page 4 of 5 notifications beyond just EDs. Vendors of other notification services would be highly unlikely to obtain agreement from hospitals to reproduce the data interfaces with Oregon hospitals needed to replace EDie, and any new interfaces and implementation that could occur would lead to redundancy and extra expense.

A statewide Medicaid subscription to Collective Platform, expanded the EDie service by providing real-time notifications to CCOs, fee-for-service care managers, state programs such as long-term care and intellectual/developmental disability providers, tribal clinics and key behavioral health partners. Subscribing to Collective Platform maximizes the investment made in EDie, and maximizes the value of information contained within the EDie database to improve coordination of Medicaid services across the continuum of care.

13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request if it is submitted through ORPIN. Agency may elect to attach a signed Request.

Signature: e.g. Electronically in ORPIN _________________ Type Name Date
