About this file

Summary

This is a Special Procurement Request approval document for the State of Oregon involving LinkedIn Flex Learning services for the Chief Human Resources Officer (CHRO). The procurement requests access to LinkedIn Learning's online training platform to provide flexible, self-directed learning opportunities for state employees. The request outlines the need for comprehensive digital learning content spanning professional development, technical skills, and leadership training. No specific response deadline, bidder's meeting, or contract term duration is explicitly detailed in the available documentation. The procurement represents a specialized services acquisition designed to enhance workforce development capabilities across the state organization.

The pricing structure and specific financial terms are not fully detailed in the provided summary documentation. This procurement appears to be a single-source or limited-competition request, as indicated by the "Special Procurement Request" designation, which typically allows for non-competitive procurement when specific justification exists. The contract would be funded through the state's operational budget allocated to human resources and employee development initiatives. The approval by the CHRO indicates executive-level authorization and underscores the strategic importance of digital learning infrastructure for statewide workforce capability enhancement.

10. Request, Background, Current Need, and Proposed Contracting Procedure:

a. Request:

DAS SPS, on behalf of CHRO, requests approval of this Special Procurement (“SP”) Request No. REQ- 10700-00179468 to direct award and negotiate a contract or price agreement (Contract) for up to nine

(9) years with LinkedIn Corporation, for the Tools and Services listed in section 9 above.

b. Background:

LinkedIn Flex Hiring Program Recruiting hard to fill positions, such as Information Technology (“IT”), Accounting and Executive level roles, has become difficult. Through the use of advanced analytics, Artificial Intelligence (“AI”) driven sourcing, and collaborative tools, this Program will allow state agencies to easily identify candidates with the right skills and experience, and access LinkedIn’s network of more than 1.1 billion members, reducing

SP_REQ-10700-00179468_LinkedInFlex&Learning_CHRO_v2 Page 2 of 5 time-to-fill and cost-per-hire, while strengthening employer branding and building diverse pipelines— critical for staying competitive.

The LinkedIn Flex Hiring Program also allows the State to connect with passive candidates, who are not actively looking for new roles, but would be open to the right opportunity.

There is the potential of connecting the Program with Workday, the State’s current Human Capital Management (“HCM”) system.

LinkedIn Learning LinkedIn Learning will allow CHRO to expand the training and learning opportunities available to state employees. CHRO is responsible for the development of learning content for up to 45,000 employees with limited staffing capacity. Leveraging LinkedIn Learning resources available to all state employees allows the State to proactively meet existing and emerging employee training and development needs.

There is the potential to connect LinkedIn Learning to Workday for employees to easily access and track their learning. LinkedIn Learning also has the capability to customize training for employees.

c. Current Need:

Recruiting, hiring and retaining niche positions is challenging in the current job market. Using the Tools and Services provided by LinkedIn will assist state agencies in not only recruiting and hiring but also retaining employees by making available on-demand training related to their current career, as well as access to trainings to begin a new career path. There are 17 agencies across the State of Oregon enterprise with immediate need for this program: 37 Recruiter Seats and 70–80 job slots monthly. Many agencies already contract with LinkedIn individually; a Contract for LinkedIn Flex Hiring Program would eliminate the need for individual state agencies to enter into separate duplicative agreements, reduce State costs, and expand access for agencies previously limited by budget. A Contract would provide the State with flexibility to add more recruiter seats and learning licenses without having a price increase.

The Program comes with 10-weeks of implementation consultation to ensure successful implementation.

If an agency were to contract directly with LinkedIn, they would not be able to take advantage of the Flex Hiring Program. They would have to purchase the services A La Carte. A La Carte includes the following:

73 job slots

Job wrapping

37 recruiter licenses

1 premium career page

1 basic career page

Work with us ad

If the agency were to need a dedicated customer service manager, implementation consultant and traffic driver ad campaigns, those would be an extra cost, as well as paying for additional job slots if they had more than 73 recruitments for any one year.

The State of Oregon anticipates 30% of the current workforce will be eligible for retirement within the next five years. This turnover possibility creates significant training and resource needs across the enterprise to prepare employees for future organizational needs. The training development and resources needs to support the enterprise exceeds CHRO’s internal resource capacity. Leveraging

SP_REQ-10700-00179468_LinkedInFlex&Learning_CHRO_v2 Page 3 of 5 resources from LinkedIn Learning and other organizations will allow CHRO to meet existing and future training needs proactively. LinkedIn Learning provides employees and managers with timely and easily accessible resources.

d. Proposed Contracting Procedure:

1. As required by Oregon Administrative Rule (“OAR”) 125-247-0287, DAS SPS will issue a public notice (the “Notice”) of this SP approval on OregonBuys® for a period of seven (7) calendar days.

2. The Notice will include provisions that any Affected Person(s) may protest the approval of this SP.

3. SPS will respond to and resolve all protest(s) of this SP, if any.

4. If no protests are received and sustained, SPS will proceed with direct award and negotiation of a

Contract with LinkedIn as set out in Section 10.a above.

5. SPS will work with DAS Enterprise Information Services (“EIS”) and obtain its endorsement prior to executing the Contract, if required.

6. As required by Oregon Revised Statute (“ORS”) 291.047 and related administrative rules, SPS will work with the Oregon Department of Justice (“DOJ”) and obtain required approval prior to executing the Contract.

11. Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.

The Tools and Services outlined in Section 9 (above) are the intellectual property of – and solely available from – LinkedIn.

Oregon’s Public Contracting Code (the “Code”), set out in ORS Chapters 279A, 279B, and 279C, is predicated on the principles of competition. However, it has been established that the Tools and Services outlined in Section 9 (above) are only available from LinkedIn. Therefore, outside of ORS 279B.065 Small procurements, which limits the maximum compensation of a direct awarded contract to $25,000, there are only two procurement methods defined in statute through which the request articulated in this document can be solicited and approved:

o ORS 279B.075 Sole-Source procurements o ORS 279B.085 Special procurements

Sole Source procurement was not chosen due to the inability to amend the Sole Source should there be any changes to scope or estimated cost of the Tools and Services.

12. Findings to Satisfy the Required Standards: This proposed special procurement:

___X___ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:

No other entity has access to LinkedIn’s Hiring Enterprise Program & LinkedIn Learning.

No other entity has same capabilities and products as LinkedIn. Capabilities and products such as:

o Reaching passive candidates o Executive level hiring and specialized job skills

SP_REQ-10700-00179468_LinkedInFlex&Learning_CHRO_v2 Page 4 of 5 o Includes direct messaging to connect directly with candidates o dedicated State of Oregon website to post jobs (which directs candidates to Workday to apply for the position) o Integrated talent management (LinkedIn Learning integrates with LinkedIn’s Hiring

Enterprise Program allowing hiring managers to view interested internal candidates) o LinkedIn publishes over 60 new courses every week to LinkedIn Learning.

o LinkedIn Learning helps to identify and close skills gaps, while tracking development toward skills.

o LinkedIn Learning has the ability to pair a learner’s LinkedIn Learning profile with their

LinkedIn.com profile.

and

__ X ____ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:

Cost Savings (Hiring Enterprise): Currently there are 17 state agencies who are interested in a contract with LinkedIn. If each agency were to enter into a contract with LinkedIn separately, for year one would be a cost of $640,561. For a three-year contract the total would be $2,079,516 (this includes a 5% annual increase). Agencies would also need to pay for each individual A La Carte product and service that is included in LinkedIn Hiring Enterprise Program. Entering into a PA with LinkedIn for the Flex Hiring Program would make all of the products available to all state agencies. The cost of LinkedIn Hiring Enterprise Program for each agency will be included in their biennial assessment paid to CHRO. The anticipated annual cost under the Contract is estimated to be $507,515 per year. For a three-year contract the total would be $1,731,189. Saving agencies $348,327 over three years.

Cost Savings (LinkedIn Learning): If state agencies were to contract with LinkedIn individually for their learning platform, the cost per license would be $11, with a 5% annual increase. For a three-year contract, the cost per license would be $12.83, for a total contract price of $1,606,968. The price per license under a PA is estimated to be $4.70 for the first year, $5.98 for year two, and $7.36 for year three, with a total contract price of $812,397. This is a savings of $794,571 over a three-year period.

or

___ ___ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:

13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request if it is submitted through OregonBuys®. Agency may elect to attach a signed Request.
