About this file
This is a Memorandum of Understanding template from the Massachusetts Division of Insurance governing the reference process for resolving disputes over fire insurance claim loss amounts under Massachusetts General Law Chapter 175, Sections 99 through 100H. The memorandum establishes the framework by which the Division, an insurance company, an insured party, and three appointed referees collaborate to ascertain the amount of loss when the insured and insurance company disagree on a fire insurance claim. The document outlines the procedural requirements for referee selection, including that referees must be disinterested Commonwealth residents, and addresses the conditions under which prior service within four months requires written consent from the other party. Within ten days of the third referee's appointment by the Commissioner, the three referees shall convene to hear evidence, with hearings potentially adjourning weekly but resuming within one week unless unanimously agreed otherwise. The referees shall issue a signed, written decision in duplicate determining the amount of loss, with the majority decision being conclusive and binding on all parties. The memorandum also specifies that referees must examine any reference agreements to ensure terms are fulfilled and that they are not required to sign agreements detrimental to either party's interests.
The memorandum delineates cost allocation based on the award outcome: each party pays their respective referee's reasonable charges and expenses, while if an award favors the insured, both parties split the third referee's compensation and expenses equally; conversely, if an award favors the insurance company or no award is rendered, the insurance company bears the full cost of the third referee. The third referee must submit a detailed statement to the Division within five days of the final decision, including travel time, number of meetings, and award details. Either party aggrieved by the third referee's charges may petition the Commissioner for review, with the Commissioner's decision being final and conclusive. The document also notes that willful non-compliance with applicable Massachusetts law provisions by the insurance company or its representatives may result in fines ranging from $100 to $500.
