About this file

This is a Memorandum for the Record documenting the use of other than full and open competition for a simplified acquisition threshold procurement.

The contractor shall perform all inspections, certifications, and maintenance requirements for Hyster Material Handling Equipment (MHE) forklifts at Building LP-26 Naval Station Norfolk. The period of performance is 18 September 2026 through 17 September 2027. The required source is Hyster approved laptop diagnostic troubleshooting software, hardware, and diagnostic procedures for Hyster brand MHE forklifts. The memorandum identifies multiple justifications for sole source procurement: brand name requirement (Hyster is the shipboard-approved MHE forklift OEM), standardization requirements to maintain fleet configuration baseline across T-AO Class, T-AKE Class, and T-ESB Class vessels using the E40XNG model, and urgency. The requirement was identified on 5 August 2026 with a delivery date of 18 September 2026, reflecting an urgent need arising from an unexpected massive shipment of forklifts. The contractor must have specific experience working on MSC four-wheel braking systems on shipboard-approved forklifts and demonstrate capability to train MSC personnel on brake adjustment. The certification emphasizes that MHE must be safety certified to prevent work stoppages that would impact the overall mission, prevent serious injury or death to personnel, and avoid damage to ship and government property. Technical Support Specialists and Consultation (TSS&C) is identified as the known Hyster service distributor with access to proprietary information and drawings that the Government does not possess.

ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

Ref: (a) PID Number: _

1. BACKGROUND:

a. For purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, items particular to one manufacturer).

b. As required by FAR 12.102(a) or GSAR 538.7104-3 and -4, this memorandum documents the decision that only one source is or limited sources are available and the basis for the decision.

The requirement does not exceed the simplified acquisition threshold.

2. DESCRIPTION OF PRODUCT OR SERVICE:

a. Description: Contractor shall perform all Inspections, Certifications and maintenance requirements of Hyster Material Handling Equipment (MHE) Forklifts.

b. Required delivery date or period of performance: 18 September 2026 – 17 September 2027

c. Intended use: Pre-delivery inspection, safety certification of Military Sealift Command (MSC) Hyster MHE Forklifts.

3. DETERMINATION (select A, B, or C):

MSC Version 3.0 (dtd 6 Feb 2026)

(1) RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the product or service. Explain what rights are restricted, why the restrictive rights make the required item or service available from only one source, and why another company could not satisfy the Government’s need.

(2) EXCLUSIVE LICENSING AGREEMENTS: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM. (Complete only a or b below)

(a) Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.

(b) Identify the distributor / authorized technical representative for the item or service. Provide evidence of the exclusive licensing agreement as an attachment to this document.

(3) STANDARDIZATION: Per COMSCINST 4790.3, to maintain fleet configuration baseline, only the specified make/model of the equipment/parts will satisfy the Government’s needs for additional units or replacement items.

(a) Make and Model: Hyster Shipboard approved Forklifts / E40XNG

(b) Other vessels with this Make / Model: T-AO Class, T-AKE Class, T-ESB Class

(4) COMPATIBILITY: Product is direct replacement part(s) for existing equipment and must be compatible. Make and Model:

(5) OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source. Services to MHE shall be performed ashore at Building LP-26 Naval Station Norfolk. The Contractor’s needs to have worked on MSC four-wheel braking systems on shipboard approved forklifts and be able to demonstrate / train MSC personnel on how to adjust brakes. This will allow many USNS SHIPS to get underway with a full complement of operational certified MHE.

Material Handling Equipment (MHE – Forklifts) are used daily to move supplies (stores), used at UNREP stations, and Ammunition movements. If MHE is not Safety Certified for shipboard use, the ships overall mission would be at a work stoppage until Safety Certification is completed. Forklifts need to be Safety certified (Brakes/Lift Cylinders/EMI-sparks/Grounding strap ect..) to prevent Serious injured or death to personal and damage to ship/government property.

b. BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer. Hyster is the brand name Shipboard approved MHE forklift.

Hyster is the Original Equipment Manufacturer. Technical Support Specialists and Consultation (TSS&C) is the known Hyster service distributor and has access to proprietary information/drawings. The Government does not own or have access to proprietary information/drawings.

(1) STANDARDIZATION: Per COMSCINST 4790.3, to maintain fleet configuration baseline, only the specified make/model of the equipment/parts will satisfy the Government’s needs for additional units or replacement items.

(a) Make and Model: Hyster Shipboard approved Forklifts / E40XNG

c. URGENCY (C3/C4 Casualty Report). As defined in Naval Warfare Publication 1-03-

1, the supplies or services are of such urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent requirement is based on the following:

(1) Date on which the requirement was identified: 5 August 2026

(2) Required delivery date or period of performance: 18 September 2026 – 17 September 2027.

(3) Explanation of why delivery/commencement of services by the date mentioned above is required. Hyster gave no warning massive number of forklifts were shipped – MHE team was busy trying to figure out location(s) to put all MHE.

(4) If appropriate, include any additional pertinent information.

(5) CASREP Number:

4. CERTIFICATIONS AND APPROVALS:

a. Technical / Requirement Certification: I certify that the facts and representation under my cognizance, which are included in this justification are complete and accurate to the best of my knowledge and belief.
