FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval

Contracting Activity: U.S. Army Contracting Command-Redstone-Letterkenny Army Depot (LEAD), CCAM-MLK, Chambersburg, PA 17201-4150.

Description of Action: Letterkenny Army Depot (LEAD) request approval to award a new firm fixed priced contract to Power Test Incorporated (N60 W22700 Silver Spring Drive, Sussex, Wisconsin 53089) on a sole source basis. The Government projects award of this Action on 202 . AWCF customer funds will be used on this procurement. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d) (i) (B).

Description of Supplies/Services: This requirement is for the purchase of a portable mobile dynamometer system containing two containerized dynamometers and one containerized cooling system. The system is a necessary part of the new US Army Communication-Electronics Command (CECOM) workload that is being performed at LEAD. CECOM generators will be disassembled, the engines will be re-machined and rebuilt. The dynamometers will be used to performance test the engines to ensure they will perform as required as part of the generators. The estimated project duration is approximately 28 weeks from the date of contract award. The estimated value of this proposed procurement is $ . The contract will not include an option provision.

Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5.

Reason for Authority Cited: Procurement by other than full and open competition is necessary because of the proprietary nature of this equipment. The equipment is mobile and can be moved from the proposed location to any other location as needed. These will not be permanent components of the building. Traditional dynamometer systems that are installed in a building have major cost upgrades to building such as foundation, intake and exhaust ventilation, cooling water, and fire suppression. With the modular mobile system, each cargo container is self-contained. Modifications to the building are not necessary. The only building connections required are for utilities, power and water. A similar dyno system that is a traditional semi-permanent installation in a building with all of the mentioned upgrades would cost approximately $1.3M-$1.4M. The building upgrades would be approximately cost $200,000 of that total. This is an unreasonable investment in building 57 because the building is leased by LEAD.

Due to Power Test having the sole unique design of modular mobile dynamometer components, it is necessary to request a sole source contract to Power Test Inc., N60 W22700 Silver Spring Drive, Sussex, Wisconsin 53089, CAGE Code 9W788, to ensure the successful completion of this project. This design has the complete dynamometer cell built into a metal 20’ shipping container. This allows the dyno cell to be located anywhere outside utilities can be connected. Where the traditional dyno cell is permanent inside a building with major upgrades to the building, the containerized dyno cell can be moved to where it is needed to be used. Power Test is the only manufacturer with the modular mobile design of dynamometer system components to allow flexibility of location.

Letterkenny Army Depot asserts that the Dynamometer is critical to meeting the demands of the CECOM workload. Failure to approve the sole source justification will result in an incapability to meet mission requirements to test the performance of the engines for the CECOM generators. Although other alternatives are available for permanent structures it is cost prohibitive and would create the need for permanent changes to a leased building and would impact the locations of future programs by limiting the capability to have a mobile unit.

6. Efforts to Obtain Competition: No effective competition is anticipated for this acquisition. Market Research shows there are no other supplies that can meet the requirement. The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered. At this time, no responses in writing have been received and no effective competition is anticipated for this acquisition due to the proprietary nature of this Dynamometer system; however, all responses to the posting will be considered.

b. Subcontracting competition. No subcontracting plan is required as this will be sole source to a small business in accordance with FAR 19.702(b)(1).

7. Actions to Increase Competition: No action is currently planned by LEAD to increase competition on subsequent buys since none are planned at this time Power Test is the only dyno manufacturer that has a mobile dyno system which allows LEAD not to make expensive upgrades to a building (57) that it leases and doesn’t own.

8. Market Research: In accordance with FAR Part 10, , Industrial Engineer, Production Engineering Division, Directorate of Operations, Planning, Support (DOPS);

and , Electronics Engineer, Production Engineering Division, Directorate of Operations, Planning, Support (DOPS) used personal knowledge in procuring supplies/services of this type. They also contacted Rob Kazmier, Senior Sales Engineer, Power Test, Inc., on 30 Oct 2020 who is knowledgeable in government and industry regarding market capabilities. Numerous internet searches for mobile Dynamometer systems were conducted by both LEAD and contracting personnel. Due to the unique design of the dyno system, no other contractor has been identified that can perform this action. This is a commercial item acquisition therefore FAR Part 12 will be used.

In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought was posted to Federal Business Opportunities

(FBO) on 23 February 2021 for seven days. No other sources expressed a written interest in the acquisition.

Interested Sources: To date, no other sources have been written to express any interest. It would be a duplication of costs for a vendor to reverse engineer the modular containerized dyno system to include all of the systems and form, fit and function of the system. Currently, there are no other sources with this portable design. Notices required by FAR 5.201 shall be published, and any bids or proposals received shall be considered. The anticipated time of FBO synopsis is 2021.

Other Facts: The Power Test modular dynamometer systems have been purchased by multiple departments of the Department of Defense by and are currently being used CONUS and OCONUS by the Army and USMC. However, this equipment has not been previously been procured by LEAD.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. This determination will be made using price analysis and comparing the current vendor proposal to the Independent Government Cost Estimate (IGCE). This acquisition does not meet the threshold in FAR 15.403-4 for obtaining certified cost or pricing data and is exempt from the requirement in accordance with FAR 15.403-1(b)(3).
