JUSTIFICATION AND APPROVAL

PIXEDIT SOFTWARE SUBSCRIPTION RENEWAL

The requirement for PixEdit subscription software renewal will consist of one 12-month base period, and two 12-month Option periods as listed below:

Base Year: July 1, 2025 – June 30, 2026 Option Year One: July 1, 2026 – June 30, 2027 Option Year Two: July 1, 2027 – June 30, 2028

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 “Only one Responsible Source and no other supplies or services will satisfy agency requirements”. PixEdit subscription software licenses are a brand name product of PixEdit. No other firm can provide this brand name product due to the proprietary nature of the software. Use of this brand name description in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product of another company.

A brand name item peculiar to PixEdit is essential to the Government’s requirement because other products do not meet or cannot be modified to meet the Agency’s needs without assuming unnecessary operational risks. Per market research performed by the Contracting Officer Representative, PixEdit USA, is the only authorized reseller of PixEdit software for the United States Government Department of Defense and their contractors.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF THE

CITED AUTHORITY:

PixEdit is used to support customer capability to convert scanned gray scale or color documents into monochrome files. Documents that previously had to be redrawn due to low readability can be scanned, threshold and stored in the Document Management System (DMS). This allows for better quality documents for our customers during the solicitation phase. DLA workers may use document images and not have to recreate images, to make changes, therefore saving manhours and money.

In accordance with FAR 6.302-1, brand name PixEdit subscription software from PixEdit USA as a sole source is essential to the Government’s requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency’s requirements.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

Per the OEM, PixEdit USA is the only authorized reseller of PixEdit software for the United States Government Department of Defense and their contractors. Should this change in the future, all authorized dealers will be given an opportunity to submit an offer.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within

OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT

ACQUISITION FOR SUPPLIES OR SERVICES:

DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government.

Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure continued Full and Open competition. Requirements will continue to be posted on Sam.gov to ensure fair opportunity is given and no other providers are available.
