About this file

This is a Scope of Services document for Phase I Environmental Site Assessments (ESAs) issued by the Massachusetts Department of Developmental Services (DDS) for nine residential properties located in Southeastern Massachusetts. The project requires qualified environmental consultants to conduct comprehensive Phase I ESAs on these homes, which involve site inspections, historical records review, and environmental risk assessment in accordance with ASTM E1527-21 standards. The scope encompasses detailed documentation of each property's environmental conditions, identification of recognized environmental conditions (RECs), and preparation of professional assessment reports for each site. The document specifies requirements for qualified Environmental Professionals and establishes protocols for site access, data collection, and reporting procedures necessary to support DDS's residential property portfolio management and due diligence obligations.

The assessment services are structured to meet Massachusetts regulatory standards and DDS operational requirements for environmental compliance documentation. The scope requires bidders to demonstrate expertise in conducting Phase I ESAs on residential properties and familiarity with Southeastern Massachusetts geographic and environmental conditions. Contractors must ensure reports comply with applicable Massachusetts environmental regulations and provide defensible documentation suitable for property management decisions. The contract terms, pricing structure, and specific performance timelines are detailed within the document to establish clear expectations for service delivery, quality standards, and contractual obligations between DDS and the selected environmental consulting firm.

4.0 SCOPE OF WORK

Task 1 -- Phase I Environmental Site Assessment:

The Consultant will complete a Phase I Environmental Site Assessment for each of the single-family properties noted above. The Assessments will be completed in general accordance with the guidelines set forth in the American Society for Testing and Materials (ASTM) publication E1527-21, “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process”. The purpose of the Phase I ESAs is to identify “Recognized Environmental Conditions (RECs)” in connection with the properties. RECs, as defined by the ASTM E1527-21, means “…the presence of hazardous substances or petroleum products in, on, or at the subject property”

1. Due to a release to the environment;

2. Under conditions indicative of a release to the environment; or

3. Under conditions that pose a material threat of a future release.

The Consultant will provide a professional opinion regarding RECs at the properties based upon the following, as available: (1) information obtained from interviews with people knowledgeable about the property regarding the current and former operations/uses; (2) from the records/files reasonably available for review from federal, state, and local sources; and (3) from visual observations of property-specific and surrounding features and conditions.

Building materials have not been surveyed under a previous scope of services. The Consultant is to document the locations and types of suspect hazardous materials and wastes in an initial “Red Flag” memorandum, to be followed by remediation or abatement steps, if required, in a recommendation letter.

Task 1.1 - Federal and State File Review

The state and federal records, listed below, shall be reviewed using available computer database resources to identify RECs at and near the properties. The approximate search distances from the properties are also noted below. Please note that DCAMM has added additional databases that the Consultant is required to review and assess.

• Federal National Priorities List (NPL) (1.0 mile);

• Federal Resource Conservation and Recovery Act (RCRA) corrective action (CORRACTS) and non-CORRACTS Treatment, Storage and Disposal (TSD) facility list; (1.0 miles and 0.5

~ 4 ~ mile, respectively);

• Federal Comprehensive Environmental Response, Compensation, and Liability Information

System (CERCLIS) listing (0.5 mile);

• Federal RCRA generators list (property and adjoining properties);

• Federal Emergency Response Notification System (ERNS) list (property only);

• State-listed hazardous waste disposal sites (1.0 mile);

• State listing of oil and/or hazardous material spills (0.5 mile);

• State listing of landfills and/or solid waste disposal sites (SWL); (0.5 mile);

• State registered leaking underground storage tanks (LUSTs) (0.5 mile);

• State-listed Source Registration (Property and adjoining properties);

• State registered Petroleum Waste Generator (property and adjoining properties)

• State-listed Greenhouse Gas Generator (property and adjoining properties);

• Massachusetts Department of Public Health environmental and/or air quality assessments for the property;

• State listing of Private Drinking Water (SearchWell) for property and adjoining properties;

• State registered underground storage tanks (USTs) (property and adjoining properties); and

• State-listed Asbestos Abatement Notifications for the property.

The Consultant shall review the databases for information on applicable permits and compliance history.

The Consultant will also review available Sanborn and other Fire Insurance Maps from a computer database service company (i.e., EDR). Fire insurance maps typically illustrate historic property uses, operations, and potential environmental features of concern. Historic aerial photographs or mapping must be reviewed to identify/confirm historic property uses.

The Consultant shall review and provide an opinion on all waste storage and releases within the search radius in ASTM E1527-21. These opinions should address direction, distance and type of waste or release, and its potential to impact the subject property.

The Consultant will evaluate the potential Vapor Encroachment Condition (VEC) in accordance with ASTM E1527-21 using guidance specified in ASTM 2600-15.

As part of this task, the Consultant will also generate a property-specific Geographic Information System (GIS) map(s) from the data layers available from the Massachusetts Executive Office of Energy and Environmental Affairs (EOEEA). The GIS map(s) will help to identify the physical setting and sensitive environmental receptors on or near the Property. GIS information, to be shown as applicable, includes:

• Color aerial;

• USGS topographic;

• Hydrographic features;

• Bedrock and surficial geology;

• Conservation areas;

• Protected open spaces, potential and confirmed vernal pools and Areas of Critical

Environmental Concern (ACEC) within 0.5 mile of the Property; and

• Regulated areas (MADEP regulated, FEMA).

Task 1.2 - Local File Review

~ 5 ~

Supplementing the information obtained from federal and state sources, the Consultant shall contact the following local agencies to review available records, permits, and compliance history regarding property operations and oil and/or hazardous material (OHM) releases/spills (or potential for) to the environment at and in the vicinity of the property:

• Assessor’s Office;

• Engineering Department;

• Department of Public Works - Water and Sewer Division;

• Local Fire Department (e.g., registered aboveground and underground storage tank information); and

• Local Health Department (e.g., history of spills, environmental violations or permits).

Task 1.3 - Site Reconnaissance and Interviews

The objective of the property reconnaissance is to identify and document the pertinent features and conditions at and surrounding the property with particular focus on those areas, which may indicate the likelihood of an Oil and/or Hazardous Materials (OHM) release. Property reconnaissance will include the following activities:

• Observations of the exterior grounds to identify periphery conditions, surrounding properties and their uses, abutting roadways, stressed vegetation, on-property wells, potential contamination pathways (i.e., underground storage tanks and utilities, septic systems and leach fields), and known and suspect oil and/or hazardous material waste storage and disposal areas;

• Observations of accessible building interior to identify general building layout/construction, electrical/mechanical rooms, floor drains/trenches, heating and cooling systems, surficial staining;

• Observations of on-site and surrounding environmental features and conditions, including surface water bodies, wetlands, and drainage ditches; and

• Interviews with people who have knowledge of the property shall be conducted. Information associated with interviews shall consist of when and with whom the interviews were conducted (e.g., local/state/federal government officials, past owners, etc.) and the method used to conduct the interviews (e.g., in person, written, telephone).

During property reconnaissance, the Consultant shall photograph significant property and surrounding features for physical documentation purposes.

DCAMM will identify a contact person for each property to ensure site access, to assist in answering any questions, and to provide copies of any documents which exist for the property (i.e., building plans, environmental reports). Other than those agencies and contacts that will be provided by DCAMM to facilitate Tasks 1 and 2, the Consultant will not contact property owners without written approval of DCAMM. Based on field observations and supplied and ascertained property plans and reports, the Consultant shall generate a plan to illustrate the primary property and pertinent surrounding features/conditions.

The Consultant shall prepare and submit a “Red Flag” memorandum to DCAMM within three business days following site reconnaissance. The memorandum shall provide a summary of site observations and confirm the presence or absence of RECs as they are known at that time.

Task 1.4 - Report Preparation

~ 6 ~

The information and data generated from the above-noted tasks will be reviewed, compiled, and presented in a Phase I Environmental Site Assessment Report (the Report). The Report will include a findings and conclusions section that renders one of the following professional opinions:

• The assessment has revealed “no” evidence of Recognized Environmental Conditions in connection with the Property; or

• The assessment has revealed no evidence of Recognized Environmental Conditions in connection with the Property “except” for the following [i.e., a list of specific conditions of concern identified on the Property will be presented].

The Report will include Identification of Historical Recognized Environmental Conditions (HREC) and Controlled Recognized Environmental Conditions (CREC).

If RECs are identified at the Property during the Phase I ESA, a listing of each identified condition is to be provided in the Report. The Consultant will also provide recommendations in a letter separate from the Phase I ESA report to address any identified RECs. The Consultant will send an electronic version of the draft Report and recommendation letter to DCAMM for review and comment prior to finalization. The final deliverable will be a PDF version of the final Report and recommendation letter.

The “Red Flag” memorandum shall provide a summary of the site reconnaissance and confirm the presence or absence of RECs as they are known at that time. The Consultant shall flag additional environmental documents/issues that will warrant additional review and/or may have broader implications to the valuation of the parcels, specific environmental liabilities, and other general concerns.

Task 1.5 - Meetings The Consultant should assume one (1) site visit for each property inspection.

Task 2 -- Hazardous Materials Survey:

Based on the findings noted in the “Red Flag” memorandum, Task 2 may include sampling of suspect asbestos-containing material (ACM), an XRF survey for lead-based paint, and a visual-only inspection for other chemicals and hazardous building materials, including but not limited to, suspect PCBs, mercury, and oil. If suspect materials are identified, DCAMM and the Consultant will evaluate next steps and determine whether lab analysis is recommended.

Hazardous Materials Survey shall occur as follows:

Asbestos The asbestos survey shall be performed by a Massachusetts-licensed asbestos inspector. This individual will inspect accessible interior and exterior areas of the property and record the type, quantity, and condition of suspect ACM. The inspector will collect samples of suspect ACM.

Whenever possible, the samples should be collected in such a way that the sample sites are inconspicuous. Sample sites must be immediately repaired and sealed in a manner that prevents the release of fibers. Suspect ACM will be analyzed by a Massachusetts licensed laboratory using polarized light microscopy (PLM).

Lead Paint The Consultant shall conduct a survey for lead paint using a handheld XRF analyzer. The

~ 7 ~

Consultant shall survey both interior and exterior surfaces for lead paint utilizing industry standard methodology.

PCB-Containing Materials The Consultant shall conduct a visual-only survey to identify suspect PCB-containing materials and equipment or containers that may contain mercury, oil, and other chemicals and hazardous materials. For this task, we are not expecting a detailed inventory of typical household cleaners and detergents.

The Consultant shall prepare a report that contains the results of the hazardous materials survey, including ACM laboratory results, drawing(s) showing the sample locations, and the type, quantity, and condition of materials found. This report shall be separate from the Phase I ESA and a separate report shall be prepared for each property.

5.0 PROJECT PERSONNEL

The Consultant shall identify the personnel assigned to the project. The Consultant will ensure that only personnel with the appropriate experience and credentials will be assigned to the project.

Include a statement of roles and responsibilities for all personnel, along with professional resumes.

6.0 SCHEDULE
