About this file
This is a Federal Supply Schedule (FSS) Justification/Documentation for restricting a procurement to a single manufacturer. The customer agency is N62742, and the contracting activity is ACQ21 Services Branch. The requirement is for PBX Repair and Maintenance Services for a specific Avaya PBX Telephone System, with an estimated total value covering all hardware maintenance, software licensing, on-site technical support, and preventative care during a performance period consisting of one base year, four option periods, and one six-month extension option.
The justification is based on items peculiar to one manufacturer under GSAM/R 538.7104-4, as the particular brand name and product features are essential to the ordering activity's requirements. Market research was conducted among mandatory sources (AbilityOne, UNICOR, Integrated Material Management) and GSA Schedule holders using NAICS code 811213 (Communication Equipment Repair and Maintenance), which identified 68 contractors. However, the research confirmed that while at least two or more capable small businesses exist among GSA Schedule holders, the maintenance of this specific Avaya system requires OEM-certified technicians, proprietary software updates, and specialized diagnostic tools available only through the manufacturer or authorized service providers. The contracting officer determined that fair and reasonable pricing will be established through formal quotes prior to award, and the agency intends to maximize competition by posting a competitive Request for Quote under NAICS code 811213 to encourage small business participation, potentially resulting in a small business set-aside.

4. Authority and Supporting Rationale (see GSAM/R 538.7104-3)

(1)(v) A law expressly authorizes or requires that the purchase be made from a specified source.
Not applicable. See Supporting Rationale for Items Peculiar to One Manufacturer IAW GSAM/R 538.7104-4(b).
5. Supporting Rationale for Items Peculiar to One Manufacturer IAW GSAM/R 538.7104-4(b) Applicable. Items peculiar to one manufacturer must not be acquired unless --:
The particular brand name, product or feature is essential to the ordering activity’s requirements;

The order (or FSS BPA established) is placed competitively, and the file documents the basis for restricting consideration to an item peculiar to one manufacturer.
Not applicable. This FSS Documentation is not for Items Peculiar to One Manufacturer IAW GSAM/R 538.7104-4(b)

Note: IAW DFARS 208.470(d), as revised by Class Deviation 2026-O0017, Rev. 1, Contracting Officers must make a determination of fair and reasonable pricing when using the FSS. Do not rely on the determination of price reasonableness made for establishing the FSS schedule contract.
Formal Quotes will be determined to be fair and reasonable prior to award that is consistent with FAR, DFARS, GSAM/R, and NMCARS.
7. Description of the Market Research Conducted Among Schedule Holders and the Results, or a Statement of the Reason Market Research Was Not Conducted.
Mandatory Sources Review: A review of mandatory sources (AbilityOne, UNICOR, Integrated Material Management) was performed first. It was determined that none of these sources could provide the required "Avaya Phone Service."
GSA Schedule Holders Research: Following the mandatory source review, research was conducted among GSA Schedule holders using GSA Advantage.
A search was performed using the NAICS code 811213 (Communication Equipment Repair and Maintenance).
The search identified 68 contractors listed under this code.
Results: The key finding of the research was that among the 68 identified contractors, there were at least two or more capable small businesses identified that could perform the required maintenance and repair services.
8. Any Other Facts Supporting this Justification/Documentation.
This requirement is for the repair and maintenance of a specific Avaya PBX Telephone System.
Maintenance for such systems often requires OEM-certified technicians, access to proprietary software updates, and specific diagnostic tools that may only be available through the manufacturer or a limited number of authorized service providers.
