Pojoaque Basin Regional Water System R16PS00829-Step 1 Amendment 1 Questions and Answers

1) Document reference: Solicitation R16PS00829 PBRWS, Section L.12, Page 60 of 75, Step 1-Factor 1 Design Builder Profile/ Experience.

For each of the three experience requirements, the requirements state, “for New Construction and/or Construction Projects with features similar to the intake structure, water treatment plant, and/or ancillary facilities required for this project.”

Question: Does this mean that every project submitted under Factor 1 must contain all of these features or can a proposer submit projects that have some of the features, such as a water treatment plant without a pipeline or a pipeline project without a water treatment plant, as long as all features are included within the five (5) submitted projects?

Answer: The offeror must decide what experience to provide which will meet the minimum requirement for this factor. An offeror providing experience which exceeds the minimum acceptable level may achieve a higher rating. Conversely, if an offeror provides less than the minimum acceptable level may achieve a lower than acceptable rating.

Question: Per the RFP, Offerors are to, “provide evidence of up to five (5) projects completed within the last eight (8) years.” May the Offeror include construction projects that are substantially complete? Please clarify what level of completeness is required for the projects.

Answer: Projects that are completed are 100% completed.

3) Document reference: SF1442 and I.11 52.228-01 Bid Guarantee

Question: The SF 1442 notes that an offer (bid) guarantee is required for the contract. Please confirm that a bid guarantee is not required for the Step One submission. If the Government would like a letter of bondability submitted with the Step One Statement of Qualifications, please confirm the form in which the letter should be submitted and a range of construction values to be included in the letter.

Answer: A bid bond will be required for Phase 2 of the evaluation process.

4) Document reference: None

Question: As a Federal project on Federal lands, please confirm that a New Mexico State contractor’s license is not required.

Answer: The subject lands are not Federally owned. The contractor must be Licensed prior to performing work (design and construction) in the state of New Mexico.

Question: Per the RFP, offerors are to complete a Project Information Worksheet for each identified project. The reader is then directed to the SF-330, included in Section J. Please confirm that the offeror is to use SF330, Part I, Section F as the Project Information Worksheet. Or may we use a form like the one attached (which was previously provided by the Bureau of Reclamation for a separate solicitation)?

Answer: Offerors shall use the SF-330.

6) Document reference: L.12 WBR 1452.215-81 General Proposal Instructions Bureau of Reclamation, Step One – Request for Qualifications, Volume II, Qualification Proposal, Step 1-Factor 2: Project Team Organization and Key Personnel, p. 61 of 75 AND Step Two – Request for Proposal, Step 2-Factor 3: Partnering and Teaming Agreements, p. 65 of 75

Question: The RFP refers to SF40 (or SF 40), which is to be used to submit key personnel resumes. No SF40 was provided as part of the RFP. Should these references refer to the SF 330? If not, please provide an SF40.

Answer: These references refer to the SF 330

7) Question: For submittal of the proposal, is early hand-delivery possible? For instance, Friday, September 9 before 4 PM?

Answer: Early submission is acceptable, Hand-delivery is acceptable must be delivered to room number 8100 Upper Colorado Mail Room.

8) Question: Are previous recently submitted PPQs, even if in slightly different format with the same content, acceptable? May they be included in this proposal submittal to meet the requirements of Step 1-Factor 4:

Past Performance?

Answer: In accordance with the solicitation. Past Performance Questionnaires shall be submitted on the form included in the solicitation (attachment #4 entitled past performance questionnaire). The Government may also use past performance information obtained from other than the sources identified by the Offeror.

9) Question: Please exclude the executive summary from the 100-page limit for Volume II.

Answer: The executive summary pages ARE included in the 100 page limit.

10) Question: Please confirm that there is no individual page limit for the five (5) projects submitted in Factor 1?

Answer: All factors are included in the page limitation.

11) Question: Please confirm that each resume in Factor 2 is limited to 4 pages?

Answer: Each resume in step 1 factor 1 is limited to 4 pages.

12) Question: Page 66 of 1017 (4th line at the top of the page) states - “Failure to include a fully completed SF40 shall affect the overall rating of the Offeror’s proposal.” We are not familiar with this form, please provide and editable copy of the SF40 for completion.

Answer: These references refer to the SF 330 (a replacement page has been attached).

13) Question: Please confirm that while Factors 1 and 2 are to be submitted on SF330 forms (as provided in the RFP), Factors 3 and 4 are in a format of our choosing.

Answer: Step 1 factor 3 can be submitted in the format of the offeor’s choosing Step 1 factor 4 entitled Past performance must be submitted using attachment # 4 of the solicitation entitled Past performance questionnaire. Factor 3 is of the offerors’ choosing. All factors are included in the page limitation.

14) Question: Can you please clarify the date that Reclamation is targeting for the completion of the 90% design and Final Design? There are a couple of conflicting dates, as follows;

� Section F.2 52.211‐10 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK APRIL 1984: c) complete final designs by April 15, 2018, and

� SECTION 01 11 00-SUMMARY OF WORK, PART 1 GENERAL, Page 7; Schedule: Achieve the scheduled completion date of April 15, 2018 for 90% design and August 15, 2021 for construction, commissioning and performance testing of the Project, including OM&R.

Answer: A replacement page has been attached.

15) Question: Can you please clarify the date that Reclamation is targeting for the completion of the Construction Phase and also the date targeted for completion of the Post-construction Phase (6-Month O&M Training). The Solicitation notes construction completion by August 15, 2016 and in another location it notes Construction completion including the OM&R by August 15, 2021. However, the period of performance is noted as ending on 12/31/2021.

� Section F.2 52.211‐10 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK

Answer: June 15, 2021 is the correct date (a replacement page is attached)

Performance Work Statement many of the desired project features as feasible.

The Owner’s objectives for delivery of the Project described below are as follows:

Quality: Provide treatment facilities and equipment that will be sustainable [1] and will reliably produce up to 4,000 acre-feet per year of finished water in full compliance with federal and state regulations and contractual standards for water quality over the range of raw water quality conditions set forth in the Pilot Water Treatment Plant pilot study, anticipated to be completed in the Summer of 2016. The project needs to be designed and constructed to operate through a wide range of production quantities, while delivering water that meets federal clean drinking water standards for all customers, varying from 170,000 gallons per day on average for the first three to five years of operation for a Pueblo de San Ildefonso pueblo only system to an estimated 6.23 million gallons per day to meet ultimate peak daily demand. The design-build and design-bid-build portions of the PBRWS shall be compatible so the system can be operated together as a single regional water system. The Project must be able to account for water diverted from the Rio Grande in accordance with the New Mexico Office of the State Engineer’s permit requirements. The finished water produced by the WTP shall be compatible with the groundwater supply produced by existing wells identified in Section 01 56 50, figure 56.5 The system will also provide fire protection, as described herein, for the service area depicted in Figure 86. See Section 01 86 14 and figures 86.1 through 86.3 for more information about fire protection requirements. Comply with all environmental commitments and Native American Graves Protection and Repatriation Act (NAGPRA) plans of action required by federal, state, local and tribal permits. Minimize road closures and utility outages during construction.

· Life-Cycle Cost: The total available budget for design, construction and post construction activities covered under this contract is expected to range between $75 million to $100 million.

The owner’s objectives include minimizing life-cycle costs.

· Schedule: Achieve the scheduled completion date of April 15, 2018 for 90% design and August June 15, 2021 for construction, commissioning and performance testing of the Project, including OM&R.

· Risk: Achieve an optimal balance of risk allocation between the Owner and the Design-

F.2 52.211‐10 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK APRIL 1984

The Contractor shall be required to

(a) commence design work under this contract within 14 calendar days after the date the Contractor receives the notice to proceed, and

(b) prosecute the work diligently, and

(c) complete final 90% designs by April 15, 2018, and

(d) complete construction phase no later than August June 15, 2021. The time stated for completion shall include final cleanup of the premises.

F.3 52.211‐12 LIQUIDATED DAMAGES – CONSTRUCTION SEPTEMBER 2000

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $3,889.85 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor’s right to proceed, liquidated damages will continue to accrue until the work is completed.

These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

F.4 52.211‐13 TIME EXTENSIONS SEPTEMBER 2000

Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.

The offeror shall also provide a:

I. Responsibility Matrix to clearly identify roles and responsibilities between the key positions

II. Personnel Management Plan to show how the positions will be managed throughout all project phases III. Organization Chart(s) indicating which firm each key position works for and who they report to

Failure to include a fully completed SF-330 40 shall affect the overall rating of the Offeror’s proposal.

Step 1-Factor 3: General Technical Approach Based on the information presented in Section C, the offerors shall submit the following:

a) Narrative description of the overall work plan. The narrative description shall be concise and complete, addressing the design, construction, and post-construction phases of this project.

b) Milestone schedule for the design, construction, and post-construction phases of this project.

c) General means and methods for executing work, addressing the principal components of the performance work statement.

d) Means and methods for quality control for design.

e) Means and methods for quality control for construction.

f) List of projected risks and mitigation measures for the work required by this project.

Step 1-Factor 4: Past Performance The offeror shall provide past performance questionnaires (PPQs) on all projects identified under Factor 1: Experience and Subfactor 1a, 1b, and 1c. The offeror shall submit the PPQs to their references and have the references complete and return the questionnaires via email to wbennett@usbr.gov by the date and time indicated on the form. The PPQ is included in Section J, Attachment No. 5: Past Performance Questionnaire.

The Government shall consider the information provided by the references, and may also consider information obtained from other sources when evaluating an offerors past performance.

a) The Past Performance Information Retrieval System (PPIRS) database located at http://www.ppirs.gov is one of the sources that the Government may use to obtain past performance information. PPIRS functions as the central warehouse for performance assessment reports received from several federal performance information collection systems and is sponsored by the DOD E- Business Office and administered by the Naval Sea Logistics Center Detachment Portsmouth.

b) If negative feedback is received from an Offeror’s reference, the Government will compare the negative response to the responses from the offeror’s other references to note differences. A rating will be assigned appropriately to the offeror based on the information. The offeror will be given the opportunity to address adverse past performance information obtained from references on which the offeror has not had a previous opportunity to comment, if that information makes a difference in the Government’s decision.

c) Past performance information will be used for both responsibility determinations and as an evaluation factor for award. The Past Performance Questionnaires identified in section J will be used to collect information on an offeror’s performance under existing and prior contracts/subcontracts for products or services similar in scope, magnitude, relevance, and complexity to this requirement. References other than those identified by the offeror may be contacted by the Government and used in the evaluation of the offeror’s past performance.
