thatsomeoftheinformationpostedtothenon‐publicsegmentofFAPIISiscoveredbyadisclosureexemptionunder
theFreedomofInformationAct,theGovernmentofficialwhopostedtheinformationmustwithin7calendardays
removethepostingfromFAPIISandresolvetheissueinaccordancewithagencyFreedomofInformationprocedures,
priortorepostingthereleasableinformation.Thecontractormustcite52.209‐9andrequestremovalwithin7
calendardaysofthepostingtoFAPIIS.
(2)TheContractorwillalsohaveanopportunitytopostcommentsregardinginformationthathasbeenpostedbythe
Government.Thecommentswillberetainedaslongastheassociatedinformationisretained,i.e.,foratotalperiodof
6years.ContractorcommentswillremainapartoftherecordunlesstheContractorrevisesthem.

pastperformancereviews,willbepubliclyavailable.

52.228‐13 ‐‐ Alternative Payment Protections (Jul 2000)

(a) The Contractor shall submit one of the following payment protections:

(i)Apaymentbond.
(ii)Anirrevocableletterofcredit(ILC).

Thecontractorshallfurnishallbondsoralternativepaymentprotection,includinganynecessaryreinsuranceagreements,
beforereceivinganoticetoproceedwiththeworkorbeingallowedtostartwork.
(b)Theamountofthepaymentprotectionshallbe100percentofthecontractprice.
(c)Thesubmissionofthepaymentprotectionisrequiredwithin__7___daysofcontractaward.
(d)Thepaymentprotectionshallprovideprotectionforthefullcontractperformanceperiodplusaone‐yearperiod.
(e)Exceptforescrowagreementsandpaymentbonds,whichprovidetheirownprotectionprocedures,theContractingOfficer
isauthorizedtoaccessfundsunderthepaymentprotectionwhenithasbeenallegedinwritingbyasupplieroflaboror
materialthatanonpaymenthasoccurred,andtowithholdsuchfundspendingresolutionbyadministrativeorjudicial
proceedingsormutualagreementoftheparties.
(f)Whenatripartiteescrowagreementisused,theContractorshallutilizeonlysuppliersoflaborandmaterialthatsignedthe
escrowagreement.
