About this file

This document contains the questions and answers from a question-and-answer session related to an Invitation for Bid (IFB) for cleaning services with the State of Illinois. The solicitation is for cleaning services, with the vendor supplying all but three of the line items. Vendors may submit a bid even if they do not include all items, but the State intends to award the contract to the vendor who can supply all requested items. The State will no longer have public bid openings, but will provide a Bid Tab report containing all vendor quotes within an hour of the bid opening. The Prompt Pay Act and Vendor Payment Program are discussed, as well as the requirements for the Business Enterprise Program (BEP) Utilization Plan and Good Faith Effort documentation. The contract does not require prevailing wage, and the warranty section applies to the state of the merchandise used to fulfill the contract. Vendors capable of servicing all state entities and locations must still meet the 10% BEP goal or request a waiver. The BEP goal can only be achieved by utilizing BEP vendors associated with the solicitation's NIGP codes, and the approved vendor list must be used for the Good Faith Effort waiver.

The contract will be available for use by all State of Illinois governmental units and qualified not-for-profit agencies. Vendors can expect payment in accordance with the State Prompt Payment Act and the Vendor Payment Program options outlined on the state's website.

Questions and Answers

Question 1:Do I have the liberty to bid on the products that I chose to and not respond to the cleaning services?
Answer 1:The solicitation is for cleaning services with the Vendor supplying all but three of the line items. Vendors may submit a bid even though they do not include all items; however, the State intends to award the contract to the Vendor who can supply all items requested.
Question 2:Will there be a bid opening when it is time for the bid to be opened?
Answer 2:We are no longer having public bid openings as a rule; however, we will have a Bid Tab report available within an hour after the bid opens that will contain the quotes from all Vendors along with the pricing submitted. Vendors may request a copy of this report via email to Martha.Blackwell2@illinois.gov without a FOIA request. The report will only contain the information that would have been read at a public opening.
Question 3:In regard to the State Prompt Pay act and the length of time it takes the State to pay, what are Vendors supposed to do and how does it work?
Answer 3:The Prompt Pay Act expedites payments that are past the 90-day limit. There is another third-party option that is called the Vendor Payment Program. Both options can be found on the www2.illinois.gov website.
Question 4:Concerning the Good Faith Effort for the BEP Utilization Plan, what documentation is to be submitted?
Answer 4:The Good Faith Effort Log is to be used to record all communication with the BEP Vendors when trying to establish the BEP Goal. All email documentation along with the log showing who was contacted and when they were contacted, along with the responses are to be submitted with the bid.
Question 5:What does the 10 days allowance refer to in reference to the Utilization Plan?
Answer 5:When bids are submitted that include a required Utilization Plan and there is a small deficiency, the State can allow up to 10 days to resolve. For instance, if you contacted 5 Vendors and submitted documentation for 4 but forgot the 5th, we may allow you to ‘cure’ by submitting that omitted documentation, if you were the low bidder. It does not allow you to submit your bid without the Utilization Plan or Good Faith Effort, if required.
Question 6:Section 4.1.4 Prevailing Wage: Normally prevailing wage is not applicable to the products in this bid document. I understand that this may be a boiler plate language for your contracts but can you clarify from the States perspective if this applies to items listed in this bid and if Yes. Would you be able to provide the clarification on what classification is applicable?
Answer 6:Prevailing Wage does not apply to this contract as it is not marked in Section 5.
Question 7:Section 4.25.1 This warrant is on this section is typically not applicable to weekly rental services. Can you add clarification for this?
Answer 7:As this is a services contract, this section would refer to the state of the merchandise being used in fulfilling the contract. It would pertain to the Vendor meeting the specifications outlined for the items to be used in fulfilling the contract. The only part that would not really apply would be “be merchantable” as we are not selling the items; however, that statement is applicable in the sense that we want the items to be in that state (merchantable” as opposed to be frayed, ragged, or anything like that.
Question 8:If a vendor has the capabilities to service all state entities and locations and doesn’t need to subcontract any services, does the vendor still have to meet the 10% BEP goal?
Answer 8:Yes; or do a Good Faith Effort and request a waiver of the goal if no agreement can be reached with a BEP Vendor.
Question 9:If so, can the 10% BEP goal, be achieved by a vendor spending 10% of its sales on supplies and services from BEP vendors?
Answer 9:The BEP goal can only be achieved by utilizing BEP Vendors associated with the solicitation to fulfill the contract. The NIGP codes associated with the solicitation are outlined in the IFB document.
Question 10:If we seek a Good Faith Waiver as we work to achieve this goal, are only those vendors on the attached approved vendors list permitted to be used to achieve this goal?
Answer 10:If you have a BEP Vendor who can fulfill the goal with one of the associated NIGP codes that is not on the list attached to the solicitation, then you can use that Vendor to fulfill the goal, provided they are registered with the State of Illinois Diversity Compliance unit, for the appropriate NIGP code at the time the bid is submitted. Vendors not on the list cannot be used for the Good Faith Effort Waiver.
Question 11:Can you provide a listing of the service addresses that require service under this contract?
Answer 11:We do not have a complete list of all service addresses. Please keep in mind that this contract will be available to all State of Illinois governmental units as defined in Section 1-15.100 of the Illinois Procurement Code, officers of the State of Illinois, any public authority which has the power to tax or any other public entity created by statute. In addition, all qualified not-for-profit agencies under Section 45-345 of the Illinois Procurement code may use it.
Question 12:I know this question was asked, but would like to better understand the State Prompt Payment Act and how vendors can expect to be paid for services?
Answer 12:See Answer 3 above.
