About this file
This document is a Questions and Answers template for a Request for Certified Quotation (RFCQ) issued by the Oregon Department of Transportation (ODOT) for the Mosier Deicer Containment Structure project. The solicitation seeks one (1) certified Emerging Small Business (ESB) Contractor to construct a new concrete deicer containment structure designed to prevent deicer spills, with the primary goal of environmental protection and operational safety for ODOT.
The document specifically addresses a clarification regarding Performance and Payment bonds, confirming that these bonds are required for the project even though the contract value may be under $100,000. The bond requirement is detailed in the State of Oregon General Conditions for Public Improvement Contracts, which stipulates that bonds may be necessary for contracts below the $100,000 threshold if specified in the solicitation documents. The precise language allows for bond requirements to be determined by the specific contract documents, ensuring financial protection for the project regardless of the total contract value.

ESB Mosier Deicer Containment Structure
· Could you please confirm per SGC-9, G.2.1, Performance and Payment bonds would not be required for contracts under $100,000.00? The Payment and Performance Bonds are required as they were included in the solicitation documents. Please note that SGC-9 only amends the first sentence of Section G.2.1 of the State of Oregon General Conditions for Public Improvement Contracts. Please see below for the full section as the last sentence states Bonds may be required if less than $100,000 if required in the solicitation documents:
“G.2.1 When the Contract Price is $100,000 or more (or $50,000 or more in the case of Contracts for highways, bridges and other transportation projects) the Contractor shall furnish and maintain in effect at all times during the Contract Period, a performance bond in a sum equal to the Contract Price, and a separate payment bond also in a sum equal to the Contract Price. The bonds may be required if the Contract Price is less than the above thresholds, if required by the Contract Documents.”
