About this file

This is a Questions and Answers document issued by the Oregon Department of Transportation (ODOT) for the 2026 ESB US101 Fence Replacement (Gold Beach) Project, RFCQ #S-73000-00016379. The project involves the reconstruction of 726 linear feet of Type 2 barbed and woven wire fence along US Highway 101 at milepost 324.5 in Gold Beach, Curry County, Oregon. The scope includes removal of remaining deteriorated fence materials (t-posts), installation of new fence posts with concrete footings, reattachment of three existing braces, and connection to existing endpoints on both north and south ends. The bid submission deadline is April 16, 2026, with substantial completion required by June 15, 2026, and final completion by June 26, 2026. Liquidated damages are assessed at $50.00 per calendar day for delays beyond substantial completion. The Notice to Proceed will be issued following receipt of required documentation from the awarded contractor, including contractual insurance certificates.

This procurement is restricted to Emerging Small Business (ESB) certified contractors with a current State Construction Contractors Board (CCB) license and public works bond. No prevailing wage requirements apply as the project is not expected to exceed the cost threshold triggering such requirements. Contractors must maintain commercial general liability insurance with per-occurrence limits of $1,000,000 and annual aggregate limits of $2,000,000, commercial automobile liability insurance with per-occurrence limits of $1,000,000, and performance and payment bonds equal to the contract price. Final payment will be based on actual measured quantities installed, with mobilization as a separate bid item and concrete footings following Specification Section 00440 for Commercial Grade Concrete. Awarded contractors must perform at least 51 percent of labor using their own workforce and comply with all Oregon wage and hour laws and Title VI non-discrimination provisions.

Questions and Answers #2

RFCQ # S-73000-00016379

2026 ESB US101 Fence Replacement (Gold Beach) Project

1. Old fence removal: Is the contractor responsible for removing and disposing of the existing deteriorated fence wire and posts along the 726 LF run? If so, is there a pay item for this, or is it incidental to the fence unit price?

a. The old fence has been removed except for a few t-posts throughout that will need to be removed.

2. Traffic control: Is a formal Traffic Control Plan required for this work? Will flagging operations be required on US101? Is there a separate pay item for traffic control, or is it incidental?

a. No, a traffic control plan is not required nor are flaggers as the work is approximately 75 feet to the east of highway 101.

3. Prevailing wage classification: What BOLI wage class governs fence installation on this project

— Fence Erector, Highway Construction Laborer, or other? Can ODOT confirm?

a. This project is not expected to exceed the cost threshold that would require the application of prevailing wage rates.

4. Soil conditions at brace locations: Are there known underground obstructions (rock, old concrete footings, utilities) at the two compromised brace locations?

a. The existing braces are set in concrete. As for utilities it is the contractor’s reasonability to call for a locate.

5. Post hole depth at footing: The standard drawing shows a minimum 18" embedment for brace posts. Is ODOT requiring a deeper footing given the compromised condition? Will the engineer approve depth as installed?

a. A deeper footing other than what is shown on the standard drawing will not be required.

6. Measurement / pay quantity: Is the 726 LF quantity already exclusive of gate openings (measured C-to-C), or should bidders expect a field adjustment at final payment?

a. The fence will be measured once the project has been completed to verify the quantity installed.

7. NTP timing: When does ODOT anticipate issuing NTP? The June 15 substantial completion date is tight — clarify if NTP will be issued with enough lead time for a reasonable construction window

a. The Notice to Proceed timeline will be determined by when we receive the required documentation from the awarded contractor, including the contractual insurance.

8. Endpoint conditions: Is the existing T-post on the north end and existing post on the south end in good enough condition to tie into without replacement? Or is replacement a possibility?

a. They are in good condition and don’t need to be replaced.

9. Gate brace at north end: The RFQ mentions a gate post brace that must be reattached at the north gate post. Is this the same as one of the two "compromised braces," or is it a third brace work item?

a. There are three separate braces that need to be reattached. The existing braces were all connected the same way to the posts.

10. Insurance requirements: The Sample Contract references specific insurance coverage. What are the limits (GL, auto, workers comp, umbrella)? This affects whether a certificate can be provided within 7 days of award.

a.

11. OregonBuys bid schedule format: Does ODOT require a separate line item for mobilization on the bid schedule, or is it embedded in the per-LF fence price?

a. Mobilization is a separate bid item.

12. Inspection / testing: Is any special inspection required for the concrete footing (such as mix design submittal, inspector presence, cure time hold)?

a. The concrete footing shall follow Specification Section 00440- Commercial Grade

Concrete (CGC). If using field mixed concrete it must be from the Qualified Products List (QPL). According to specification section 00440.14 CGC mixture may be accepted visual for Fence Post Footings. For further details please refer to Specification Section 00440- Commercial Grade Concrete (CGC) in the Oregon Standard Specifications for Construction.
