Prescribed by GSA, FAR (48 CFR) 53.243
1) PROVIDE QUESTIONS AND ANSWERS AS SUBMITTED IN RESPONSE TO THE RFP
Q1: Our firm is requesting an extension of the due date of the proposal for Solicitation QMAA-F6-180011-D to Wednesday, August 1st, for the submission of pricing and Thursday, August 2nd, for the submission of the proposal.
A1: After consultation with the Vehicle Purchasing Director, unfortunately GSA cannot extend the due date for proposals. Offerors are provided 4.5 weeks (31 calendar days) for proposal preparation, which is longer than in several previous years. GSA has made it known for some time that it intended to post the RFP on 6/25, which is exactly what occurred (this information is always posted in the Pre-Solicitation Notice). GSA can appreciate the staffing challenges; however, Technical Evaluation Boards and other GSA resources are already scheduled, with similar schedule and resource constraints.
Q2: In the 2019 bid is there a way our firm could offer the vehicle ordering agency as an option to use a soon to be surplussed vehicle from their fleet as a trade-in to reduce their purchasing price? I know we would have to have a system for the ordering agency to self-rate their vehicle and we could offer a set price reduction for different models and vehicle rating. I am not sure if this is even possible with GSA rules for surplus vehicles, but if we could forgo the need for them to have to send it to GSA auction and at the same time get the agency a discounted purchase price, they may be able to better stretch their vehicle budget.
A2: Trade-ins are not allowed under the purchase program. Each agency-owned vehicle is handled according to the individual agency's disposition guidelines. All prices offered and awarded are firm for the duration of the model year.
Q3: Are there any significant year-over-year changes to the FAR clauses?
A3: The following significant changes are provided for the 2019 model year:
Significant Changes
Offerors are advised to pay particular attention to the following Solicitation sections, which have been revised or added for the current RFP. Q4: Can GSA provide a copy of the Power-Point slides presented during the Pre-Proposal Conference on June 28, 2018?
A4: GSA will post the Pre-Proposal Conference slides to FBO at:
https://www.fbo.gov/notices/384ee9fb1e395410997115d7319da83f.
Q5: For the law enforcement upfit packages (LU options), do the technical exceptions need to go on the individual worksheets as well as a master LU Technical Exceptions Worksheet (TEW)?
A5: GSA Engineering has determined that offerors’ technical exceptions to each LU package should be entered in the space provided on each individual worksheet (provided in Attachment Q to the solicitation). The master LU TEW (Attachment R to the solicitation) is no longer necessary, and will be removed from the requirements (see Section 3 of this Amendment, below).
Q6: Some of the LU purchase descriptions are listed without packages.
A6: All LU packages were provided in Attachments G01 through G34 to the solicitation, and can be found on FBO at https://www.fbo.gov/notices/384ee9fb1e395410997115d7319da83f.
Q7: If the trim level name has changed but the vehicle is the same do we need to list it as an exception?
A7: If a trim level has changed from what is listed in the Schedule of Items, offerors should list any changes to trim levels or trim names on the Technical Exceptions Worksheet (see Attachment E), and GSA Engineering will address them during the technical evaluation.
Q8: I have found some listing in AutoBid showing a trim level of SEL already listed, but the base model is the SE. Does GSA want our firm to bid the SEL model or the base SE?
A8: The trim levels listed in the Schedule of Items/AutoBid reflect the information submitted during the AutoStandards process and approved by GSA Engineering. If a vendor would like to offer an alternate trim level, that vendor should list any changes to trim levels or trim names on the Technical Exceptions Worksheet (see Attachment E), and GSA Engineering will address them during the technical evaluation. Please note, the vehicle offered must provide all the equipment labeled as a minimum requirement in the Schedule of Items. This equipment can often drive a higher trim level.
Q9: Does the restriction of only being able to offer one vehicle per line item apply if you are offering two different brands or only to the same brand?
A9: Yes; all offerors are subject to the same limitation and must choose only one model to offer for each Standard Item even if the firm is able to offer two brands. See Section B.3 (Offerors may propose one or more standard item numbers solicited herein, but may only offer one model per standard item number) and Section G.4 (Offerors may propose one or more standard item numbers solicited herein, but may only offer one model per standard item number). Due to Systems constraints, GSA is unable to award multiple models to the same vendor under the same standard item number. This restriction applies uniformly to all potential offerors.
Q10: Does the statutory price limitations apply to the base vehicle price excluding options and destination charges or is it the total price?
A10: 41 CFR 101-26.501 governs the application of additional systems and equipment (AS&E) in the context of the statutory price limitations:
§ 101-26.501 Purchase of new motor vehicles.
(a) It shall be the policy to procure commercially available motor vehicles, unless other vehicles are specifically required.
(b) New sedans, station wagons, and light trucks (other than those to be used for law enforcement or where other than standard vehicles are required) shall be procured as follows: Sedans, class IB-subcompact or II-compact; station wagons, class I-subcompact or class II compact vehicles, as described in Federal standard No. 122; and light trucks as defined in Federal standard Nos. 292 and 307. (Federal standard Nos. 122, 292, and 307 as used in this section mean the latest editions.)
Requisitions submitted to GSA for motor vehicles shall be in conformance with the requirements of subpart 101-38.1.
(1) Standard passenger vehicles as defined in Federal standard No. 122 are considered to be completely equipped for ordinary operation and are subject to the maximum statutory price limitation.
(2) Items (vehicles) included in Federal standard No. 122 other than those listed as standard (basic units) are considered to be equipped with additional systems and equipment for passenger vehicles.
(c) Requisitions submitted to GSA for the acquisition of new passenger vehicles and light trucks under 8500 GVWR (gross vehicle weight rating) shall be in conformance with Pub. L. 94-163 and Executive Order 12375.
(d) New trucks and buses shall be requisitioned in accordance with the provisions of this § 101-26.501 and the following:
(1) Light trucks shall be in accordance with Federal standard Nos. 292 and 307; and
(2) Medium and heavy trucks and buses, when not procured from standardized buying programs, shall be in accordance with the latest editions of Federal standard No. 794, Federal specification Nos. KKK-T-2107, 2108, 2109, 2110, 2111, and Federal specification No. KKK-B-1579. Standardized buying programs shall be based on these specifications as appropriate.
(e) Selection of additional systems or equipment in new vehicles shall be made by the requiring agency and shall be based on the need to provide for overall safety, efficiency, economy, and suitability of the vehicle for the purposes intended pursuant to § 101-38.104-2.
(1) The essentiality of such systems or equipment shall be weighed against the economic factors involved, the potential benefits to be derived therefrom, and the impact on the fuel consumption characteristics of the vehicle.
(2) Additional systems or equipment requested to be purchased by GSA will be construed to have been determined essential for the effective operation of the vehicle involved by the agency head or a designee. When systems or equipment other than those listed in Federal standards are requested, these systems or equipment shall be considered and treated as deviations under § 101-26.501-4(b).
GSA has interpreted this language to mean any equipment on the base vehicle above what is “completely equipped for ordinary operation” is considered to be additional systems and equipment (AS&E). Optional equipment and destination charges are not factored into this calculation. As an example, equipment necessary for ordinary operation would be the vehicle frame, body, wheels, engine, transmission, doors, electrical systems, etc. Additional systems and equipment (AS&E) could cover such things as power windows, radio equipment, backup camera, spare tire, etc. Such additional systems and equipment (AS&E) may be included in the Government’s minimum requirements, but are not necessary for the “ordinary operation” of a passenger motor vehicle. As such, vendors may assign a dollar value to AS&E for the base vehicle in AutoBid for GSA to consider in determinations of statutory price limitations compliance.
In order to make this compliance determination, GSA uses the following formula:
Offered price - (destination charges + AS&E figures) = SPL calculation (The SPL calculation must be at/below the applicable statutory price limitation)
The following chart lists a few examples of fictional SPL calculations:

Line Item 10B.1 would be considered compliant, factoring in destination charges and AS&E.
Line Item 17.1 would be considered compliant, factoring in destination charges, AS&E, and the higher police-type vehicle limitation.
Line Item 7.1 would be considered compliant without factoring destination and AS&E charges (offered price already below the stated limitation).
Line Item 9P.1 would be considered compliant because SPL does not apply to any vehicle that is a commercial item and which operates on alternative fuel, including but not limited to electric, plug-in hybrid electric, and hydrogen fuel cell vehicles.
Line Item 8C.1 would be compliant on the surface, but the SPL calculation is so low as to require additional clarification from the offeror (it is unlikely that AS&E would be over twice as much as the SPL calculated price).
Line Item 9C.1 would not be compliant, even when factoring in destination charges and AS&E.
GSA does not require vendors to indicate what equipment is included in its AS&E pricing with offers, but offerors should maintain this information in the event of an audit.
Q11: How do we change the model year from 2019 to 2020 on particular models?
A11: Offerors are instructed to input this request on the Technical Exceptions Worksheet.

3. PROPOSAL PREPARATION
(a) Read the entire solicitation document prior to preparation of your offer. This solicitation contains a checklist outlining the elements required for an offer to be considered complete. Offerors shall complete the checklist and submit it with their proposal. Incomplete offers may be rejected without further consideration.
(b) All offers shall be compiled and submitted electronically. Offerors are notified that the file size of each individual email constituting their proposal must not exceed 25MB. All Volumes must be received by the due date/time specified in the RFP or the proposal as a whole may be considered late. Offerors should retain a copy for their reference. Proposal documents should not be submitted individually. The file size limitation for electronic submissions is 25MB (megabytes) per email.
(c) The Offeror is required to provide electronic copies of signed versions of the SF1449 and other proposal documents.
(d) The Offeror is advised that the Federal Standards and the Offeror’s technical and price proposals, if accepted by the Government, will form binding parts of the contract that results from this solicitation along with Section C – Additional Requirements and Section D – Solicitation Clauses. Therefore, care must be taken to properly address the requirements set forth in the RFP.
(e) These instructions set forth requirements for preparation and submission of proposals and to establish format and specific content of each offer.
