About this file
This is a Question and Answer Sheet for a Colorado state procurement (DQ1 2017-0742) regarding liquid oxygen (LOX) supply services. The State of Colorado owns a 6,000-gallon storage tank that was installed in June 2016 and first filled in October 2016. The oxygen is for industrial use, not ozone generation, and must be delivered and monitored to prevent tank depletion, as the loss of supply would result in the death of over one million fish. The current telemetry unit is wireless and operates on the Verizon network. Standard delivery expectations are 24 to 48 hours after order receipt, with vendor responsibility for tank monitoring and reordering when levels reach 66 inches.
The procurement was re-bid due to a pricing error by the previous winning bidder, and no current supplier information or prior pricing is available for reference. The State of Colorado requires acceptance of its purchase order terms and conditions without modifications and reserves the right to reject bids that include vendor-proposed alternative language as non-responsive. The vendor is responsible for maintaining monitoring and fill schedules to ensure continuous supply, with penalties applicable for failure to meet the 24 to 48-hour delivery standard given the critical nature of the service. The State does not require NSF 60 certification and is utilizing industrial-grade LOX for this application.

Question and Answer Sheet
DQ1 2017*0742
1) Who is your current supplier?
i. Answer: n/a
2) What is your current pricing?
i. Answer: A pricing error by winning bidder is why the LOX is going back to bid
3) Is the oxygen being used to generate ozone:
i. Answer: No
4) Do you require NSF 60 certified product?
i. Answer: Don’t know what that means. We are using industrial grade LOX.
5) If we take exceptions to items contained in your bid and offer up alternative language, will we be considered non-responsive? Do you need to see these exceptions prior to bid submittal?
i. Answer: On page 7 of the bid solicitation document, on the bottom half of the page, “Do you accept Colorado PO Terms and Conditions without modifications?” – We have stated that we, as the State of Colorado, reserves the right to reject the incorporation of vendor terms and conditions including potentially determining that a bid with vendor terms and conditions is non-responsive.
6) Do you own your tank(s)? If so, what size?
i. Answer: Yes, 6000 gallon
7) What was your actual annual consumption in 2015:
i. Answer: n/a –tank was installed in June 2016 and filled in October 2016 for first time.
8) The bid references a telemetry unit – do you have a phone line and power at the pad or is current telemetry unit wireless:
i. Answer: Current unit is wireless. Verizon is the best carrier in our area.
9) In your PO Terms & Conditions you reference “Time is of the Essence”. Standard delivery time is 24-48 hours after receipt of order. Is this sufficient? Is there a penalty if this time frame is not met?
i. Answer: The vendor is responsible for monitoring the tank via telemetry and filling when tank becomes low. Currently a call for reorder goes out at 66 inches and tank is filled within 48 hours. Tank cannot run out or over a million fish will perish.
